SECTION X: ARBITRATION<br />

X.13.2. such person is independent of the party appointing him and able to render<br />

an impartial decision.<br />

X.14. If a party refuses or fails to appoint an arbitrator when it is obliged to do so in<br />

accordance with these Rules the Board (or the Football Association if the League is a<br />

party) shall make the appointment giving notice in writing to that effect to each party.<br />

X.15. Upon appointment all arbitrators must sign a statement of impartiality. Any<br />

arbitrator not signing such a statement within 7 days of appointment may not act<br />

and the party appointing him must nominate another arbitrator within 7 days.<br />

Appointing a Single Arbitrator Old Rule<br />

X.16. Notwithstanding the provisions of Rule X.10, the parties shall be at liberty to appoint<br />

a legally qualified member of the Panel to be a single arbitrator in which case:<br />

X.16.1. Form 41 shall be substituted for Form 40; and<br />

X.16.2. this Section of these Rules shall be interpreted on the basis that the<br />

tribunal comprises a single arbitrator who shall undertake the duties of<br />

the chairman.<br />

Replacing an Arbitrator Old Rule<br />

X.17. If following his appointment an arbitrator refuses to act, becomes incapable of<br />

acting, is removed by order of a competent court or dies, or if his membership of the<br />

Panel is terminated pursuant to Rule W.19, the Board (or the Football Association if<br />

the League is a party) shall appoint a member of the Panel to replace him.<br />

Communications Old Rule<br />

X.18. All communications sent in the course of the arbitration by the arbitrators shall be<br />

signed on their behalf by the chairman.<br />

X.19. Such communications addressed by the arbitrators to one party shall be copied to<br />

the other.<br />

X.20. Any communication sent by either party to the arbitrators shall be addressed to<br />

the chairman and shall be copied to the other party.<br />

Directions Old Rule<br />

X.21. The chairman of the tribunal shall decide all procedural and evidential matters and<br />

for that purpose within 14 days of his appointment he shall either give directions for<br />

the conduct of the arbitration addressed in writing to each party or serve on each<br />

party Form 42 requiring their attendance at a preliminary meeting at which he will<br />

give directions. In either case the directions shall include without limitation:<br />

X.21.1. whether and if so in what form and when statements of claim and defence<br />

are to be used;<br />

X.21.2. whether and if so to what extent discovery of documents between the parties<br />

is necessary;<br />

X.21.3. whether strict rules of evidence will apply and how the admissibility,<br />

relevance or weight of any material submitted by the parties on matters of<br />

fact or opinion shall be determined;<br />
