contribution, which the university will pay, will be restricted to<br />

the rate at which it contributes to the Provident Fund of its<br />

employees.<br />

These orders take effect from 28-3-1960 and past cases of transfer<br />

will be regulated in accordance with the orders already in force. The<br />

concession sanctioned in para 1 (i) is admissible to all officers who were in<br />

service of the Government of India on 28-3-1960 provided that ;<br />

(i) the officers who had already drawn the Contributory Provident Fund<br />

benefits in respect of their service under the semi-Government institutions<br />

refund either in lumpsum or in monthly instalments not exceeding twelve in<br />

number, the institution’s share of contribution together with interest thereon<br />

from the date of withdrawal to the date of final payment. The title to count<br />

service for pension will not accrue until the amount refundable and interest<br />

thereon have been refunded in full.<br />

(ii) if no such benefit had been received, the previous employer agrees<br />

to bear the proportionate pensionary liability.<br />

21. With a view to increasing mobility of scientific talent all round, the<br />

benefit of the concessions contained in para 20 should also be made available<br />

to scientific employees of Government going over to Central autonomous<br />

organisations like CSIR etc., without break. These orders will also apply to<br />

Central Universities.<br />

22. The pensionary liability in such cases will be allocated on the basis<br />

of length of service in case the autonomous organisation, where the officer<br />

takes up service, has pensionary benefits for its employees. The Government<br />

of India would discharge their liability by payment of capitalised value of their<br />

share of pension together with the share of gratuity, if any, to the autonomous<br />

organisation on retirement of the officer from the service of such an<br />

organisation.<br />

Similar procedure should apply in the event of death of an officer while<br />

in service of the autonomous organisation. In other cases Government’s liability<br />

will be discharged by way of payment of pro-rata retirement benefits for the<br />

part of service rendered under the Government before absorption according<br />

to the instructions contained in the preceding paragraphs.<br />

23. It was clarified in this Ministry’s OM No.12(4)-EV/60 dated 5-6-1969<br />

that in the case of Scientific employees of Government going over to the<br />

Central autonomous organisations like CSIR etc., without break on or after<br />
