INTRODUCTION :
ROLE OF SECURITY ORGANISATION :
Although Security Organisation, whether it is Public Sector Undertaking or the Private
Industrial Organisation, the set up is more or less on the same lines as the Police. However, there is
enormous disparity in the powers conferred by law on them. Despite the fact that their personnel more
or less resembles Police in respect of their internal organizations, functions and uniforms, the respect
and awe which are reserved by the members of the public for the Police force or even the defence
personnel just does not exist for the private Security Staff.
The Code of Criminal Procedure 1973 confers some legal powers in
the hands of Private persons/private Security Organisations vide
Sections 43,46 & 52. Under these sections, any private personnel may
arrest or cause to arrest any person who in his presence commits a non-
bailable and cognizable offence or any proclaimed offenders and without
unnecessary delay and caused to be made over any person so arrested
to the Police Officer or in the absence of the Police Officer caused him to
be taken in the custody to the nearest Police Station.
