Recommendations to<br />
<strong>the</strong> European Union and<br />
its member states<br />
» Ensure that <strong>the</strong> envisaged legislation<br />
on non-financial reporting by companies<br />
includes:<br />
• A requirement for companies reports to<br />
cover <strong>the</strong>ir global operations;<br />
• a requirement for companies to report<br />
on <strong>the</strong> actual and potential impacts of<br />
<strong>the</strong>ir global operations on human rights<br />
and environment, and to disclose social<br />
and environmental impact assessments<br />
» Adopt a normative framework that requires<br />
companies to respect human rights and<br />
<strong>the</strong> environment and to carry out adequate<br />
human rights due diligence throughout<br />
<strong>the</strong>ir operations.<br />
» Make it mandatory for companies to<br />
disclosure <strong>the</strong>ir lobbying activities<br />
and positions in relation to national or<br />
international regulatory frameworks.<br />
» Support and fund <strong>the</strong> first meeting of <strong>the</strong><br />
Conference of Parties to <strong>the</strong> Bamako<br />
Convention.<br />
Recommendations to<br />
<strong>the</strong> African Union and<br />
member states<br />
» All AU member states that have not<br />
already done so should ratify <strong>the</strong> Bamako<br />
Convention, <strong>the</strong> Basel Convention and<br />
<strong>the</strong> Basel Ban Amendment at <strong>the</strong> earliest<br />
opportunity.<br />
» All AU member states should ensure that<br />
all requirements of Basel, Basel Ban<br />
Amendment and Bamako Convention are<br />
transposed into national legislation.<br />
» The AU should adopt a normative<br />
framework that requires companies to<br />
respect human rights and <strong>the</strong> environment<br />
and to carry out adequate human rights<br />
due diligence throughout <strong>the</strong>ir operations<br />
» Support <strong>the</strong> first meeting of <strong>the</strong><br />
Conference of Parties to <strong>the</strong> Bamako<br />
Convention. All AU member states should<br />
adopt strong pollution liability legislation.<br />
Recommendations<br />
to <strong>the</strong> UK, Spain,<br />
Gibraltar and Malta<br />
» Establish a clear agreement between Spain,<br />
UK and Gibraltar, which includes specific<br />
mechanisms, to better control ships<br />
operating in <strong>the</strong> waters around Gibraltar,<br />
in order to prevent shipping accidents and<br />
marine pollution and to ensure effective<br />
policing of shipping activities.<br />
» Investigate whe<strong>the</strong>r illegal conduct occurred<br />
in <strong>the</strong> territorial waters around Spain, Malta<br />
or Gibraltar, with respect to <strong>toxic</strong> waste<br />
generation and/or export of hazardous<br />
waste from <strong>the</strong> marine territories of any of<br />
<strong>the</strong>se countries during 2006.<br />

to Trafigura<br />
Disclose full information on <strong>the</strong> waste, including<br />
scientific and o<strong>the</strong>r studies carried out in<br />
relation to <strong>the</strong> waste and its potential impacts.<br />
