INTRODUCTION / VOORWOORD<br />
The objective of this manual is to provide directives to teachers, principles, and disciplinary committee<br />
with reference to the handling of disciplinary matters within the school context accordance the<br />
Disciplinary Procedures and Code of Conduct.<br />
Die doel van hierdie handleiding is om riglyne aan onderwysers, hoofde en dissiplinêre kommitee te<br />
voorsien, met betrekking tot die hantering van dissiplinêre aangeleenthede binne skoolverband<br />
ooreenkomstig die Dissiplinêre Prosedure en Gedragskode.<br />

THE PURPOSE <strong>OF</strong> THIS MANUAL<br />
The purpose of this manual is to provide<br />
guidelines to the principle, deputy-principle,<br />
educators and disciplinary committee with<br />
regard to the handling of disciplinary matters<br />
within the school situation in accordance with<br />
the disciplinary procedure and code of<br />
conduct.<br />
<strong>DISCIPLINARY</strong> PROCEDURE VS <strong>CODE</strong> <strong>OF</strong><br />
CONDUCT<br />
The disciplinary procedure prescribes the<br />
basic rules which must be complied with when<br />
applying discipline, whether informal or<br />
formal discipline. The procedure has been<br />
written in simple language and is easy to<br />
understand. When circumstances necessitate<br />
that a learner be disciplined, the rules<br />
contained in the disciplinary procedure must<br />
be strictly adhere to.<br />
The code of conduct contains the types of<br />
behavior of learners, which are not acceptable<br />
to the principle, deputy-principle, educators,<br />
community and governing body, in other<br />
words the various offences of the school. The<br />
code has been set out in two columns, namely<br />
serious offenses in the left column and less<br />
serious offenses in the right column.<br />
Offences in the left column could result entire<br />
discharge of a learner for a first offence. The<br />
circumstances and merits of each case will be<br />
decisive. Offenses contained in the right-hand<br />
column are such that a first offence does not<br />
justify entire discharge. Any disciplinary<br />
measures, from a corrective measure to a<br />
suspension can however be imposed, once<br />
again with due consideration of the<br />
circumstances and merits of each particular<br />
case.<br />
Guidelines for a Code of Conduct for<br />
learners<br />
Section 8 of the South African Schools Act<br />
provides that a governing body of a public<br />
school must adopt a Code of Conduct. The<br />
Code of Conduct must aim at establishing a<br />
discipline and purposeful environment to<br />
facilitate effective education and learning in<br />
schools<br />

Die doel van hierdie handleiding is om riglyne te<br />
voorsien aan die Hoof, Adjunkhoof, Opvoeders en<br />
Tugkomitee met betrekking tot die hantering van<br />
dissiplinêre aangeleenthede binne skoolverband<br />
ooreenkomstig die dissiplinêre prosedure en<br />
Gedragskode.<br />
DISSIPLINêRE PROSEDURE VS<br />
GEDRAGSKODE<br />
Die dissiplinêre prosedure skryf die basiese reëls<br />
voor wat nagekom moet word by die toepassing<br />
van dissipline, hetsy informele of formele<br />
dissipline. Die prosedure is in eenvoudige taal<br />
geskryf en maklik om te verstaan. Wanneer<br />
omstandighede dit genoodsaak dat ‘n leerder<br />
gedissiplineer moet word, moet die reëls vervat in<br />
die dissiplinêre prosedure noukeurig nagekom<br />
word.<br />
Die Gedragskode bevat die tipe gedrag van<br />
leerders wat nie vir die Hoof, Adjunkhoof,<br />
Opvoeders, Gemeenskap en Beheerliggaam<br />
aanvaarbaar is nie, met ander woorde dit is die<br />
verskillende oortredings van die Skool. Die kode<br />
is in twee kolomme ingedeel, naamlik ernstige<br />
oortredings in die linkerkantste kolom en minder<br />
ernstige oortredings in die regterkantste kolom.<br />
Oortredings vervat in die linkerkantste kolom kan<br />
daartoe lei dat ‘n leerder vir ‘n eerste oortreding<br />
permanent uit die Skool uitgesluit kan word. Die<br />
omstandighede en meriete van elke geval sal<br />
deurslaggewend wees. Oortredings vervat in die<br />
regterkantste kolom<br />
is sodanig dat dit nie by eerste oortreding ‘n<br />
permanente uitsluiting sal regverdig nie. Enige<br />
dissiplinêre maatreël vanaf ‘n eerste korrektiewe<br />
maatreël tot ‘n skorsing kan egter opgelê word,<br />
weereens met inagneming van die omstandighede<br />
en meriete van elke besondere geval.<br />
Riglyne vir ‘n Gerdagskode vir leerders<br />
Artikel 8 van die Suid-Afrikaanse Skolewet maak<br />
voorsiening daarvoor dat die Beheerliggaam van<br />
‘n openbare skool ‘n Gedragskode moet aanvaar.<br />
Die Gedragskode moet gerig wees op die<br />
vestiging van ‘n gedissiplineerde en doelgerigte<br />
omgewing om doeltreffende onderwys en studie<br />
in skole te aanvaar.<br />

ENGLISH PAR. AFRIKAANS<br />
This document sets out guidelines for<br />
consideration by governing bodies of public<br />
schools in adopting a Code of Conduct for<br />
learners to ensure that there is order and<br />
discipline in schools.<br />
The Code of Conduct must be subject to the<br />
Constitution of the Republic of South Africa,<br />
1996, the South African Schools Act, 1996<br />
and provincial legislation. It must reflect the<br />
constitutional democracy, human rights and<br />
transparent communication, which underpin<br />
South African society.<br />
The code of conduct must inform the learners<br />
of the way in which they should conduct<br />
themselves at school in preparation for their<br />
conduct and safety in civil society. It must set<br />
a standard of moral behaviour for learners and<br />
equip them with the expertise, knowledge and<br />
skills they would be expected to evince as<br />
worthy and responsible citizens. It must<br />
promote the civic responsibilities of the school<br />
and it must develop leadership. The main<br />
focus of the Code of Conduct must be positive<br />
discipline; it must not be punitive and<br />
punishment oriented but facilitates<br />
constructive learning.<br />
Each school must develop its own Code of<br />
Conduct. In formulating a Code of Conduct<br />
as a consensus document and before adopting<br />
it, the governing body must involve the<br />
parents, learners, educators, and noneducators<br />
at that school. After the adoption of<br />
the Code of Conduct, each stakeholder must<br />
receive a copy thereof. The above<br />
stakeholders must also be consulted when the<br />
Code of Conduct is reviewed annually or<br />
when any amendments are made.<br />
The purpose of a Code of Conduct is to<br />
promote positive discipline, self- discipline<br />
and exemplary conduct, as learners learn by<br />
observation and experience.<br />
All key stakeholders should be committed to<br />
the Code of Conduct despite its being directed<br />
specifically at learners.<br />
The Code of Conduct must suit the<br />
development of the learners and be<br />
appropriate to the different school levels. The<br />
language used must be easily understandable<br />
to make the content accessible. The format<br />
should be user-friendly.<br />

Hierdie dokument verskaf riglyne vir oorweging<br />
deur Beheerliggame van openbare skole in die<br />
aanvaarding van ‘n Gedragskode vir leerders om<br />
te verseker dat daar orde en dissipline in skole sal<br />
wees.<br />
Die Gedragskode moet onderhewig wees aan die<br />
Grondwet van die Republiek van Suid-Afrika,<br />
1996, die Suid-Afrikaanse Skolewet, 1996, en<br />
Provinsiale Wetgewing. Dit moet die<br />
grondwetlike demokrasie, menseregte en<br />
deursigtige kommunikasie, wat die Suid-<br />
Afrikaanse gemeenskap ten grondslag lê,<br />
weerspieël.<br />
Die Gedragskode moet die leerders inlig oor die<br />
wyse waarop hulle hulself moet gedra ter<br />
voorbereiding van hul gedrag en veiligheid in die<br />
burgerlike gemeenskap. Dit moet ‘n standaard<br />
van morele gedrag vir leerders stel en hulle toerus<br />
met die kundigheid, kennis en vaardigheid wat<br />
van hulle verwag sal word om aan die dag te lê as<br />
waardige en verantwoordelike burgers. Dit moet<br />
die burgerlike verantwoordelikhede van die skool<br />
bevorder en dit moet leierskap ontwikkel. Dit<br />
moet nie op straf ingestel wees nie, maar moet<br />
opbouende studie bevorder en morele waardes<br />
vestig.<br />
Elke skool moet sy eie Gedragskode ontwikkel.<br />
In die formulering van ‘n Gedragskode as<br />
konsepdokument, en voordat dit aanvaar word,<br />
moet die Beheerliggaam die ouers, leerders,<br />
opvoeders en nie-opvoeders van die skool afskrif<br />
daarvan ontvang. Die bogenoemde<br />
belanghebbendes moet ook geraadpleeg word<br />
wanneer die Gedragskode jaarliks hersien word of<br />
wanneer enige wysiging aangebring word.<br />
Die doel van ‘n Gedragskode is om positiewe<br />
dissipline, selfdissipline en voorbeeldige gedrag te<br />
bevorder aangesien leerders deur waarneming en<br />
ondervinding leer.<br />
Alle belanghebbendes in sleutelposisies moet<br />
verbind wees tot die Gedragskode, ongeag<br />
daarvan dat dit meer bepaald op leerders gerig<br />
word.<br />
Die Gedragskode moet aanpas by die<br />
ontwikkeling van die leerders en toepaslik wees<br />
vir die verskillende skoolvlakke. Die taal wat<br />
gebruik word moet maklik verstaanbaar wees om<br />
die inhoud toeganklik te maak. Die formaat moet<br />
gebruikers- vriendelik wees.<br />

The Code of Conduct must contain a set of<br />
moral values, norms and principles that the<br />
school community should uphold. However,<br />
the Code of Conduct is only enforceable<br />
against learners and no other person.<br />
The Code of Conduct should clarify and<br />

various stakeholders in the creation of a proper<br />
learning environment in schools.<br />

leeromgewing in skole bevorder en duidelik<br />

CONTROL <strong>AND</strong> MAINTENANCE <strong>OF</strong><br />
DISCIPLINE<br />
The maintenance of discipline is the<br />
responsibility and prerogative of the<br />
principle, deputy-principle and educators<br />
with due consideration of the following:<br />
Corrective action<br />
When applying discipline the emphasis will<br />
be on guidance and rehabilitation rather<br />
than on imposing punishment. Fair<br />
suspension should however also serve as a<br />
deterrent.<br />
Uniformity<br />
Discipline must be applied uniformly<br />
trough out the school on all levels. One of<br />
the surest methods of undermining a<br />
disciplinary procedure is to take<br />
disciplinary action against some learners<br />
and not against others.<br />
Fairness<br />
Disciplinary action must always be<br />
procedurally and substantively fair.<br />
Procedural fairness is ensured by strictly<br />
adhering to the disciplinary procedure. On<br />
the other hand substantive fairness means<br />
that any disciplinary action/ imposition of<br />
disciplinary measures must always be fair.<br />
The nature and circumstances of the<br />
specific offence, as well as the school<br />
record of the learner concerned must thus<br />
be considered before a specific disciplinary<br />
measure is decided upon. Substantive<br />
fairness is thus implies nothing other than<br />
that the disciplinary measure must be in<br />
line with and applicable to the offence and<br />
personal profile of the transgressor.<br />
The balance between uniformity and fairness<br />
The objective must be to strive to maintain<br />
a healthy balance between uniformity and<br />
fairness at all times. When considering<br />
disciplinary action an attempt must be<br />
made to treat the specific learner concerned<br />
fairly at all times without compromising<br />
uniformity.<br />

DISSIPLINE<br />
Die handhawing van dissipline is die<br />
verantwoordelikheid en prerogief van die<br />
Hoof, Adjunkhoof en Opvoeders met<br />
inagneming van die volgende:<br />
Korrektiewe aksie<br />
By die toepassing van dissipline sal die<br />
klem val op leidinggewing en rehabilitasie<br />
eerder as om straf toe te deel. Billike<br />
skorsing behoort egter ook as afskrikmiddel<br />
te dien.<br />
Eenvormigheid<br />
Dissipline moet regdeur die skool op alle<br />
vlakke eenvormig toegepas word. Een van<br />
die sekerste metodes om ‘n dissiplinêre<br />
prosedure te ondermyn, is om teen sommige<br />
leerders dissiplinêr op te tree en nie teen<br />
ander nie.<br />
Billikheid<br />
Dissiplinêre optrede moet altyd prosedurieel<br />
asook substantief billik wees. Prosedurele<br />
billikheid word verseker deur die<br />
dissiplinêre prosedure nougeset na te kom.<br />
Substantiewe billikheid daarenteen beteken<br />
dat enige dissilpinêre optrede of oplê van<br />
dissiplinêre maatreël altyd regverdig moet<br />
wees.<br />
Die aard en omstandighede van die<br />
spesifieke oortreding, asook onder andere<br />
die skoolrekord van die betrokke leerder<br />
moet dus oorweeg word, voordat daar op ‘n<br />
spesifieke dissiplinêre maatreël besluit<br />
word. Substantiewe billikeid is dus niks<br />
anders as dat die dissiplinêre maatreël in lyn<br />
en toepaslik moet wees met die oortreding<br />
en persoonlike profiel van die oortreder.<br />
Die balans tussen eenvormigheid en billikheid<br />
Daar moet deurgaans gestrewe word na die<br />
handhawing van ‘n gesonde balans tussen<br />
eenvormigheid en billikheid. By oorweging<br />
van dissiplinêre optrede moet gepoog word<br />
om die spesifieke leerder te alle tye billik te<br />
behandel sonder dat eenvormigheid<br />
benadeel word.<br />

Lapse of time between the offence and the<br />
taking of disciplinary action<br />
The general rule is that disciplinary action<br />
must be taken as soon as possible after the<br />
allege offence. The rule must be strictly<br />
adhering to.<br />
Hearing prior to entire discharge<br />
No learner shall, irrespective of the<br />
seriousness of an offence, be dismissed on<br />
disciplinary grounds before a disciplinary<br />
hearing has been held. It does happen that<br />
a learner may request that a formal hearing<br />
involving him/her is not held or he/she may<br />
refuse to attend such a hearing. In such<br />
cases a proper written record must be kept<br />
of the request/refusal and two (2) witnesses<br />
must sign such refusal/ request. The<br />
hearing may then be held in his/her<br />
absence.<br />
Social / Psychological services<br />
Where applicable, social and or<br />
psychological services can be utilized to<br />
gather background information.<br />
Follow-up<br />
Follow-up discussions with learners who<br />
commit offences will be aimed at<br />
rehabilitation and guidance to confirm<br />
corrective actions.<br />
Knowledge of the disciplinary procedure/code<br />
Every learner/parent/guardian (one per<br />
family) of the school must be provided<br />
with a disciplinary procedure and code of<br />
conduct (new learners upon entrance into<br />
school). Receipt of acknowledgement<br />
must be in written. Apart from this a copy<br />
of the disciplinary procedure and code of<br />
conduct must be available at the principle,<br />
deputy-principle, educators and<br />
administrative office.<br />

Tydverloop tussen die oortreding en die neem<br />

Die algemene reël is dat dissipline so gou as<br />
moontlik na die beweerde oortreding<br />

Verhoor voor algehele uitsluiting<br />
Geen leerder sal ongeag die erns van die<br />
oortreding, dissiplinêr uitgesluit/geskors<br />
word alvorens ‘n dissiplinêre verhoor gehou<br />
is nie. Met ander woorde voordat sodanige<br />
leerder eers voor die Tugkomitee verskyn<br />
het nie. Dit kan gebeur dat ‘n leerder<br />
versoek dat daar nie ‘n formele verhoor<br />
gehou word waarby hy/sy betrokke is nie of<br />
dat hy/sy weier om ‘n verhoor by te woon.<br />
In sodanige gevalle moet daar behoorlike<br />
skriftelike rekord gehou word van die<br />
versoek/weiering, en twee getuies moet<br />
daarby teken. Die verhoor kan dan in<br />
sy/haar afwesigheid gehou word.<br />
Maatskaplike / Sielkundige Dienste<br />
Waar toepaslik kan Maatskaplike en/of<br />
Sielkundige Dienste betrek word by die<br />
inwin van agtergrond inligting.<br />
Opvolging<br />
Opvolggesprekke met leerders wat<br />
oortredings begaan het sal gemik wees op<br />
rehabilitasie en leidinggewing om<br />
korrektiewe aksies te bevestig.<br />
Kennis van dissiplinêre prosedure/kode<br />
Elke leerder/ouer/voog (een per gesin) van<br />
die skool moet met ‘n dissiplinêre prosedure<br />
en Gedragskode uitgereik word (nuwe<br />
leerders by inname in skool).<br />
Ontvangserkenning moet skriftelik geskied,<br />
wat veilig bewaar moet word.<br />
Hierbenewens moet afskrifte van die<br />
dissiplinêre prosedure en Gedragskode ter<br />
insae by die Hoof, Adjunkhoof, Opvoeders<br />
en administratiewe kantoor beskikbaar<br />
wees.<br />

RELATION BETWEEN COURT CASES<br />
<strong>AND</strong> <strong>DISCIPLINARY</strong> ACTION<br />
Offenses within school context<br />
Offences within the school context will be<br />
dealt with at the hand of the disciplinary<br />
procedure and code of conduct irrespective<br />
of whether or not the offender lands in<br />
court as a result of the offence.<br />
Offences outside of the school context<br />
If a court case is pending against a learner<br />
and such court case has arisen from<br />
circumstances which are not related to the<br />
school, the matter will not be dealt with by<br />
means of a disciplinary procedure.<br />
However, if the schools image is<br />
negatively affected by the offence or if<br />
there is a relation between the offence and<br />
the schools interests, 4.1 above is<br />
applicable.<br />
Offenses which result in imprisonment<br />
If a learner is sentenced to imprisonment,<br />
he/she could be summarily discharge from<br />
school.<br />
THE LEGAL AUTHORITY FOR THE<br />
CONTROL <strong>AND</strong> DISCIPLINE <strong>OF</strong><br />
LEARNERS<br />
In terms of section 3(n), of the National<br />
Education Policy Act, Act No. 27 of 1996, the<br />
Minister of Education must determine national<br />
education policy for the control and discipline<br />
of learners at education institutions.<br />
This policy shall be directed at the<br />
advancement and protection of the fundamental<br />
rights of every person guaranteed in the Bill of<br />
Rights in the Constitution of the Republic of<br />
South Africa 1996, Act No. 108 of 1996.<br />

Oortredings binne skoolverband sal aan die<br />
hand van die Dissiplinêre Prosedure en<br />
Gedragskode hanteer word ongeag daarvan<br />
of die leerder as gevolg van die oortreding in<br />
die hof kan beland al dan nie.<br />
Misdrywe buite skoolverband<br />
Indien ‘n hofsaak teen ‘n leerder hangend is<br />
waar sodanige hofsaak voortspruit uit<br />
omstandighede wat nie met die skool<br />
verband hou nie, sal die saak nie deur<br />
middel van die dissiplinêre prosedure<br />
hanteer word nie.<br />
Indien die skool se beeld egter nadelig<br />
daardeur geraak is of indien daar ‘n ander<br />
wesenlike verband tussen die misdryf en die<br />
skool se belange bestaan, geld 4.1 hierbo.<br />
Oortredings wat gevangenisstraf tot gevolg het<br />
Indien ‘n leerder gevanggenisstraf opgelê<br />
word, kan hy/sy summier uitgesluit word uit<br />
die skool.<br />
DIE WETLIKE BEVOEGDHEID VIR DIE<br />
BEHEER EN DISSIPLINE VAN LEERDERS<br />
Ingevolge Artikel 3 (n) van die Wet op<br />
Nasionale Onderwysbeleid, Wet No. 27 van<br />
1996, moet die Minister van Onderwys die<br />
Nasionale Onderwysbeleid vir die beheer en<br />
dissipline van leerders by onderwysinrigtings<br />
bepaal.<br />
Hierdie beleid sal gerig wees op die bevordering<br />
en beskerming van die fundamentele regte van<br />
elke persoon, soos gewaarborg in die Handves<br />
van Menseregte in die Grondwet van die<br />
Republiek van Suid-Afrika, 1996, Wet No. 108<br />
van 1996.<br />

The South African School Act, Act No. 84 of<br />
1996, section 8(1) empowers a governing body<br />
of a school to maintain discipline in a school.<br />
The Code of Conduct must prescribe behavior<br />
that respects the rights of learners and<br />
educators.<br />
The Code of Conduct of a public school must<br />
be displayed at the school and as far as possible<br />
be given to each learner in the official language<br />
of teaching of the learner when he/she enrolls<br />
at a school. As learners are compelled to<br />
comply with the Code of Conduct of the school<br />
they attend they must be informed about its<br />
contents, which must list, in positive terms, the<br />
things learners may not do, or should do, as<br />
well as communication channels, grievance<br />
procedures and due process in conducting a fair<br />
hearing.<br />
Learners must understand that action may be<br />
taken against them if they contravene the Code<br />
of Conduct. When action is taken against<br />
learners they should be informed why their<br />
conduct is considered as misbehavior or<br />
misconduct and why they are to be disciplined<br />
or punished. The punishment must suit the<br />
offence.<br />
Nothing shall exempt a learner from complying<br />
with the Code of Conduct of the school.<br />
An educator at the school shall have the same<br />
rights as a parent to control and discipline the<br />
learner according to the Code of Conduct<br />
during the time the learner is in attendance at<br />
the school, any classroom, school function or<br />
school excursion or school related activities.<br />
The principle or an educator, upon reasonable<br />
(sufficient information), has the legal authority<br />
to conduct a search of any learner or property<br />
in possession of the learner for a dangerous<br />
weapon, firearm, drugs, or harmful dangerous<br />
substance, stolen property, or pornographic<br />
material brought on to the school property. (A<br />
search may be performed in terms of the<br />
following Acts of general applications: Control<br />
of Access to Public Premises and Vehicles Act,<br />
1985, Act No. 53 of 1985; Drugs and Drug<br />
Trafficking Act 140 of 1992; Arms and<br />
Ammunition Act, 1969, Act No. 75 of 1969).<br />

Die Suid-Afrikaanse Skolewet, Wet No. 84 van<br />
1996, Artikel 8 (1) magtig die Beheerliggaam<br />
van ‘n skool om dissipline in ‘n skool te<br />
handhaaf. Die Gedragskode moet gedrag wat<br />
die regte van leerders en opvoeders respekteer<br />
voorskryf.<br />
‘n Gedragskode moet by die skool vertoon word<br />
en sover moontlik aan elke leerder verskaf word<br />
in die amptelike taal van onderrig van die<br />
leerder wanneer hy/sy by ‘n skool inskryf.<br />
Aangesien leerders verplig is om gehoor te gee<br />
aan die Gedragskode van die skool wat hulle<br />
bywoon, moet hulle ingelig word oor die<br />
inhoud, wat in positiewe terme die dinge wat<br />
leerders nie mag doen nie, of moet doen, asook<br />
die kommunikasiekanale, grieweprosedure en<br />
die behoorlike regsproses wat tydens die<br />
verloop van ‘n regverdige verhoor gevolg moet<br />
word.<br />
Leerders moet verstaan dat daar teen hulle<br />
opgetree kan word indien hul die Gedragskode<br />
sou verbreek. Wanneer daar stappe teen<br />
leerders gedoen word, moet hulle ingelig word<br />
waarom hulle gedrag as wangedrag beskou<br />
word en waarom hulle gedissiplineer of gestraf<br />
gaan word. Die straf moet strook met die<br />
oortreding.<br />
Niks sal die leerder daarvan vrystel om aan die<br />
Gedragskode van die skool gehoor te gee nie.<br />
‘n Opvoeder by die skool sal oor dieselfde regte<br />
as ‘n ouer/voog beskik om die leerder ingevolge<br />
die Gedragskode te beheer en te dissiplineer<br />
gedurende die tyd wat die leerder die skool,<br />
asook enige klas, skoolfunksie of skooluitstappe<br />
of verwante aktiwiteite bywoon.<br />
Waar daar redelike vermoede bestaan en<br />
voldoende inligting bestaan, het die skoolhoof<br />
of ‘n opvoeder die wetlike bevoegdheid om<br />
enige leerder of eiendom in besit van die leerder<br />
te laat ondersoek vir ‘n gevaarlike wapen,<br />
vuurwapen, dwelms of ‘n skadelike gevaarlike<br />
middel, gesteelde eiendom of pornografiese<br />
materiaal, wat op die skooleiendom gebring<br />
word. (‘n Deursoeking mag uitgevoer word<br />
ingevolge die Wette van algemene toepassing :<br />
die Wet op die Beheer van Toegang tot<br />
Openbare Persele en Voertuie, 1985, Wet No.<br />
53 van 1985; die Wet op Dwelmhandel, 1992,<br />
Wet No. 140 van 1992 en die Wet op Wapens<br />
en Ammunisie, 1969, Wet No. 75 van 1969.)<br />

During a search human dignity shall be<br />
observed and persons of their own gender shall<br />
search learners in private, preferably in the<br />
presence of at least one other person. A record<br />
must be kept of the search proceedings and the<br />
outcome.<br />
A learner who falls pregnant may not be<br />
prevented from attending school. A pregnant<br />
girl may be referred to a hospital school for<br />
pregnant girls.<br />
<strong>DISCIPLINARY</strong> REGULATIONS FOR<br />
EDUCATORS, PRINCIPAL, TOUR<br />
MANAGERS <strong>AND</strong> <strong>DISCIPLINARY</strong><br />
COMMITTEE<br />
Discipline may be appliedby the following<br />
persons or institutions within the limits<br />
determined by these regulations or the<br />
applicable law:<br />
Educators<br />
In the case of less serious offences made in the<br />
presence of an educator, or reported to the<br />
educator, the applicable educator has the right to<br />
discipline the learner himself once the learner<br />
has been asked to explain his offenceand he has<br />
been found guilty.<br />
Should the learner plead not guilty, the educator<br />
must report the case to the principle<br />
The learner or educator that has knowledge of<br />
the trespass must report any situation of a<br />
trespass that points to serious misconduct to the<br />
principle or vice-principle immediately. No<br />
educator other than the person delegated by the<br />
principle has the authority or competence to<br />
discipline a learner for a serious misconduct.<br />
Disciplinary measures for less serious offences<br />
depend solely on the discretion of the applicable<br />
educator, but may consist of only one of the<br />
following:<br />

Gedurende ‘n deursoeking moet menslike<br />
waardigheid gehandhaaf word en leerders moet<br />
deur persone van hul eie geslag deursoek word,<br />
verkieslik in die teenwoordigheid van ten<br />
minste een ander persoon. ‘n Verslag moet<br />
gehou word van die deursoekingsproses en die<br />
uitslag daarvan.<br />
‘n Leerder wat swanger raak mag nie<br />
skoolbywoning ontsê word nie. ‘n Swanger<br />
meisie mag na ‘n hospitaalskool vir swanger<br />
meisies verwys word.<br />
TUGREGLEMENT VAN OPVOEDERS,<br />
HO<strong>OF</strong> TOERBESTUUR EN TUGKOMITEE<br />
Tug kan deur die volgende persone of<br />
instansies toegepas word binne die perke<br />
wat deur hierdie reglement of toepaslike<br />
wet bepaal word:<br />
Opvoeders<br />
In die geval van minder ernstige oortredings<br />
wat in die teenwoordigheid van ‘n opvoeder<br />
gepleeg word of gerapporteer word aan die<br />
opvoeder, sal die betrokke opvoeder die reg hê<br />
om, nadat die leerder om ‘n verduideliking<br />
gevra is en geen verontskuldigende antwoord<br />
gegee word nie, die leerder self tug.<br />
Indien die leerder die bewerings teen hom<br />
ontken, moet die opvoeder die saak aan die<br />
Hoof rapporteer.<br />
Iedere geval van ‘n vermeende oortreding wat<br />
op klaarblyklike ernstige wangedrag neerkom,<br />
moet onmiddellik deur die leerder of opvoeder<br />
wat daarvan kennis dra, onder die aandag van<br />
die Hoof of Adjunkhoof gebring word. Geen<br />
opvoeder anders as die gedelegeerde van die<br />
Hoof, sal die reg of bevoegdheid hê om enige<br />
tugbevoegdheid ten aansien van ernstige<br />
wangedrag uit te oefen nie.<br />
Tugmaatreëls vir minder ernstige oortredings<br />
sal in die uitsluitlike diskresie van die betrokke<br />
opvoeders wees, maar mag slegs bestaan uit een<br />
van die volgende:<br />
berisping;<br />

detention during break time;<br />
cleaning of facilities;<br />
addition work task;<br />
report to the guardian teacher;<br />
eviction from class / expelled from<br />
class.<br />
Such offences and the applicable punishment<br />
applied must be recorded by the educator in the<br />
applicable book and the learner must sign the<br />
record.<br />
In the case where the offence is reported to the<br />
guardian teacher or it is the third offence<br />
recorded, the learner will still be punished but<br />
the following steps must be taken:<br />
report to the standard / grade / phase<br />
guardian;<br />
the record of previous offences are also<br />
given to guardian teacher;<br />
a reprimanding interview by the<br />
guardian teacher with the learner;<br />
the guardian teacher must see to it that<br />
the learner delivers a letter by hand to<br />
the parents reporting the following:<br />
a list of previous offences;<br />
the parent / guardian are<br />
informed that in the case of<br />
further offences, the<br />
Governing Body has the right<br />
to consider the expulsion of<br />
the learner for a period of not<br />
more than one week.<br />
In the case of a fourth or more offence, the<br />
educator where the offence occurs, or the<br />
educator who receives the report of the offence,<br />
must report it to the Principal or vice-principal in<br />
the absence of the principle, immediately.<br />

teken.<br />
In die geval van aanmelding by die<br />
standerdvoog of ‘n derde oortreding wat aldus<br />
aangeteken word, sal benewens die straf wat<br />
daarvoor opgelê is, ook die volgende stappe<br />
volg:<br />
die geval word by die standerdvoog<br />
aangemeld;<br />
die rekord van vorige oortredings word aan<br />
die standerdvoog beskikbaar gestel;<br />
‘n berispende onderhoud word deur die<br />
standerdvoog met die leerder gevoer;<br />
die standerdvoog moet toesien dat die<br />
leerder ‘n brief per hand aan sy ouers of<br />
voog aflewer waarin:<br />
die vorige oortredings van die<br />
leerder uiteengesit word;<br />
die ouer/voog meegedeel word,<br />
dat in die geval van enige verdere<br />
oortreding van enige aard, die<br />
Beheerliggaam die skorsing van<br />
die leerder vir ‘n periode van nie<br />
langer as 1 week nie, mag<br />
oorweeg.<br />
In die geval van ‘n vierde of verdere oortreding,<br />
moet die opvoeder by wie dit plaasvind of die<br />
opvoeder aan wie dit gerapporteer word, dit<br />
onverwyld aan die Hoof, of in sy afwesigheid<br />
aan die Adjunkhoof rapporteer.<br />

a) The principal has all authority to<br />
discipline any offence referred to him.<br />
May it be of a less serious nature or<br />
serious misconduct? However he has<br />
no authority to discipline if he is of<br />
impression that the offence may lead<br />
to exclusion or expulsion. In such<br />
cases the principal deals according to<br />
paragraph 6.6 of this document<br />
b) The principal has the authority to<br />

Procedure when learner is referred to the<br />
Principal<br />
a) The Principal calls the learner that is<br />
guilty of a serious offence to his office<br />
to interview him / her immediately;<br />
b) The Principal informs the learner of<br />
the seriousness of the offence<br />
committed. He informs the learner of<br />
the relevant witnesses and information<br />
he has about the offence;<br />
c) If the learner pleads guilty to the last<br />
applicable offence, the Principal may<br />
continue with discipline once the<br />
learner has had the chance to give all<br />
facts and factors concerning the<br />
offence and the applicable discipline<br />
that may be applied;<br />
d) Should a learner plead not-guilty to an<br />
alleged offence, the learner should be<br />
allowed the opportunity to state his/<br />
her case, when witnesses may be<br />
called in. The Principal must use his<br />
discretion to call for more witnesses<br />
or proof to the advantage or<br />
disadvantage of the learner to<br />
determine the truth;<br />
e) The Principal must concider all<br />
information and evidence and come to<br />
a conclusion which he gives orally to<br />
the offender. Thereafter the Principal<br />
must inform the learner of the facts<br />
and factors and the applicable<br />
discipline concerning the offence<br />
before he disciplines the learner;<br />
f) The Principal may use his discretion<br />
in asking any person or learner to<br />
assist him in an advising manner<br />
during the procedure;<br />
g) The Principal, or someone nominated<br />
by him, must make written notes of all<br />
activities that took place during the<br />
proceedings.<br />
6.2.1.2 Prosedure indien oortreders na die Hoof<br />

d) Indien die leerder die pleging van<br />
die beweerde oortreding ontken,<br />
moet die leerder die volle<br />
geleentheid gegun word om sy<br />
saak te stel, wat die geleentheid<br />
tot die roep van getuies sal insluit.<br />
Die Hoof sal, in sy uitsluitlike<br />
diskresie, verdere getuienis kan<br />
voorlê tot voordeel of tot nadeel<br />
van die leerder, in die strewe<br />
daarna om die waarheid te bepaal;<br />
e) Die Hoof moet alle inligting en<br />
getuienis oorweeg en tot ‘n<br />
bevinding kom wat mondelings<br />
aan die leerder oorgedra moet<br />
word. Daarna mag die Hoof<br />
voortgaan om die leerder te straf<br />
nadat die leerder volledig<br />
geleentheid gehad het om feite en<br />
faktore voor te lê wat betrekking<br />
het op die aangeleentheid en die<br />
moontlike straf wat opgelê mag<br />
word;<br />
f) Die Hoof kan in sy diskresie,<br />
enige persoon of leerling vra om<br />
hom tydens die verrigtinge by te<br />
staan in ‘n adviserende<br />
hoedanigheid;<br />
g) Die Hoof, of iemand deur hom<br />
aangewys, moet aantekeninge hou<br />
van die wesenlike gebeure wat<br />
plaasgevind het tydens die<br />
verrigtinge.<br />

a) When the principal finds a learner guilty of<br />
misconduct he may<br />
apply one or more of the following punishments:<br />
(i) Cancellation or<br />
reduction of a mark<br />
achieved in a test, task,<br />
project, instruction or<br />
examination;<br />
(ii) Cancellation of the<br />
registration for a subject<br />
or subject level for a<br />
specific term, or specific<br />
year in the case of<br />
annual subjects;<br />
(iii) The learner must<br />
perform a specific task<br />
or service;<br />
(iv) Repremand the learner;<br />
(v) Instruct the learner to<br />
apologize to a specific<br />
person;<br />
(vi) Detention;<br />
(vii) Punishment such as<br />
applied by an educator in<br />
par. 6.1.4.<br />
b) When the principal is busy with the<br />
hearing of a learner and he is of the<br />
openion that the misconduct is of<br />
such a nature that the punishment is<br />
beyond his jurisdiction, he may refer<br />
the case to the Disciplinary<br />
Committee before the learner is<br />
found guilty. The Disciplinary<br />
Committee will then continue with<br />
the hearing.<br />

The principal decides whether the<br />

recorded formally against the<br />
learner’s record.<br />
A learner that has been found guilty<br />
and punished by the principal may<br />
lodge an appeal against his / her<br />
verdict and / or sentence with the<br />
chairperson of the Disciplinary<br />
Committee. This appeal will follow<br />
mutatis mutandis as in par. 8 of this<br />
document.<br />
A tour manager or camp leader may:<br />
o Exclude a learner from partaking in a<br />
tour or camp or from certain tour or<br />
camp activities;<br />
o Stop his / her membership of the<br />
group or camp immediately and the<br />
learner may be sent back to his<br />
school or permanent residence,<br />
depending on the nature of<br />
misconduct.<br />
The tour manager or group leader reports the<br />
conduct of the learner in writing to the<br />
principal after the tour or camp. The principal<br />
has the authority to decide according to<br />
circumstances whether further disciplinary<br />
actions will take place.<br />

the Governing Body members, appoint the<br />
Chairman of the committee so that justice<br />
especially with regard to the learner will enjoy<br />
preference. When legal issues occur, legal advice<br />

Three members of the committee form a quorum.<br />
The Disciplinary Committee may request<br />
information from any person, including experts<br />
from within or outside the school. The school<br />
may pay a nominal amount to a person from<br />
outside the school for services rendered.<br />

Authority of the Chairman<br />
The Chairman determines the procedure and<br />
sequence of activities for a disciplinary hearing if<br />
these regulations do not make provisions for such<br />

may, if he / she find it necessary:<br />
a) ask any committee member to be<br />
excluded from a specific hearing;<br />
b) replace any committee member by<br />
someone else.<br />
The chairman of the disciplinary committee:<br />
a) determines the dates and time for<br />
hearings by the committee;<br />
b) calls the committee together on<br />
other days if circumstances make<br />
it necessary;<br />

A complaint lodged against a learner is first<br />
investigated by the principal, or someone<br />
appointed by the principal. (Hereafter referred to<br />
as the principal) The principal collects<br />
information concerning the complaint / charge<br />
and personal conditions of the learner (Including<br />
information that can be to the advantage of the<br />
learner) as he seems necessary.<br />
When a misconduct has been reported to the<br />
principal and / or he investigates an alleged<br />
misconduct, the principal may appoint a male, if<br />
the learner is a boy, or a female, if the accused is<br />
a girl, to have the authority to search body or<br />
goods of the applicable person and to confiscate<br />
any object that may have been used during the<br />
misconduct. Such objects will be kept by the<br />
school until after disciplinary action has been<br />
taken and those performing the disciplinary action<br />
will decide if object will be return to the owner.<br />
Should a principal find it necessary to charge a<br />
learner he should compile a written report after<br />
his investigation. If he decides that there is a<br />
prima facie case against the learner, he completes<br />
a formal disciplinary charge sheet. He formulates<br />
the charge and explains clearly the misconduct of<br />
the learner.<br />
The disciplinary committee hears charges against<br />
learners that have been given to them by the<br />
principal.<br />
The principal gives a written notice of a hearing<br />
by the disciplinary committee to the applicable<br />
learner at least seven (7) days before the date of<br />
the hearing. He gives instructions of a specific<br />
date, time and place of the hearing as well as a<br />
copy of the charge as in par. 6.3.3. Such notice<br />
must be given to the learner personally.<br />

Funksie en prosedure<br />
‘n Klagte teen ‘n leerder word voordat dit<br />
aan die Tugkomitee voorgelê word, deur die<br />
Hoof of sy gedelegeerde (hierna slegs bloot<br />
“die Hoof” genoem) ondersoek. Die Hoof<br />
versamel sodanige inligting aangaande die<br />
klag en die persoonlike omstandighede van<br />
die leerder (insluitende inligting wat tot die<br />
voordeel van die leerder kan strek) as wat<br />
hy/sy nodig en moontlik ag.<br />
Wanneer ‘n oortreding gerapporteer word<br />
aan die Hoof, of die Hoof ondersoek instel<br />
na so ‘n beweerde oortreding, sal die Hoof<br />
‘n man in die geval dat die aangeklaagde ‘n<br />
seun is, en ‘n dame in die geval dat die<br />
aangeklaagde ‘n dogter is aanwys, wat die<br />
reg sal hê om die betrokkene se liggaam<br />
en/of goed te deursoek en besit te neem van<br />
enige voorwerp wat na bewering betrokke<br />
was by die pleging van die oortreding.<br />
Sodanige goedere sal behou word deur die<br />
skool tot by afhandeling van die tugoptredes<br />
teen die leerder, waarna die tuginstelling<br />
wat die tug toepas, sal beskik oor die<br />
goedere en/of dit aan die regmatige eienaar<br />
daarvan terugbesorg.<br />
Indien die Hoof van mening is dat ‘n leerder<br />
aangekla behoort te word, stel hy/sy ‘n<br />
verslag saam na sy/haar ondersoek. Indien<br />
die Hoof van mening is dat daar ‘n prima<br />
facie saak teen die leerder bestaan, stel<br />
hy/sy ‘n dissiplinêre klagstaat op waarin die<br />
aanklag teen die leerder geformuleer word<br />
met vermelding van die oortredings wat<br />
begaan is.<br />
Die Tugkomitee verhoor aanklagte teen<br />
leerders wat deur die Hoof aan hom<br />
voorgelê word.<br />
Die Hoof stel ‘n leerder wat van ‘n<br />
oortreding voor die Tugkomitee aangekla<br />
word, minstens sewe (7) dae voor die datum<br />
van verhoor, skriftelik in kennis om op ‘n<br />
bepaalde tyd en plek voor die Tugkomitee te<br />
verskyn, tesame met ‘n dissiplinêre<br />
klagstaat soos bedoel in par. 6.6.3.<br />
Sodanige kennisgewing moet aan die<br />
leerder persoonlik oorhandig word.<br />

Should the pupil not be at school for two<br />
consecutive days, the notice must be posted to<br />
him / her by registered post. Should the<br />
notice be posted it is addressed to the postal<br />
address given at his registration or the address<br />
given in writing to inform the school of a<br />
change of address.<br />
It is accepted that the learner has received the<br />
notice within seven (7) days after postage<br />
(excluding Saturdays, Sundays and Public<br />
holidays), even if the pupil still resides at that<br />
address or not or whether he / she has<br />
received the notice or not.<br />
A learner who must appear before the<br />
disciplinary committee:<br />
a) may be supported at the hearing by<br />
his parent, or both parents, or<br />
guardian, or both guardians;<br />
b) may be allowed to get legal advice<br />
with regard to the hearing;<br />
c) may not be supported by a legalist<br />
during the disciplinary hearing,<br />
unless the Disciplinary Committee is<br />
convinced that injustice will be done<br />
if the learner is not supported by<br />
legal advice. The decision of the<br />
disciplinary committee is final.<br />
Notice in par. 6.6.5<br />
a) must inform the learner that a written<br />
admission of guilty or a plead of not<br />
guilty and or a written testimony of<br />
the charge may be given to the<br />
principal before the hearing<br />
6.6.6<br />
6.6.7<br />
Indien die leerder egter vir twee dae<br />
agtereenvolgens nie by die skool is nie, moet<br />
die kennisgewing per geregistreerde pos aan<br />
hom/haar gestuur word. Indien die<br />
kennisgewing per pos geskied, moet dit<br />
geadresseer word aan die leerder se posadres,<br />
soos verstrek op die vorm ingevul by sy/haar<br />
jongste aansoek om as leerder geregistreer te<br />
word of na enige veranderde adres waarvan<br />
hy/sy later skriftelik kennisgewing aan die<br />
skool gegee het.<br />
Dit word aanvaar dat die leerder die<br />
kennisgewing en besonderhede binne 7 dae<br />
(Saterdae, Sondae en Openbare Vakansiedae<br />
uitgesluit) na die datum waarop dit gepos is,<br />
ontvang het, afgesien daarvan of die leerder<br />
hom/haar nog by die betrokke adres bevind al<br />
dan nie, en afgesien daarvan of hy/sy dit<br />
werklik ontvang het.<br />
‘n Leerder wat voor die Tugkomitee moet<br />
verskyn:<br />
a) sal die reg hê om deur sy ouer of<br />
beide sy ouers of voog of beide sy<br />
voogde bygestaan te word tydens<br />
die verhoor;<br />
b) sal die reg hê om regsadvies te<br />
bekom ten aansien van die<br />
verhoor;<br />
c) sal nie die reg hê om tydens die<br />
verhoor deur ‘n<br />
regsverteenwoordiger bygestaan te<br />
word nie, tensy die Tugkomitee<br />
oortuig word dat ‘n onherstelbare<br />
onreg sal volg indien<br />
regsverteenwoordiging nie aldus<br />
toegestaan sal word nie, welke<br />
beslissing van die Tugkomitee<br />
finaal sal wees.<br />
Die kennisgewing in 6.6.5<br />
a) moet die aangeklaagde nooi om<br />
skriftelik skuld te erken of te<br />
ontken, en om indien hy/sy dit<br />
verkies, ‘n skriftelike verklaring<br />
oor die aanklag teen hom by die<br />
Hoof in te dien voor die aanvang<br />
van die verhoor;<br />

during the hearing, written<br />

least 24 hours before the hearing.<br />
Should permission be granted at the<br />
hearing, the hearing will not be<br />
postponed if the legal advisor is not<br />

The disciplinary committee may use any<br />
documentation or information concerning the<br />
case to question the charged or witnesses at<br />
the hearing. The principal presents his report<br />
of par. 6.6.1 to the disciplinary committee.<br />
The disciplinary committee, the principal and<br />
the accused person has the right to call for<br />
witnesses that are relevant to the situation.<br />
The person who wants to call for a witness is<br />
responsible to see to the availability and<br />
presence of the witness.<br />
The principal leads the witness before the<br />
committee and may question the accused or<br />
his / her witness.<br />
The accused may:<br />
a) state his / her case to the disciplinary<br />
committee;<br />
b) ask the witnesses appearing before<br />
the committee questions;<br />
c) inspect any documentation<br />
concerning his hearing or investigate<br />
witnesses, unless it is to the<br />
detriment of the witness personally;<br />
d) give evidence in defence of his / her<br />
case in mitigation of sentence;<br />
e) call for witnesses of whom names<br />
were given 24 hours in advance of<br />
the hearing to the principal or may<br />
present written documentation of<br />
other witnesses as evidence in<br />
defence or mitigation of sentence;<br />

Die Tugkomitee mag enige dokumentêre of<br />
ander getuienis wat op die verhoor betrekking<br />
het, ter tafel neem en die aangeklaagde en<br />
getuies ondervra. Die Hoof lê sy verslag<br />
waarna in par. 6.6.1 verwys word, aan die<br />
Tugkomitee voor. Die Hoof, die aangeklaagde<br />
en die Tugkomitee het die reg om getuies te<br />
roep wat relevant tot die aangeleentheid is of<br />
blyk te wees. Iemand wat ‘n getuie wil roep is<br />
self verantwoordelik om die teenwoordigheid<br />
van die getuies te verseker.<br />
Die Hoof lei die getuienis voor die Tugkomitee<br />
en mag die aangeklaagde of sy getuie ondervra.<br />
‘n Aangeklaagde mag:<br />
a) die Tugkomitee toespreek om<br />
sy/haar saak te stel;<br />
b) aan die getuies wat voor die<br />
Tugkomitee getuig, vrae stel;<br />
c) enige dokumente wat op die<br />
verhoor betrekking het, inspekteer<br />
en enige ander getuienis ondersoek,<br />
indien dit nie tot gevolg het dat<br />
getuienis persoonlik benadeel sou<br />
word nie;<br />
d) getuienis gee ter verdediging van<br />
sy/haar saak of ter versagting van<br />
die straf;<br />
e) self getuies roep waarvan die name<br />
24 uur voor die tyd bepaal vir die<br />
verhoor by die Hoof ingedien is, en<br />
dokumentêre of ander getuienis<br />
voorlê ter verdediging van die<br />
aanklag of versagting van die<br />
vonnis;<br />

f) speak to the committee in defence<br />
or mitigation of sentence after all<br />
evidence and witnesses has been<br />
heard and before the sentence is<br />
passed.<br />
If an accused does not attend the hearing after<br />
written notice of par. 6.6.5, he / she may be<br />
heard in absentia.<br />
The decision of the disciplinary committee is<br />
given orally to the accused immediately. After<br />
the hearing the forms annexure C / C1 / C2<br />
(depending on the sentence) are completed in<br />
triplicate. The original is given to the learner,<br />
one copy to the chairman of the Governing<br />
body / Departmental Head and the other copy is<br />
kept on the learners file.<br />
After sentencing the accused the disciplinary<br />
committee may decide:<br />
a) if it will report to any other<br />
disciplinary institution about the<br />
nature of the misconduct and<br />
sentence with further action kept in<br />
mind;<br />
b) to inform the parents / guardians of<br />
the learners if they were not present<br />
at the hearing, or to make the<br />
sentence known to an outsider<br />
person or institution;<br />
c) that in the case of misconduct other<br />
than that of tests or exam<br />
regulations to put a notice on the<br />
official school notice board about<br />
the misconduct and sentence.<br />
Unless otherwise decided by the committee the<br />
principal may put a notice on the notice board<br />
of misconduct and sentence passed concerning<br />
test / examination regulations without<br />
mentioning of the learners name.<br />
After every disciplinary hearing all original<br />
documentation, evidence material, minutes of<br />
the hearing and following correspondence is<br />
kept safely by the principal.<br />

Indien ‘n aangeklaagde nie verskyn ingevolge<br />
die skriftelike kennisgewing genoem in par.<br />
6.6.5 nie, kan hy sy in absentia verhoor word.<br />
Die beslissing van die Tugkomitee word<br />
mondeling aan die aangeklaagde meegedeel<br />
en onmiddellik na afloop van die tugverhoor<br />
word vorms Bylae C / C(1) / C(2) (hangende<br />
af van die vonnis) in drievoud voltooi. Die<br />
oorspronklike word op die leerder gedien, een<br />
afskrif gaan aan die Voorsitter van die<br />
Beheerliggaam/ Departementshoof en die<br />
ander afskrif word vir rekord doeleindes op<br />
leêr bewaar.<br />
Na die oplegging van die straf kan die<br />
Tugkomitee besluit:<br />
a) of hy/sy aan enige ander<br />
tuginstansies die aard van die<br />
oortreding en die straf opgelê sal<br />
rapporteer met die oog op verdere<br />
gepaste optrede;<br />
b) om die leerder se ouers/voogde in<br />
kennis te stel van die straf indien<br />
hulle nie by die verhoor<br />
teenwoordig was nie, of om die<br />
straf aan ‘n buitepersoon of<br />
instansie bekend te maak;<br />
c) in geval van oortredings anders as<br />
van toetse of eksamenregulsies,<br />
of die straf en die oortreding op<br />
amptelike kennisgewingborde<br />
van die skool bekend gemaak<br />
moet word, al dan nie.<br />
Tensy die Tugkomitee anders besluit, mag<br />
die Hoof ‘n skuldigbevinding en oplegging<br />
van straf ten opsigte van ‘n oortreding van die<br />
toets- en eksamenregulasies op die amptelike<br />
kennisgewingbord van die skool bekend<br />
maak sonder vermelding van die betrokke<br />
leerders.<br />
Na afhandeling van ‘n tugsaak word alle<br />
oorspronklike dokumente, bewysmateriaal,<br />
notules van die verrigting en latere<br />
korrespondensie aan die Hoof vir bewaring<br />
besorg.<br />

The decision of the disciplinary committee is<br />
final with par. 6.7.2. Report is given to the<br />
Governing Body of all activities, findings and<br />
sentences by the disciplinary committee.<br />
The disciplinary committee may apply one or<br />
more of the following sentences:<br />
a) suspension from class attendance at<br />
school for maximum of 1 week;<br />
b) suspension from attending school<br />
in consultation with the<br />
Departmental Head, while waiting<br />
for a decision from the<br />
Departmental Head whether the<br />
learner must be expelled from<br />
school;<br />
c) impose a monetary fine of not more<br />
than one thousand rand that will be<br />
paid to school funds;<br />
d) cancellation of the results of a test,<br />
work task or examination or the<br />
registration in a specific course;<br />
e) impose a fine so that the amount<br />
will be sufficient to cover any<br />
damage, loss or cost caused by the<br />
learner to the school or any other<br />
person. The applicable amount<br />
will be paid into the school funds;<br />
f) abolish certain privileges the<br />
learner may have at school for a<br />
certain period of time;<br />
g) imposing a certain task;<br />
h) any other punishment which the<br />
committee may deem necessary in<br />
specific circumstances.<br />

Jurisdiksie en strawwe<br />
Die beslissing van die Tugkomitee is,<br />
behoudens par. 6.7.2 finaal. Daar word aan<br />
die Beheerliggaam verslag gedoen oor die<br />

Tugkomitee.<br />
Die Tugkomitee kan een of meer van die<br />

a) skorsing van bywoning van die<br />
skool vir ‘n tydperk van hoogstens<br />

b) skorsing van bywoning van die<br />
skool, in oorleg met die<br />
Departementshoof, in afwagting<br />
van ‘n beslissing deur die<br />
Departementshoof of die leerder<br />
uit die skool gesit moet word;<br />
c) heffing van ‘n geldelike boete tot<br />
‘n maksimum van een duisend<br />
rand wat in die skoolfonds gestort<br />
sal word;<br />
d) kansellering van die uitslag van ‘n<br />
toets, werkstuk of eksamen of van<br />
registrasie in ‘n bepaalde kursus;<br />
e) oplegging van sodanige geldelike<br />
bedrag as wat genoegsaam is om te<br />
vergoed vir enige skade, verlies of<br />
koste wat opsetlik of nalatig deur<br />
die oortreder aan die skool of aan<br />
enige ander persoon of saak<br />
veroorsaak is, en welke bedrag in<br />
die skoolfonds gestort sal word;<br />
f) opheffing vir ‘n bepaalde tydperk<br />
van enige voorregte van ‘n leerder,<br />
as lid van die skool;<br />
g) oplegging van ‘n bepaalde taak;<br />
h) enige ander straf wat die<br />
Tugkomitee in die besondere<br />
omstandighede geskik ag.<br />

PROCEDURE FOR A <strong>DISCIPLINARY</strong> HEARING<br />
Preparation for a disciplinary hearing<br />
Determine whether an offence has been<br />
committed(complete an incident report Annexure A)<br />
As soon as the principal receives notice of<br />
an offence the incident report must be<br />
completed. (Annexure A) It may be written<br />
reports by witnesses or any other people<br />
involved in the incident. In such a manner<br />
he must be assured that in terms of law,<br />
disciplinary or school codes an offence has<br />
been committed and that disciplinary<br />
actions is necessary. Should their be<br />
disciplinary actions against a learner it must<br />
be done in writing. The learner receives the<br />
original copy, the principal the first copy,<br />
the second copy is placed on file and the<br />
third copy is sent to the parents/guardian of<br />
the learner.<br />
Note being:<br />
The incident report is not a written warning.<br />
The aim of the incident report is to collect<br />
all relevant information concerning the<br />
alleged misconduct and may serve as basis<br />
for further disciplinary action.<br />
Formulate offence<br />
If it is found that the alleged incorrect<br />
behavior requires disciplinary action,<br />
misconduct is formulated according to the<br />
disciplinary codes. This is the<br />
responsibility of the principal.<br />

word. Sodoende moet hy/sy<br />
homself/haarself daarvan gewis dat<br />
daar in terme van wetgewing,<br />
dissiplinêre kode of skool kode,<br />
oënskynlik ‘n oortreding begaan is en<br />
of sodanige oortreding dissiplinêre<br />
optrede regverdig. Indien dissiplinêr<br />
teen leerder opgetree word, ontvang<br />
leerder oorspronklike, Hoof eerste<br />
kopie, tweede kopie word vir<br />
rekorddoeleindes gebêre en derde<br />
kopie gaan aan ouers/voogde.<br />
Let wel:<br />
Die voorvalleverslag is nie ‘n<br />
skriftelike waarskuwing nie. Die doel<br />
van die voorvalleverslag is om<br />
inligting aangaande die beweerde<br />
oortreding te versamel om as<br />
grondslag vir moontlike dissiplinêre<br />

beweerde foutiewe gedrag wel<br />
dissiplinêre optrede regverdig, word ‘n<br />
oortreding aan die hand van die<br />

die verantwoordelikheid van die Hoof<br />
wees.<br />

Notice of disciplinary hearing<br />

a) The notice form (Annexure B and B(1)<br />
) must be completed in full by the<br />
Principal and must be given to the<br />
learner and his / her parents in good<br />
time before the hearing. Make sure of<br />
the notice period required as in the<br />
disciplinary procedure. The notice<br />
(Annexure B) must be issued in four –<br />
fold. Once the learner has signed<br />
acceptance of the notice he is served<br />
with the original. Copies are given to<br />
the principal, one is kept on the file for<br />
record purposes and the third copy is<br />
sent to the parents / guardians. The<br />
notice (Annexure B(1) ) is completed<br />
in triplicate. The original is served on<br />
the parents once they have signed<br />
admission of receipt. The first copy<br />
goes to the principal while the second<br />
one goes on the file of the learner for<br />
record purposes.<br />
b) The learner must also be informed<br />
orally, with the aid of a translator if<br />
necessary about the following:<br />
the alleged offence;<br />
the date, time and place where<br />
the hearing will take place;<br />
that he makes the necessary<br />
arrangements if he requires<br />
the assistance of a member of<br />
the Representative Student<br />
Council;<br />
that he makes the necessary<br />
arrangements for his own<br />
witnesses to be present at the<br />
hearing;<br />
that he has the right to be<br />
assisted by his parents /<br />
guardians at the hearing;<br />
that he may gain legal advice<br />
in respect of the hearing;<br />
7.1.3 Kennisgewing van dissiplinêre verhoor<br />
a) Die kennisgewingvorm (Bylae B<br />
en B(1)) moet volledig voltooi<br />
word deur die Hoof en binne ‘n<br />

where the hearing will be held.<br />
People present at the hearing<br />
Only persons mentioned in the disciplinary<br />
procedure may be present at the hearing.<br />
Course of the disciplinary hearing<br />
A list of control is included to assist the<br />
chairperson step by step in the hearing. He<br />
can mark off once a step is completed.<br />
This list of control must be added to the<br />
minutes of the hearing.<br />
Duties of the Chairperson<br />
The Chairperson will:<br />
ensure that all concerned persons<br />
are present. If a learner is not<br />
present it must not be assumed<br />
that he does not want to be<br />
present. Make sure that the<br />
stipulations of the disciplinary<br />
procedure were followed<br />
accurately. If a learner does not<br />
want to make use of a<br />
Representative from the Student<br />
Council it must be indicated on<br />
the disciplinary report and the<br />
learner must be requested to sign;<br />
describe the alleged offence<br />
clearly;<br />
give the principal a chance to<br />
describe the incident;<br />

Pligte van Voorsitter<br />
Die Voorsitter sal:<br />
verseker dat alle betrokkenes<br />
teenwoordig is. Indien die<br />
leerder nie teenwoordig is nie,<br />
moet nie sondermeer aanvaar<br />
word dat hy verkies om nie<br />
teenwoordig te wees nie. Die<br />
stappe voorgeskryf in die<br />
dissiplinêre prosedure moet<br />
eers nougeset nagekom word.<br />
Indien die leerder nie van ‘n lid<br />
van die Verteenwoordigende<br />
Studenteraad gebruik wil maak<br />
nie, moet dit as sodanig op die<br />
dissiplinêre verslag aangedui<br />
word, en moet hy versoek word<br />
om dit te onderteken;<br />
die beweerde oortreding<br />
volledig beskryf;<br />
die Hoof die geleentheid gee<br />
om die gebeure te beskryf;<br />

The Chairman will ask the offender / his<br />
representative as well as the principal to<br />
use the information available to give their<br />
view if the alleged offender is guilty and<br />
give reasons for the decision.<br />
After hearing the views the Chairman in co<br />
– operation with the rest of the committee<br />
will decide if the learner is guilty. The<br />
Chairperson will base his conclusion of<br />
guilty or not on a “weight of probabilities”<br />
(rather than on the concept of “above<br />
reasonable doubt” which is used in the<br />
criminal procedure.) He will convey his<br />
decision and reasons to the offender and<br />
other concerned persons present.<br />
7.2.2<br />

deurlopend die getuienis wat<br />
deur elke betrokkene gelewer<br />
is, opsom;<br />
die leerder versoek om die<br />
lokaal te verlaat voordat ‘n<br />
besluit geneem word of hy<br />
skuldig of onskuldig is.<br />
Die Voorsitter sal die beskuldigde<br />
leerder/sy verteenwoordiger en die Hoof<br />
vra om met die feite tot hul beskikking,<br />
hul siening te gee of die leerder skuldig<br />
is al dan nie, asook redes waarom hulle<br />
so dink.<br />
Na aanhoor van genoemde sienings sal<br />
die Voorsitter in samewerking met res<br />
van Tugkomiteelede, self besluit of die<br />
leerder skuldig of onskuldig is. Die<br />
Voorsitter sal sy besluit ten aansien van<br />
skuldig, al dan nie, basseer op ‘n<br />
“oorwig van waarskynlikhede” (in<br />
teenstelling met die beginsel van “bo<br />
redelike twyfel” wat in die Strafproses<br />
prosedure gebruik word). Hy sal sy<br />
besluit en die redes daarvoor aan die<br />
beskuldigde leerder en die ander partye<br />
teenwoordig oordra.<br />

If there is any doubt, the Chairperson may<br />
postpone the hearing for a short while until<br />
the necessary information has been<br />
obtained. To illustrate the difference<br />
between “above reasonable doubts” vs.<br />
“weight of probabilities” the following<br />
definitions are given.<br />
Above reasonable doubt<br />
The required onus probandi to succeed in<br />
criminal procedures. This onus is higher<br />
than those in civil – right procedures. The<br />
chairperson must be approximately 75%<br />
certain that the person is guilty. The<br />
chairperson does not have to be 100%<br />
certain of guilt, a margin of reasonable<br />
doubt is allowed.<br />
Weight of probabilities<br />
The required onus to achieve in a civil –<br />
right procedure. The onus is lower than<br />
that of a criminal procedure. The party at<br />
issue whose evidence of the incidence<br />
seems to be the most probable (with a<br />
minimum of 51% credibility) has the right<br />
to have the verdict in his favor.<br />
Determining disciplinary measures in the of a<br />
conviction<br />
It must be made sure that the learner’s<br />
school record is available at the hearing.<br />
When disciplinary measures are<br />
determined, the following factors must be<br />
considered:<br />
the seriousness of the<br />
transgression;<br />
the circumstances in which the<br />
offence took place;<br />
the nature and number of<br />
previous offences by the learner<br />
that are still valid;<br />

Indien daar twyfel bestaan kan die<br />
Voorsitter die verhoor vir ‘n kort tyd<br />
verdaag of uitstel totdat die nodige<br />
inligting bekom is. Om die verskil<br />
tussen “bo redelike twyfel” vs “oorwig<br />
van waarskynlikhede” te illustreer volg<br />
‘n kernagtige definisie van die<br />
onderskeie beginsels hieronder.<br />

bewyslas is hoër as in siviele-regtelike<br />
verrigtinge. Die voorsittende beampte<br />
moet min of meer 75% seker wees dat<br />
die persoon skuldig is. Die<br />
voorsittende beampte hoef nie absoluut<br />
100% seker te wees nie – ‘n mate van<br />
redelike twyfel word toegelaat.<br />
Op ‘n oorwig van waarskynlikhede<br />
Die vereiste bewyslas om te slaag in<br />
siviele-regtelike verrigtinge. Die<br />
bewyslas is laer as in strafregtelike<br />
verrigtinge. Die gedingsparty wie se<br />
weergawe van die feite die<br />
waarskynlikste blyk te wees dit wil sê<br />
gedingsparty se weergawe(ten minste<br />
51% geloofwaardig), is geregtig op<br />
uitspraak in sy guns.<br />
Bepaling van dissiplinêre maatreël in die geval<br />
van skuldigbevinding<br />
Daar moet seker gemaak word dat die<br />
leerder se rekord by die dissiplinêre<br />
verhoor beskikbaar is, met ander<br />
woorde sy skoolrekord.<br />
By die bepaling van dissiplinêre<br />
maatreëls sal die volgende faktore in ag<br />
geneem word:<br />
die erns van die oortreding;<br />
die omstandighede waaronder<br />
die oortreding plaasgevind<br />
het;<br />
die aard en aantal vorige<br />
oortredings deur die leerder<br />
wat nog geldig is;<br />

how were similar offences treated<br />
previously;<br />
is there anything in mitigation of<br />
sentence;<br />
the effect that the disciplinary<br />
action will have on other learners;<br />
are the disciplinary measures<br />
within rules of the disciplinary<br />
code.<br />
The Chairperson will ask the offender and<br />
the principal to give their view, as well as<br />
reason for their views, on the disciplinary<br />
measures that will be applied.<br />
After hearing the opinions the chairperson<br />
and the rest of the committee will decide on<br />
the applicable disciplinary measures. The<br />
chairperson will decide and then convey his<br />
decision to all representative parties<br />
present.<br />
Conveying the verdict to the learner<br />
The chairperson will call the learner and<br />
give the following information:<br />
whether he is guilty or not and the<br />
reasons for the verdict;<br />
which disciplinary measures will<br />
be imposed.<br />
If there is any doubt the chairperson may<br />
withhold the verdict until the necessary<br />
clearance of an aspect has been obtained.<br />
Completion of appropriate documentation<br />
The applicable document (Annexure C /<br />
C(1) / C(2) depending on the incident) must<br />
be completed by the chairperson.<br />

moet word asook die redes waarom<br />
hulle so dink.<br />
Na aanhoor van hierdie menings sal die<br />
Voorsitter en res van Tugkomitee self<br />
besluit oor die dissiplinêre maatreëls<br />
wat opgelê sal word. Hy sal sy besluit<br />
en die redes daarvoor aan die<br />
teenwoordigende partye oordra.<br />
Oordra van die bevinding aan die leerder<br />
Die Voorsittende beampte sal die<br />
leerder inroep en aan hom die volgende<br />
meedeel:<br />
of hy hom skuldig bevind al<br />
dan nie en die redes daarvoor;<br />
watter dissiplinêre maatreël<br />
toegepas gaan word.<br />
Indien daar twyfel bestaan kan die<br />
Voorsitter vir ‘n kort tyd uitspraak<br />

Voltooiing van die toepaslike vorm<br />
Die toepaslike vorm (bylae C / C(1) /<br />
C(2) na gelang van die geval) sal<br />
volledig deur die Voorsitter voltooi<br />

Signing of the document<br />

a) The Chairperson will read the<br />
contents of the document<br />
(annexure C/ C(1)/ C(2) ) to the<br />
learner and then ask the learner<br />
and parents to sign the document<br />
as proof that they take note of the<br />
verdict.<br />
b) It is not a requirement that the<br />
learner and his/her parents must<br />
sign the document. Refusal to<br />
sign the document will have no<br />
effect what so ever on the<br />
application of disciplinary action.<br />
c) If the learner or parents/guardians<br />
refuse to sign the document the<br />
chairperson will make a written<br />
note on the document that the<br />
verdict has been given to the<br />
learner and parents/guardians.<br />
The notice will then be signed by<br />
the chairperson as well as a<br />
witness.<br />
d) The original document is given to<br />
the learner. A copy is given to<br />
the chairperson of the Governing<br />
body or Departmental Head. The<br />
second copy is kept on the<br />
learner’s school file.<br />
Arrangement of a subsequent interview (if<br />
applicable)<br />
If applicable the chairperson may make<br />
arrangements with the learner with regard<br />
to standards that must be achieved and<br />
what must be done to achieve these<br />
standards. He may make arrangements for<br />
a subsequent interview during which he<br />
will try to solve problems that might still<br />
occur.<br />

dokumente te onderteken, sal<br />
geen invloed hoegenaamd op<br />
die toepassing van dissiplinêre<br />
optrede hê nie.<br />
c) Indien die leerder of sy<br />
ouers/voogde weier om die<br />
vorm te onderteken, sal die<br />
Voorsitter dit op die verslag<br />
aanteken asook dat die besluit<br />
aan die leerder en sy<br />
ouers/voogde oorgedra is en<br />
die en die inskrywing<br />
onderteken. ‘n Getuie sal ook<br />
die vorm onderteken.<br />
d) Die oorspronklike vorm word<br />
aan die leerder oorhandig. Die<br />
eerste afskrif gaan na die<br />
Voorsitter van die<br />
Beheerliggaam of<br />
Departementshoof en die<br />
tweede afskrif gaan vir<br />
rekorddoeleindes na die<br />
personeelkantoor.<br />
Reël van opvolgonderhoud (indien toepaslik)<br />
Indien nodig kan die Voorsittende<br />
beampte met die leerder ooreenkom oor<br />

Duties of secretary during hearings<br />
Take minutes during hearing<br />
The secretary’s duty is to take minutes<br />
accurately during the hearing procedure.<br />
Procedures as well as what was said by<br />
different parties must be written down<br />
accurately and detailed. This prevents<br />
differences of opinion which may occur at<br />
a later stage.<br />
Format of minutes<br />
APPEAL<br />
Aim<br />
The format of the minutes must be<br />
according to the list of control. An<br />
example of minutes has been attached for<br />
your convenience. The secretary must<br />
take note that if a question is asked and<br />
then answered, it must be written down as<br />
such. The names of all persons that give<br />
witness or ask questions must be written<br />
down clearly for reference purposes. If<br />
applicable the minutes must be typed<br />
neatly and kept on file.<br />
The aim of an appeal is to give the learner<br />
the opportunity to call on higher authority<br />
against any disciplinary measures taken<br />
against such a learner.<br />
The grounds on which the learner may<br />
appeal are stipulated in the procedure:<br />
Delegation of authority<br />
Appeal cases are handled by the line<br />
authority (one level higher) in<br />
correspondence with the approved school<br />
procedures.<br />

mag voorkom uit die weg te ruim.<br />
Formaat van notule<br />
APPèL<br />
Doel<br />
Die formaat van die notule moet<br />
volgens die kontrolelys geskied, en<br />
word ‘n voorbeeld van ‘n notule vir<br />
gerief aangeheg. Sekretaris/esse se<br />
aandag word daarop gevestig, dat<br />
wanneer ‘n vraag gevra en ‘n antwoord<br />
gegee word, dit so genotuleer moet<br />
word. Alle persone wat getuig of vrae<br />
vra se name moet ook duidelik uitgestip<br />
word, vir latere verwysing. Indien van<br />
toepassing moet notule netjies getik<br />
word en moet oorspronklike op leêr<br />
bewaar word.<br />
Die doel van appèl is om die leerder die<br />
geleentheid te gee om hom/haar te beroep<br />
op die volgende hoër gesag teen enige<br />
dissiplinêre maatreël wat teen sodanige<br />
leerder geneem word.<br />
Die gronde waarop appèl aangeteken kan<br />
word, word in die prosedure uiteengesit:<br />

A learner has the right to appeal against<br />
disciplinary actions taken against him<br />
according to these procedures. The<br />
following general reasons for appeal may<br />
occur:<br />

was to harsh in the<br />
circumstances.<br />
Should the learner want to<br />
give new evidence that was<br />
not available at the hearing<br />
and where this lack of<br />
evidence is not due to neglect<br />
to give the evidence by the<br />
learner or if the evidence<br />
could not be obtained<br />
reasonable by the learner.<br />
The allegation that the<br />
disciplinary committee was<br />
biased during the hearing.<br />
The allegation that the right<br />
procedure was not followed.<br />
The following appeal procedure is applicable to<br />
all learners:<br />
Educators<br />
Principal<br />
A learner found guilty of an offence by an<br />
educator and then disciplined may appeal to<br />
the principal against his conviction.<br />
According par. 8.4.3 this appeal will be<br />
handled mutates mutandis.<br />
A learner convicted and disciplined by the principal,<br />
may lodge an appeal against his/her conviction with<br />
the chairperson of the Disciplinary Committee. The<br />
chairperson will then handle the appeal mutates<br />
mutandis as in par. 8.4.3.<br />

bevind en gestraf word, kan teen sy/haar<br />
skuldigbevinding en/of straf appèl<br />
aanteken na die Hoof van die skool<br />
welke appèl mutatis mutandis sal<br />
verloop soos in par. 8.4.3. hieronder<br />
uiteengesit.<br />
‘n Leerder wat deur die Hoof skuldig bevind en<br />
gestraf word, kan teen sy haar skuldigbevinding<br />
en/of straf, appèl aanteken na die Voorsitter van<br />
die Tugkomitee welke appèl mutatis mutandis sal<br />
verloop soos in par. 8.4.3. hieronder uiteengesit.<br />

Disciplinary Committee<br />

A learner may apply for leave to appeal against his<br />
conviction to the chairperson of the Governing<br />
Body, within seven (7) days after his/her<br />
conviction by the disciplinary committee, except in<br />
expulsion cases. The chairperson may grant<br />
permission if he is of the opinion that the learner<br />
has a reasonable change of success with such an<br />
appeal. The decision of the chairperson Governing<br />
Body is final. If permission is given to appeal the<br />
learner must give a written notice of appeal to the<br />
principal within two (2) days (only a notice of<br />
appeal) (The chairperson completes the bottom<br />
section of annexure E)<br />
Once permission to appeal has been given, the<br />
learner must hand in a written appeal to the<br />
principal stating reasons and against which section<br />
of the conviction he is appealing against. This<br />
must be done within seven (7) days.<br />
The chairperson of the Governing Body will then<br />
compose an Appeal Board consisting of three<br />
members who may hear any appeal of which the<br />
principal gives them notice. He also appoints the<br />
chairperson of the Appeal Board. The chairperson<br />
will consist out of a member of the Governing<br />
Body and two persons which have no connection<br />
with the school. Should legal matters occur, legal<br />
advice may be gained. No member of the<br />
disciplinary committee may serve on the Appeal<br />
Board.<br />
The principal hands all documentation relevant to<br />
the disciplinary committee, to the Appeal Board.<br />
The following procedure must be followed when<br />
an appeal has been lodged:<br />
Step 1<br />
a) If a learner is dissatisfied with the<br />
conviction of the chairperson of<br />
the Disciplinary Committee, he/she<br />
or the representative must<br />
complete the first section of appeal<br />
document (annexure E) in<br />
triplicate. The reason for his<br />
appeal as well as any extra<br />
information applicable to the case<br />
must be written on the document.<br />

Tugkomitee<br />
‘n Leerder kan binne sewe (7) dae na die<br />
beslissing van die Tugkomitee, by die Voorsitter<br />
van die Beheerliggaam aansoek doen om verlof<br />
tot appèl teen die Tugkomitee se beslissing, slegs<br />
in gevalle waar skorsing nie toegepas is nie. Die<br />
Voorsitter staan sodanige aansoek toe indien<br />
hy/sy van mening is, dat die leerder ‘n redelike<br />
vooruitsig op sukses het met so ‘n appèl. Die<br />
Voorsitter van die Beheerliggaam se beslissing is<br />
finaal. Indien verlof tot appèl toegestaan word,<br />
moet leerder binne twee dae skriftelik kennis van<br />
appèl by Hoof gee. (slegs kennis gee) (Voorsitter<br />
voltooi onderste gedeelte van Bylae E.)<br />
Nadat verlof tot appèl verleen is, moet leerder<br />
binne sewe dae sy/haar gronde vir appèl skriftelik<br />
by die Hoof indien en ook skriftelik te kenne gee<br />
teen watter deel van die uitspraak hy/sy appèl<br />
aanteken.<br />
Die Voorsitter van die Beheerliggaam stel ‘n<br />
Appèlraad saam wat uit drie lede bestaan om<br />
enige appèl aan te hoor, waarvan die Hoof<br />
hom/haar kennis gee, en wys ook die Voorsitter<br />
van die Appèlraad aan. Die voorsitter word<br />
aangewys uit ‘n lid van die Beheerliggaam terwyl<br />
die ander twee lede geen verbintenis met die<br />
skool mag hê nie. Indien regsaangeleenthede ter<br />
sprake kom, word voorgestel dat regsadvies<br />
ingewin word. Geen lid van die Tugkomitee mag<br />
op die Appèlraad dien nie.<br />
Die Hoof oorhandig alle dokumentasie en notules<br />
wat op die tugverhoor betrekking het aan die<br />
Appèlraad.<br />
Die volgende stappe moet gevolg word wanneer<br />
appèl aangeteken word:<br />
Stap 1<br />
(a) Wanneer leerder ontevrede is met<br />
die beslissing van die Voorsitter<br />
van die Tugkomitee, moet hy/sy of<br />
sy verteenwoordiger die appèlvorm<br />
in drievoud voltooi (bylae E) –<br />
eerste gedeelte van vorm). Die<br />
rede(s) vir die appèl asook enige<br />
bykomende inligting wat op die<br />
saak van toepassing is, moet op die<br />
appèlvorm aangeteken word.<br />

b) The appeal document must be given<br />
to the principal within seven (7)<br />
days after leave to appeal has been<br />
granted. The principal admits<br />
reception of the document and gives<br />
a copy to the learner.<br />
c) The original appeal document, as<br />
well as all other relevant<br />
documentation and minutes are<br />
handed to the chairperson of the<br />
Governing Body. A copy is kept on<br />
file.<br />
Step 2<br />
a) If leave to appeal is granted, the<br />
chairperson of the Appeal Board<br />
determines a date, time and place<br />
when the appeal hearing will take<br />
place. The principal then gives<br />
written notice to all relevant persons<br />
at least seven (7) days before the<br />
hearing. Notice must be given to the<br />
learner and his parents on the<br />
required documents. (annexure F<br />
and F(1))<br />
b) The appeal board has the right to call<br />
in any person he can provide<br />
information needed for the hearing.<br />
The appeal board then hears oral<br />
objection from the learner and gives<br />
the Disciplinary committee a chance<br />
to motivate their decisions.<br />
c) The learner has the right to have<br />
representation such as that allowed<br />
at the disciplinary hearing.<br />
d) Members of the Disciplinary<br />
Committee may only be called in as<br />
witnesses at the Appeal Hearing if<br />
necessary. Like any other witness<br />
they may not be present when the<br />
disciplinary measure is decided<br />
upon.<br />
(b) Die appèlvorm moet binne sewe<br />

Appèlraad ‘n datum vas vir die<br />
verhoor van appèl en die Hoof<br />
gee minstens sewe (7) dae vooraf<br />
skriftelik kennis van die<br />
verhoordatum van die appèl aan<br />
al die betrokkenes. Kennis moet<br />
aan die leerder en ouers op die<br />
voorgeskrewe vorms (bylae F en<br />
F(1)) gegee word.<br />

(b) Die Appèlraad kan na goeddunke<br />
enige persoon oproep om hulle<br />
van inligting te voorsien wat op<br />
die tugsaak betrekking het. Die<br />
Appèlraad hoor voorts<br />
mondelinge vertoë van die<br />
appellant aan en bied geleentheid<br />
aan die Tugkomitee om die redes<br />
vir die Tugkomitee se beslissing<br />
te motiveer.<br />
(c) Die leerder het ook hier die reg op<br />
verteenwoordiging soos by ‘n<br />
Tugkomitee verhoor.<br />
(d) Die lede van die Tugkomitee<br />
verhoor mag alleenlik as getuies<br />
by die Appèlverhoor betrek word,<br />
indien nodig. Soos enige ander<br />
getuie mag hulle ook nie<br />
teenwoordig wees wanneer die<br />
dissiplinêre maatreël oorweeg<br />
word nie.<br />

e) The chairperson will follow a<br />
procedure similar to that stipulated<br />
in the disciplinary procedure and<br />
also listen to witnesses and<br />
evidence that are applicable within<br />
the grounds of the Appeal Board.<br />
The minutes of the Disciplinary<br />
Hearing must also be declared as a<br />
correct version of what happened<br />
during the disciplinary hearing.<br />
f) The chairperson of the Appeal<br />
Board will make an independent<br />
decision after hearing the appeal.<br />
He will then make known the<br />
Appeal Boards decision and<br />
reasons to the learner. The<br />
chairperson will then writes down<br />
his conviction on the Appeal<br />
document (annexure G) and sign<br />
it. It is recommended that the<br />
learner and his/her parents also<br />
sign the document as proof that<br />
they take note of the board’s<br />
decision.<br />
g) The Appeal Board may confirm<br />
the decision of the Disciplinary<br />
Committee, set it aside or<br />
amended their decision. The<br />
Appeal Board may even give a<br />
harsher punishment then that of<br />
the Disciplinary Committee.<br />
h) The relevant documentation is<br />
given to the principal for filing<br />
purposes.<br />
i) The decision of the Appeal Board<br />
is final and no leave to appeal to<br />
any higher authority will be<br />
granted.<br />
Appeal procedure where suspension is applicable<br />
A learner has the right to appeal to the<br />
Departmental Head against exclusion<br />
imposed on him by the Disciplinary<br />
Committee. The same procedure as that<br />
mentioned in par. 8. 4. 3. 5 must be<br />
followed. The relevant documentation is<br />
now sent to the Departmental Head,<br />
whose decision is final. (complete<br />
annexure E (1) )<br />
8.4.4<br />
(e) Die Voorsittende beampte sal ‘n<br />
proses volg in ooreenstemming met<br />
die voorgeskrewe reëls soos vervat<br />
in die dissiplinêre prosedure en<br />
onder andere ook die getuienis oor<br />
toepaslike aangeleenthede wat binne<br />
die appèlgronde val aanhoor. Die<br />
notule van die aanvanklike<br />
dissiplinêre verhoor moet ook<br />
bekragtig word as synde ‘n korrekte<br />
weergawe van wat tydens die<br />
dissiplinêre verhoor plaasgevind het.<br />
(f) Die Appèlvoorsitter sal na aanhoor<br />
van die appèl ‘n onafhanklike<br />
bevinding maak en die Appèlraad se<br />
beslissing en redes daarvoor aan die<br />
leerder oordra. Die Appèlvoorsitter<br />
sal na sy beslissing dit op die<br />
uitspraak appèlvorm (bylae G)<br />
aanteken en dit onderteken. Dit is<br />
wenslik dat die leerder en sy/haar<br />
ouers/voogde ook die appèlvorm<br />
onderteken as bewys dat kennis<br />
geneem is van die Appèlraad se<br />
beslissing.<br />
(g) Die Appèlraad kan die Tugkomitee<br />
se beslissing bekragtig, ter syde stel<br />
of wysig, en is bevoeg om ‘n<br />
swaarder straf op te lê as wat die<br />
Tugkomitee opgelê het.<br />
(h) Die relevante dokumentasie word na<br />
die Hoof gestuur vir liassering en<br />
rekorddoeleindes.<br />
(i) Die beslissing van die Appèlraad is<br />
finaal en geen verdere appèl na hoër<br />

A learner will have the right to appeal to a<br />
Member of the Executive Council if a<br />
recommendation for suspension was given<br />
by the disciplinary committee and it was<br />
granted by the Departmental Head. The<br />

must be followed. The relevant<br />
documentation must be sent to the<br />
Member of the Executive Council whose<br />
