ITEM DISCUSSION ACTION/RECOMMENDATIONS
I. Welcome and
Introductions
The meeting was called to order by Yanira Lima. Self-introductions were made.
Ms. Lima thanked Behavioral Health Services for hosting the Proposition 36
Regional Coordinating Council Meeting for the West, South Bay, and Airport
areas.

II. Approval of
II. Announcements
(Cont’d.)
III. LabCorp
Yanira Lima asked if there are any corrections to the Discussion Notes from the
previous meeting held on October 9, 2008. There was one correction from
Probation, clarifying that drug testing continues to be done on a random basis.
The Discussion Notes will be corrected and posted on the Alcohol and Drug
Program Administration’s (ADPA) Prop 36 website at
www.lapublichealth.org/adpa, under the Discussion Notes section.
10) Roster Regions 5 & 8
Announcements:
• In addition to the usual handouts, two bulletins from the Alcohol and Drug
Program Administration (ADPA) were distributed.
• ADPA Bulletin 08-04 “Timely Submission of Progress Reports” was
recently distributed on November 17, 2008 and was designed to address the
problem of treatment agencies were either consistently posting their
Progress Reports to the Court late or not at all.
• ADPA Bulletin 08-05 “The Misdemeanant Policy” was sent out on
November 24, 2008, which directs the Community Assessment Service
Centers to directly refer all misdemeanants into a Level I program. The
procedural changes in this bulletin were made in response to another
reduction in Prop 36 funding.
• Kiah McIntyre conveyed to all treatment agencies that TCPX identification
numbers (Treatment Court Probation eXchange) continue to be left off of
some specimens which is a critical piece of information. As a result of the
delays, when a sample ‘sits’ without being analyzed, this can cause a
build-up of ammonia in the urine sample and this can result in a ‘validity’
problem in the results.
• The LabCorp e-results, an on-line delivery system of test results directly to
the secured site of the registered treatment provider – is being utilized by
many providers.
• A treatment providers inquired if ADPA and LabCorp is planning to return
to the point of care test (POCT) type of drug testing. Answer: No. Even if
a product could be found that would be ‘approved’ this would require that
most of the agencies would have to undergo the process of becoming
“CLIA” certified, which does not seem feasible at this time.
• Ms. McIntyre announced that there will be training offered in lab-based
drug testing, and the classes will probably be scheduled for some time in
March. Notices will be sent out.
• Ms. Lima and Ms. McIntyre surveyed the treatment providers as to whether
the lab-based testing is working well. The ‘turn-around’ time for the
agencies to receive results seems to be about 24-48 hours. No one had any
complaints regarding this.
• Judge Luna and Judge Tynan could not be present.
• Judge Wright- Announced that he has been reassigned to another Court,
and will no longer be hearing Prop 36 cases.
• One treatment provider reported that the “Next Court Date” section in the
client’s TCPX file is not reflecting the new date on the clients’ TCPX
screens. Other providers stated they are also having this problem with the
TCPX.
• Public Defender- LabCorp was questioned as to their ability to respond to
the need to document that a marijuana participant’s THC level is actually
‘coming down’ while they’re claiming abstinence. The Deputy Public
Defender asked if obtaining confirmations on this type of drug testing
result could be expedited by having the Judge fax a Minute Order directly
over to LabCorp requesting the results rather than having it go through the
providers. Kiah McIntyre expressed concern and stated that LabCorp
would still have to have the Chain-of Custody form from the treatment
provider.
V. Treatment No Announcements were made.
VI. Corrections
and Rehabilitation
No questions.
VII. CASC • There were no CASC announcements
• The CASC asked that it be notified when agencies have open beds and
available outpatient appointments.
VIII. Probation • Probation restated their October 2008 memo that as a result of the current
Prop 36 funding condition, their department will no longer be able to
provide drug testing for P36 cases. This includes the final drug test just
prior to closing out a case, despite a judicial order.
• Effective November 2008, case management of Prop 36 cases will be
supervised (similar to the PC-1000 cases) with sign-in registration done at
the KIOSKs. All current Prop 36 cases are currently being transferred to
the Riverview Office in Arcadia for case load storage to be supervised by a
group of Deputy Probation Officers (DPO’s). The DPO’s that are at the
CASC sites will remain stationed there. At present, their duties will remain
unchanged, but this may be updated at a future meeting.
• Termination and Dismissal (T & D) Reports will only be provided to the
Prop 36 Courts if request by the Judge.
• Mr. Sosa suggested that if the agencies have any matters that require the
assistance of Probation, they should contact his office at (562) 908-3175.
