temperate habits. The Audit Officer should certify the applicant’s title to pension<br />

or gratuity with some such proviso as the following :-<br />

“Provided that the sanctioning authority is of opinion, on consideration<br />

of the Medical certificate and other evidence as to habits and character,<br />

that the capacity has not been proved to be caused by irregular or<br />

intemperate habits”.<br />

3. (a) A Government servant reported to be suffering from leprosy or syphilis<br />

should not at once be invalided but should be granted such leave as may<br />

be necessary, but not exceeding the amount to his credit to enable him to<br />

undergo proper treatment and he should be invalided from service in the former<br />

case only if after undergoing the treatment for the full period of the leave to his<br />

credit he is still certified to be infected with the disease, and in the latter case<br />

only if he refused to undergo the treatment prescribed by competent medical<br />

authority or is such authority considers the treatment has failed.<br />

(b) The following instructions have also been issued by Government<br />

for the guidance of medical officers in cases of syphilis and leprosy :-<br />

(i) Syphilis and leprosy are amenable to treatment.<br />

(ii) A Government servant reported to be suffering from the diseases<br />

need not necessarily be invalided from service.<br />

(iii) He may be granted such leave as it necessary but not exceeding<br />

the amount which he has to his credit in order to enable<br />

him to undergo proper treatment.<br />

(iv) A Government servant who is suffering from these diseases<br />

and who refused to undergo the treatment prescribed by competent<br />

medical authority or where such authority considers that<br />

the treatment has failed, is liable to be invalided from service.<br />

(v) The question of the grant of an invalid pension will be decided<br />

on the merits of the case.<br />

(vi) A Government servant who has been granted leave to undergo<br />

treatment for syphilis should be allowed to return to duty<br />

only on the production of a certificate from the Director of the<br />

King Institute, Guindy, or other recognized laboratory, that his
