allowance admissible at the rates in force on the 31st March, 1978 appropriate<br />

to that pay shall be the pay for purposes of calculating the average<br />

emoluments; and<br />

(ii) In cases where a person has drawn pay in the revised pay scales<br />

of 1974 during any part of the period of 10 months’ immediately preceding the<br />

date of retirement, for such period during which pay in the revised pay scales<br />

of 1974 is drawn pay for purposes of average emoluments shall be the basic<br />

pay drawn from time to time during the said period plus the dearness allowance<br />

appropriate to that basic pay at the rates in force on the 1st April, 1978.<br />

Note 1:- If during the last ten months of his service a Government<br />

servant had been absent from duty on leave for which leave<br />

salary is payable or having been suspended had been<br />

reinstated without forfeiture of service, the emoluments which<br />

he would have drawn had he not been absent from duty or<br />

suspended shall be taken into account for determining the<br />

average emoluments:<br />

Provided that any increase in pay (other than the increment referred to<br />

in Note 3) which is not actually drawn shall not form part of his emoluments.<br />

Note 2:- If, during the last ten months of his service, a Government<br />

servant had been absent from duty on extraordinary leave or<br />

had been under suspension the period whereof does not count<br />

as service, the aforesaid period of leave or suspension shall<br />

be disregarded in the calculation of the average emoluments<br />

and equal period before the ten months shall be included.<br />

Note 3:- In the case of a Government servant who was on earned<br />

leave on average pay, as the case may be, during the last ten<br />

months of service and earned an increment, which was not<br />

withheld,<br />

(a) during the currency of the earned leave not exceeding one<br />

hundred and twenty days or during the first one hundred and<br />

twenty days of earned leave exceeding one hundred and twenty<br />

days, or<br />

(b) during the currency of leave on average pay not exceeding<br />

four months, or during the first four months of leave on average<br />

pay exceeding, four months, such increments, though not<br />
