Article 441 :- An invalid pension is awarded, on his retirement from the<br />

public service, to an officer who, by bodily or mental infirmity, is permanently<br />

incapacitated for the public service or for the particular branch of it to which<br />

he belongs.<br />

2. If a Government servant who, under the conditions of his service, is<br />

liable to be deputed for military duty is found physically unfit for such duty<br />

when called upon, he is liable to be invalidated from service, See Article 441.<br />

A decision to invalid such Government servant may not however, be given<br />

effect to if a Medical Board or other competent medical authority is of opinion<br />

that the Government servant concerned may become fit for military duty if<br />

he undergoes suitable medical or surgical treatment. If, on the other hand,<br />

the Government servant declines to undergo the treatment, he will be invalidated<br />

and his case will not be considered as one of the complete and permanent<br />

incapacity for service and he will not as a matter of right be entitled to<br />

any pension. It is open to the Government to decide in such case whether any<br />

pension should be allowed and if so, whether it should be the full or a reduced<br />

pension.<br />

Article 442 :- An officer applying for an invalid pension shall submit a medical<br />

certificate of incapacity in the manner specified below :-<br />

(a) If the officers submitting the application is on leave, elsewhere<br />

than in India, then the Medical examination shall be arranged through the Indian<br />

Missions abroad by a Medical Board consisting of a physician, Surgeon<br />

and an Opthalmologist, each of them having the status of a consultant.<br />

The service of doctors approved for the officers and staff of the Mission<br />

concerned shall be utilised for this purpose, provided that they fulfil the<br />

above conditions. A lady doctor shall be included as a member of the Medical
