Regional Coordinating Council Meeting for the West, South Bay, and Airport<br />
areas.

Yanira Lima asked if there are any corrections to the Discussion Notes from the<br />
previous meeting held on October 9, 2008. There was one correction from<br />
Probation, clarifying that drug testing continues to be done on a random basis.<br />
The Discussion Notes will be corrected and posted on the Alcohol and Drug<br />
Program Administration’s (ADPA) Prop 36 website at<br />

Announcements:<br />
• In addition to the usual handouts, two bulletins from the Alcohol and Drug<br />
Program Administration (ADPA) were distributed.<br />
• ADPA Bulletin 08-04 “Timely Submission <strong>of</strong> Progress Reports” was<br />
recently distributed on November 17, 2008 and was designed to address the<br />
problem <strong>of</strong> treatment agencies were either consistently posting their<br />
Progress Reports to the Court late or not at all.<br />
• ADPA Bulletin 08-05 “The Misdemeanant Policy” was sent out on<br />
November 24, 2008, which directs the Community Assessment Service<br />
Centers to directly refer all misdemeanants into a Level I program. The<br />
procedural changes in this bulletin were made in response to another<br />
reduction in Prop 36 funding.<br />
• Kiah McIntyre conveyed to all treatment agencies that TCPX identification<br />
numbers (Treatment Court Probation eXchange) continue to be left <strong>of</strong>f <strong>of</strong><br />
some specimens which is a critical piece <strong>of</strong> information. As a result <strong>of</strong> the<br />
delays, when a sample ‘sits’ without being analyzed, this can cause a<br />

build-up <strong>of</strong> ammonia in the urine sample and this can result in a ‘validity’<br />
problem in the results.<br />
• The LabCorp e-results, an on-line delivery system <strong>of</strong> test results directly to<br />
the secured site <strong>of</strong> the registered treatment provider – is being utilized by<br />
many providers.<br />
• A treatment providers inquired if ADPA and LabCorp is planning to return<br />
to the point <strong>of</strong> care test (POCT) type <strong>of</strong> drug testing. Answer: No. Even if<br />
a product could be found that would be ‘approved’ this would require that<br />
most <strong>of</strong> the agencies would have to undergo the process <strong>of</strong> becoming<br />
“CLIA” certified, which does not seem feasible at this time.<br />
• Ms. McIntyre announced that there will be training <strong>of</strong>fered in lab-based<br />
drug testing, and the classes will probably be scheduled for some time in<br />
March. Notices will be sent out.<br />
• Ms. Lima and Ms. McIntyre surveyed the treatment providers as to whether<br />
the lab-based testing is working well. The ‘turn-around’ time for the<br />
agencies to receive results seems to be about 24-48 hours. No one had any<br />
complaints regarding this.<br />
• Judge Luna and Judge Tynan could not be present.<br />
• Judge Wright- Announced that he has been reassigned to another Court,<br />
and will no longer be hearing Prop 36 cases.<br />
• One treatment provider reported that the “Next Court Date” section in the<br />
client’s TCPX file is not reflecting the new date on the clients’ TCPX<br />
screens. Other providers stated they are also having this problem with the<br />
TCPX.<br />
• <strong>Public</strong> Defender- LabCorp was questioned as to their ability to respond to<br />
the need to document that a marijuana participant’s THC level is actually<br />
‘coming down’ while they’re claiming abstinence. The Deputy <strong>Public</strong><br />
Defender asked if obtaining confirmations on this type <strong>of</strong> drug testing<br />
result could be expedited by having the Judge fax a Minute Order directly<br />
over to LabCorp requesting the results rather than having it go through the<br />

providers. Kiah McIntyre expressed concern and stated that LabCorp<br />
would still have to have the Chain-<strong>of</strong> Custody form from the treatment<br />
provider.<br />
V. Treatment No Announcements were made.<br />
VI. Corrections<br />
and Rehabilitation<br />
No questions.<br />
VII. CASC • There were no CASC announcements<br />
• The CASC asked that it be notified when agencies have open beds and<br />
available outpatient appointments.<br />
VIII. Probation • Probation restated their October 2008 memo that as a result <strong>of</strong> the current<br />
Prop 36 funding condition, their department will no longer be able to<br />
provide drug testing for P36 cases. This includes the final drug test just<br />
prior to c<strong>los</strong>ing out a case, despite a judicial order.<br />
• Effective November 2008, case management <strong>of</strong> Prop 36 cases will be<br />
supervised (similar to the PC-1000 cases) with sign-in registration done at<br />
the KIOSKs. All current Prop 36 cases are currently being transferred to<br />
the Riverview Office in Arcadia for case load storage to be supervised by a<br />
group <strong>of</strong> Deputy Probation Officers (DPO’s). The DPO’s that are at the<br />
CASC sites will remain stationed there. At present, their duties will remain<br />
unchanged, but this may be updated at a future meeting.<br />
• Termination and Dismissal (T & D) Reports will only be provided to the<br />
Prop 36 Courts if request by the Judge.<br />
• Mr. Sosa suggested that if the agencies have any matters that require the<br />
assistance <strong>of</strong> Probation, they should contact his <strong>of</strong>fice at (562) 908-3175.<br />

IX. Other Matters <strong>Public</strong> Comment-<br />
