an option in terms of the G.O.Ms.No.212, I&P Department, dt. 29-3-79 and<br />

G.O.Ms.No.130, I&P Department. dt. 18-3-81 that his preworkcharged<br />

establishment service is permissible to be counted for purpose of pension.<br />

The Regional provident fund commissioner shall be requested for<br />

refund of the employer’s share in E.P.F if it has been remitted by the head of<br />

the department and to credit the same to government account. Where no<br />

refund of the E.P.F has been made, there is no question of counting the prework<br />

charged establishment service.<br />

From the date of such remitance only, regularisation will be considered<br />

and come to effect.<br />

15. Counting of service rendered under Central Government:<br />

In the case of a Government servant belonging to Central Government,<br />

who is permanently transferred to a service or post to which these rules apply,<br />

the continuous service rendered under the Central Government in an officiating<br />

or temporary capacity, if any, followed without interruption by substantive<br />

appointment, or the continuous service rendered under that Government in<br />

an officiating or temporary capacity, as the case may be, shall qualify:<br />

Provided that nothing contained in this sub-rule shall apply to any such<br />

Government servant who is appointed otherwise than by deputation to a service<br />

or post to which these rules apply.<br />

16. Counting of service as apprentice:-<br />

Service as an apprentice shall not qualify.<br />

17. Counting of service on contract: -<br />

(1) A person who is initially engaged by the Government on a contract<br />

for a specified period and is subsequently appointed to the same or another<br />

post in a regular capacity in a pensionable establishment without interruption of<br />

duty, may opt either -<br />

(a) to retain the Government contribution in the contributory<br />

Provident Fund with interest thereon including any other<br />

compensation for that service; or<br />
