Lake Technology Limited A.C.N. 051 198 273 of Australia
(“Lake”) warrants to the purchaser that the hardware and media
embodying software in this product are free from defects in
material and workmanship for a period of one (1) year from the
date of purchase or shipment, whichever is earlier.
If the purchaser discovers such a defect, they should notify
Lake within the warranty period and return the product to Lake,
indicating the defect and providing proof of purchase. Lake
will examine the product and, if it finds that there is such a
defect, will at its option either repair or replace the product,
return the product to the purchaser within ninety (90) days of
receipt and refund the purchaser’s shipping expenses. Shipping
of products is at the purchaser’s sole risk.
NOTE: — EXCLUSION AND LIMITATION OF LIABILITY
TO THE FULL EXTENT PERMITTED BY APPLICABLE
LAW, LAKE DISCLAIMS AND EXCLUDES ALL AND
ANY WARRANTIES AND CONDITIONS IN RESPECT OF
THIS PRODUCT. THIS EXCLUSION EXTENDS, WHERE
LAWFUL TO DO SO, TO THE IMPLIED WARRANTIES OF
MERCHANTABILITY AND FITNESS FOR A
PARTICULAR PURPOSE. ALL SOFTWARE AND
HARDWARE MAY HAVE ERRORS, AND THEREFORE
THE USE OF THE LAKE SOFTWARE AND HARDWARE
MUST BE BY SKILLED AND SUITABLY TRAINED
PERSONNEL WHO CAN VERIFY THE RESULTS OF USE
TO BE ACCURATE. LAKE THEREFORE SUPPLIES THE
HARDWARE AND SOFTWARE SUPPLIED “AS IS”
WITHOUT WARRANTY AS TO THE CORRECTNESS,
COMPLETENESS OR ACCURACY OF THE RESULTS OF
USE, OR AS TO ANY BENEFITS OF USE OF ANY
NATURE. The limited warranty provided above is the only
warranty made by Lake on this product. No oral or written
information or advice given by Lake, its dealers, distributors,
agents or employees will create a warranty or in any way
increase the scope of this warranty, and you may not rely on
any such information or advice.
In no event will Lake be liable for any consequential, incidental
or indirect damages (including damages for loss of business
profits, business interruption, loss of business information)
arising out of the use of or inability to use Lake products, even
if Lake or an authorised Lake representative has been advised of
the possibility of such damages or for any claim by any other
party.
