726. As per <strong>the</strong> joint statement: “In <strong>the</strong> light of assurances<br />

given to <strong>the</strong>ir senior leading counsel<br />

and in view of his advice, Leigh Day withdraw any<br />

allegation that <strong>the</strong>re has been impropriety on <strong>the</strong><br />

part of Trafigura or any of its legal advisors, (including<br />

Macfarlanes) in investigating <strong>the</strong> claims.”<br />

727. A total of 9 drivers have made statements to<br />

Trafigura: 7 drivers, an assistant of a driver who<br />

died in 2008 and a driver who died in 2009. The<br />

nine Ivorian drivers had been hired to take <strong>the</strong><br />

<strong>toxic</strong> waste from <strong>the</strong> Probo Koala to Akouédo.<br />
