SECTION X: ARBITRATION<br />

X.21.4. whether and if so to what extent there shall be oral or written evidence<br />

or submissions;<br />

X.21.5. whether expert evidence is required;<br />

X.21.6. whether and if so to what extent the tribunal shall itself take the initiative<br />

in ascertaining the facts and the law.<br />

The Tribunal’s General Powers Old Rule<br />

X.22. The chairman of the tribunal shall have power to:<br />

X.22.1. allow either party upon such terms (as to costs and otherwise) as it shall<br />

think fit to amend any statement of claim and defence;<br />

X.22.2. give directions in relation to the preservation, custody, detention,<br />

inspection or photographing of property owned by or in the possession of<br />

a party to the proceedings;<br />

X.22.3. give directions as to the preservation of evidence in the custody or control<br />

of a party;<br />

X.22.4. direct that a witness be examined on oath;<br />

X.22.5. require each party to give notice of the identity of witnesses it intends to call;<br />

X.22.6. require exchange of witness statements and any expert’s reports;<br />

X.22.7. appoint one or more experts to report to it on specific issues;<br />

X.22.8. require a party to give any such expert any relevant information or to<br />

produce or provide access to any relevant documents or property;<br />

X.22.9. order that a transcript be taken of the proceedings;<br />

X.22.10. extend or abbreviate any time limits provided by this Section of these<br />

Rules or by its directions;<br />

X.22.11. require the parties to attend such procedural meetings as it deems necessary<br />

to identify or clarify the issues to be decided and the procedures to be adopted;<br />

X.22.12. give such other lawful directions as it shall deem necessary to ensure the<br />

just, expeditious, economical and final determination of the dispute.<br />

Duty of the Parties Old Rule<br />

X.23. The parties shall do all things necessary for the proper and expeditious conduct of<br />

the arbitration and shall comply without delay with any direction of the chairman<br />

of the tribunal as to procedural or evidential matters.<br />

Default of the Parties Old Rule<br />

X.24. If either party is in breach of Rule X.23 the tribunal shall have power to:<br />

X.24.1. make peremptory orders prescribing a time for compliance;<br />

X.24.2. make orders against a party which fails to comply with a peremptory order;<br />

X.24.3. dismiss a claim for want of prosecution in the event of inordinate or<br />

inexcusable delay by a party which appears likely to give rise to a substantial<br />

risk that it will not be possible to have a fair resolution of the issues or will<br />

cause serious prejudice to the other party;<br />
