SECTION X: ARBITRATION<br />

X.24.4. debar that party from further participation and proceed with the arbitration<br />

and make an award but only after giving that party written notice of its<br />

intention to do so.<br />

The Hearing Old Rule<br />

X.25. The chairman shall fix the date, time and place of the arbitration hearing and shall<br />

give the parties reasonable notice thereof.<br />

X.26. At or before the hearing the chairman shall determine the order in which the<br />

parties shall present their cases.<br />

X.27. Any witness who gives oral evidence may be questioned by the representative of<br />

each party and by each of the arbitrators.<br />

Remedies Old Rule<br />

X.28. The tribunal shall have power to:<br />

X.28.1. determine any question of law or fact arising in the course of the arbitration;<br />

X.28.2. determine any question as to its own jurisdiction;<br />

X.28.3. make a declaration as to any matter to be determined in the proceedings;<br />

X.28.4. order the payment of a sum of money;<br />

X.28.5. award simple or compound interest;<br />

X.28.6. order a party to do or refrain from doing anything;<br />

X.28.7. order specific performance of a contract (other than a contract relating<br />

to land);<br />

X.28.8. order the rectification, setting aside or cancellation of a deed or<br />

other document.<br />

Majority Decision Old Rule<br />

X.29. If the arbitrators fail to agree on any issue they shall decide by a majority and a<br />

majority decision shall be binding on all of them. No dissenting judgment shall<br />

be produced.<br />

Provisional Awards Old Rule<br />

X.30. The tribunal shall have power to make provisional awards during the proceedings<br />

including without limitation requiring a party to make an interim payment on<br />

account of the claim or the costs of the arbitration. Any such provisional award<br />

shall be taken into account when the final award is made.<br />

The Award Old Rule<br />

X.31. If before the award is made the parties agree on a settlement of the dispute<br />

the tribunal shall record the settlement in the form of a consent award.<br />

X.32. The tribunal may make more than one award at different times on different<br />

aspects of the matters in dispute.<br />

X.33. The award shall be in writing and shall contain reasons for the tribunal’s decision. S.33<br />
