HIGHLIGHTS OF DISCUSSION Verbal Intervention: “Malaysia is of the view that Note 161 should not be deleted at this juncture. We agree with Germany that such clause is used in other Codex Committees in certain situations thus we feel that further discussion at national level is needed on the implication of this note at a broader sense. We are agreeable with the Chair’s proposal to retain this note but the use should be reduced and on a case-by-case basis. Clear and transparent justification for the need of this note should be given when proposing its addition in the GSFA. Malaysia also believes that the proposal by Australia to discuss further section 3.2 of the Preamble to identify situations as highlighted by the EU could assist in the decision for the criteria.” COMMITTEE'S DECISION TINDAKAN MALAYSIA 2.2.10 DISCUSSION PAPER ON THE REVISION OF SECTION 4 “CARRY-OVER OF FOOD ADDITIVES INTO FOOD” OF THE PREAMBLE OF THE GSFA (Agenda Item 5h) HIGHLIGHTS OF DISCUSSION (Documents: CX/FA 11/43/14; CRD 18 (Comments of European Union, India, Jordan, Kenya and Thailand)) The Committee recalled that it had established an e-WG to evaluate the necessity to revise Section 4 of the Preamble of the GSFA to take into account differences between Section 4 “Carry-over of food additives into foods” and the “Carry-over Principle of Food Additives” in Volume 1 of the Codex Alimentarius. The Delegation of Brazil introduced the report of the e-WG, as presented in CX/FA 11/43/14, containing in Annex 1 proposed COMMITTEE'S DECISION TINDAKAN MALAYSIA 38

The Committee noted that the e-WG had agreed: that the scope and the application of the carry-over provisions were well defined in current text of Section 4.1 of the Preamble of the GSFA, and that Section 3(d) from Volume 1 should not be included; that the conditions applying to the carry-over of food additives were sufficiently described in the Preamble and no further definition was necessary, and that it was not appropriate to include text regarding labelling as this was beyond the terms of reference of the GSFA and the CCFA. The Committee discussed the recommendations as follows. Recommendation I Note: CX/FA 11/43/14 To analyze the proposed amendments presented in Annex 1 of CX/FA 11/43/14, as underlined and bold text, and forward to the Commission for adoption those agreed to by the Committee. The Committee considered the proposed amendment to Section 4 of the Preamble of the GSFA COMMITTEE'S DECISION Recommendation I The Committee and agreed to clarify the title of Section 4.1 by specifically referring to carry-over of food additives from ingredients and raw materials into food; Insert a new header “4.2 Special Conditions Applying to the Use of Food Additives not Directly Authorised in Food Ingredients and Raw Materials”; and Further clarify the new section 4.2 by adding the words, “or added to”, after “used in”, and “including that any maximum level applying to the food is not exceeded” at the end of the paragraph.
