to have questioned <strong>the</strong> legal framework that<br />
should apply to <strong>the</strong> waste overall.<br />
The UN Special Rapporteur on <strong>the</strong> adverse<br />
effects of <strong>the</strong> movement and dumping of<br />
<strong>toxic</strong> and dangerous products and wastes<br />
on <strong>the</strong> enjoyment of human rights, who<br />
also examined this case, concluded that<br />
“inspection of <strong>the</strong> vessel and sample analysis<br />
to determine <strong>the</strong> origin and exact composition<br />
of <strong>the</strong> waste would have been necessary to<br />
identify <strong>the</strong> applicable legal framework.” 510<br />
However, <strong>the</strong> subsequent official enquiry<br />
revealed that, despite <strong>the</strong> evident problems<br />
with <strong>the</strong> waste, <strong>the</strong> authorities did not question<br />
Trafigura’s categorization of it as MARPOL<br />
waste and Trafigura’s right to ship it onward<br />
to ano<strong>the</strong>r country without applying <strong>the</strong> Basel<br />
Convention/European Waste Shipment<br />
Regulation controls. The waste was clearly<br />
under <strong>the</strong> jurisdiction of <strong>the</strong> Ne<strong>the</strong>rlands at<br />
that point (at sea or on board <strong>the</strong> Probo Koala).<br />
Consequently, any onward shipment to ano<strong>the</strong>r<br />
country would be defined as a transboundary<br />
movement and thus subject to <strong>the</strong> Basel<br />
regime and <strong>the</strong> European Waste Shipment<br />
Regulation, which gives effect to <strong>the</strong> Basel<br />
Convention. 511<br />
While <strong>the</strong> authorities may have initially thought<br />
<strong>the</strong> material was normal MARPOL waste, once<br />
<strong>the</strong>y were in possession of fur<strong>the</strong>r information<br />
about <strong>the</strong> nature of <strong>the</strong> waste, it should have<br />
become clear that <strong>the</strong> material fell under <strong>the</strong>
