TENDER NOTICE <strong>No</strong> .Sr.DMM/Agra/Veh.Hiring/11 Date 20-12-2011<br />

Sr. Divisional Electrical Engineer (General) Agra, for and on behalf of president of<br />

President of India, invites sealed open tenders from the contractors/firms having valid for the<br />

following noted work and will be received up to 14.55 Hrs. in the tender box kept in the office of<br />

Sr. DEE/G/AGRA, which will be opened at 15.00 Hrs. on the date(s) <strong>ment</strong>ioned. The form can be<br />

obtained from Sr. Divisional Materials Manager, Agra Cantt on all worked days through cash<br />

pay<strong>ment</strong> shown against the work and Rs. 500/- extra if form is required by post. <strong>Railway</strong> shall not<br />

be responsible for delayed delivery of tender forms by post. <strong>Tender</strong> for ms will be available 30<br />

days before & up to 1<strong>1.</strong>00 Hrs. on the opening date <strong>ment</strong>ioned therein. In case it happens to be<br />

holiday on opening day, the tenders will be opened on next day at the same time. Cost of the<br />

tender form is not refundable. If any contractor is inter ested to be present at the time of opening of<br />

tender , he may do so at his own expenses. Administration has right to cancel any one or all the<br />

tender s with out assigning any reasons. The tender docu<strong>ment</strong>s can also be downloaded from<br />

<strong>Railway</strong>’s website www.ncr.Indian railways.gov.in or gover<strong>ment</strong> of India portal<br />

www.tenders.gov .in and used for quoting, for which the cost of tender docu<strong>ment</strong>s should be<br />

submitted along with tender in the shape of crossed Demand Draft or Banker ’s Cheque (nonrefundable)<br />

payable at Agra in favour of Sr. Divisional Finance Manager, <strong><strong>No</strong>rth</strong> <strong>Central</strong><br />

<strong>Railway</strong>, Agra with out which tender form will be rejected. <strong>Railway</strong> Administration shall not be<br />

responsible for any delay/difficulties/ inaccessibility of the downloading facility for any reason<br />

whatsoever. In case of any discrepancy between the tender docu<strong>ment</strong>s downloaded from internet<br />

and the master copy available in the office, the later shall prevail and will be binding on the<br />

<strong>Tender</strong>er(s). <strong>No</strong> claim on this account will be entertained. The tenderer shall be required to<br />

deposit earnest money with the tender for the due performance with the stipulation to keep the<br />

offer open till such date as specified in the tender. (Minimum 90 days from the date of opening of<br />

tender) under the conditions of tender . The earnest money should be in cash deposited with<br />

Divisional cashier or in any of the following forms: Deposit receipts, pay orders, demand drafts<br />

duly pledged in favour of Sr. Divisional Finance Manager, <strong><strong>No</strong>rth</strong> <strong>Central</strong> <strong>Railway</strong>, Agra . Failing<br />

which the tenders will be summarily reacted. These forms of earnest money could be either of the<br />

State Banks of India or of any of the nationalized banks. <strong>No</strong> confirmatory advice from the Reserve<br />

bank of India will necessary. Deposit receipts executed by the scheduled Banks ( other than State<br />

Bank of India and the nationalized banks) should be approved by the Reserve Bank of India for<br />

this purpose. The railways will not, however, accept deposit receipt with out getting in writing the<br />

concurrence of the Reserve bank of India. <strong>Tender</strong> with invalid earnest money and in shape of<br />

REGULATIONS FOR TENDERS AND CONTRACT FOR THE<br />

GUIDANCE OF CONTRACTORS FOR vehicle hiring WORKS<br />

Meaning of Terms<br />

In these Regulations for tenders and following terms shall have the Definitions meaning<br />

assigned hereunder except where the contest otherwise required:-<br />

(a) “<strong>Railway</strong>” shall mean the president of the republic o f India or the administrative Officers of<br />

the <strong><strong>No</strong>rth</strong> <strong>Central</strong> <strong>Railway</strong> or of the successor <strong>Railway</strong> authorized to deal with any matter<br />

which these present are concerned on his behalf.<br />

(b) “General Manager” shall mean the officer in administrative charge of the whole of <strong>Railway</strong><br />

and shall mean and include the General Manager of the successor railway.<br />

(c) “Chief Engineer” shall mean the officer in charge of the <strong>Stores</strong> Deptt. of N. <strong>Central</strong> <strong>Railway</strong><br />

shall and also include the Engineer in Chief, Chief Engineer (Construction) Chief Signal and<br />

Tele- communication Engineer and shall mean include the Chief Engineer/Engineer in Chief,<br />

Chief Engineer (Construction) and Chief Signal Tele- communication Engineer of the<br />

successor railway.<br />

(d) Engineer shall mean the Division/District Engineer/DEE/G/Agra NCR or the Executive<br />

Engineer in Executive charge o f the work and shall include the superior officer of the<br />

Engineering Deptt. Of the <strong>Central</strong> <strong>Railway</strong> i.e. Dy. Chief Engineer /Chief Engineer<br />

(Construction) Engineer in chief Signal and Tele- communication Engineer Dy. Chief Signal<br />

and Tele-communication Engineer and shall mean and include the Engineer of the successor<br />

<strong>Railway</strong>.<br />

(e) “Engineer’s representative” shall mean the SE/SSE in direct charge o f the work and shall<br />

include any residence engineer or sub Engineer or Sub-Engineer or any Inspector of the Civil<br />

Engineering/Signal/Tele-communication Engineering Deptt, appointed by the <strong>Central</strong><br />

<strong>Railway</strong> and shall mean and include the Engineer’s Representative of the successor <strong>Railway</strong>.<br />

(f) “Contractor” shall mean the per son firm or capacity whether incorporated or not who enters<br />

in to the contract with the railway and shall include their executors administrators,<br />

Successors and permitted assigns.<br />

(g) “Divisional Superintendent” shall mean the administrative officer in-charge of the Division<br />

of <strong>Central</strong> <strong>Railway</strong> for the time being and shall mean and include the divisional<br />

Superintendent o f the successor <strong>Railway</strong>.<br />

(h) “<strong>Tender</strong>er” shall mean the person, the firm of company who tender for the works with a view<br />

to execute the works on contract with the <strong>Railway</strong> and shall include the divisional<br />

Superintendent o f the successor and permitted assigns.<br />

(i) “Limited tenders” shall mean tenders invited from all o r more contractor s on the approved<br />

list of contractor with the <strong>Railway</strong>.<br />

(j) “Open tenders” shall mean tenders invited in open and manner and with adequate notice.<br />

(k) “Work” shall mean the work contemplated in the drawing and schedulers set forth in the<br />

tender from the description of contract and required to be executed according to<br />

specifications.<br />

(l) “Specification” shall mean the specification for material & work <strong>Central</strong> railway issued<br />

under authority of the chief engineer o r as amplified added to or superseded by special<br />

specifications, if any appended to the tender forms.<br />

(m) Schedule of rate “<strong>Central</strong> <strong>Railway</strong>” shall mean the schedule of rate issued date the electric of<br />

the chief electrical Engineer fro m time to time.<br />

“Dr awing” shall mean the drawing, plans and tracings or prints o r the annexed to the tender<br />

Forms.<br />

2 . Singular and Plural:- Words imparting the singular number shall also include the plural and vice<br />

verse where the context required.<br />

3. These regulation for tender and contract shall be read in conjunction with the general condition of<br />

contract which are referred to here in and shall be subject to modification adjust and suppression by special<br />

condition of contract and /or special specifications if any to the tender forms.<br />

4. Contract’s Credentials-<br />

a. Contractor who has no t carried out any works so far on this railway should furnishes particulars<br />

regarding:-<br />

b. His position as an independent contractor.<br />

c . His capacity to undertake and carry out works satisfactorily, as vouched for by a responsible office<br />

or firm.<br />

d . His previous experience of works similar to the to be contracted for , in proof o f which original<br />

certificates o r testimonials may be called for and their geniuses verified, if need be, by reference to the<br />

signatories thereof.<br />

e . His knowledge, fro m actual personal investigation o f the resources of the Zone or Zones in which he<br />

offers to work.<br />

f. His ability to supervise the work personally or by competent and duly authorized without agents.<br />

g . His financial position<br />

5. Omissions and discrepancies:- Should a tendered find discrepancies in, or omission from the drawing<br />

or any o f the tender for ms or should he be in doubt as to their meaning, he should at once notify the<br />

authority inviting tenders who may send a written instruction to all tenders. It shall be understood that<br />

every endeavor has been made to avoid amt error which can materially affect the basis of the tender and he<br />

successful tender shall take upon himself and provide for the risk o f any error which may subsequently be<br />

discovered and shall make no subsequent claim on account there of.<br />

6.Earnest money:- The tenders shall also be required to deposit a sum of Rs. 11136.0 to wards earnest<br />

money with the I f his tender is accepted this earnest money will be retained and part security for the due<br />

and faithful fulfill<strong>ment</strong> of the contract in terms of clause 16 of the general condition of contract. The<br />

earnest money of other tenderers shall, save as herein before provided be returned to them, but the<br />

<strong>Railway</strong> shall not be responsible for any lossor depreciation that may happen there to while in their<br />

possession nor be liable to pay any interest thereon.<br />

7.Care in submission of <strong>Tender</strong> :-<br />

a.) Before submitting a tender, the tender will be deemed to have satisfied himself by actual inspection<br />

docu<strong>ment</strong> of the site and locality of the work that all condition liable to be encountered during the<br />

execution of the work or taken into account and that the rates he enters in the tender form is/are<br />

adequate and all inclusive to accord with the provision in clause 37 of the general condition of contract<br />

for the completion of work to the entire satisfaction o f the engineer.<br />

b) When work is tendered for by a fir m or company o f contractor the tender shall be singed by the<br />

individual legally authorised to enter into commit<strong>ment</strong>s on their behalf.<br />

The <strong>Railway</strong> will not be bound by power of attorney granted by the tender er or by change in the<br />

composition o f the firm mad e subsequent to the execution of the contract. It may however recognize such<br />

power o f attorney and change after obtaining proper legal advice, the cost o f which will be chargeable to<br />

contractor.<br />

8.Opening of <strong>Tender</strong>:-At the advertised time and placed, tenders received for a contract shall be opened<br />

by a tender committee, and where practicable, the name tenderers and rate tendered by them read out at in<br />

presence of such of the intending contractors or their agents as may attend.<br />

9. Right of Rly. to deal with tenders:- The <strong>Railway</strong> reserves the right o f not to invite tender for any<br />

work o r works or to invite open o r limited tenders, and when tenders are call to accepted a tender in<br />

who le or in part or reject any tender or all tender without assigning reason for any such action.<br />

10. Executions of Contract docu<strong>ment</strong>: - The tender whose tender is accepted shall be required to appear<br />

in the office of the Divisional Electrical Engineer (General) Agra <strong><strong>No</strong>rth</strong> <strong>Central</strong> <strong>Railway</strong> as the case may<br />

be in person o r if a firm or corporation, a duly authorised representative so appear and execute the contract<br />

docu<strong>ment</strong> within seven days after notice that the contract have been awarded to him. Failure to do shall<br />

constitute a breach of the agree<strong>ment</strong> effected by the acceptance of the tender in which case the earnest<br />

money accompanying the tender shall be forfeited by the <strong>Railway</strong> as liquidated damages for such default<br />

In the event o f any <strong>Tender</strong>er who se tender is accepted shall refuse to execute the contract docu<strong>ment</strong> as<br />

herein before provided the railway may determine that such tenderer has abandoned the contract and<br />

there upon his tender and the acceptance therefore shall be null and avoid and the railway shall be entitled to<br />

forfeit the earnest money as liquidated damages for such default<br />

Conditions of <strong>Tender</strong><br />

<strong>1.</strong> The drawing for t he work can be seen in the Office of Sr.Div. Materials Manager <strong><strong>No</strong>rth</strong> <strong>Central</strong> <strong>Railway</strong>s, Agra<br />

2. General conditions of contract and specifications for material and work of the N. <strong>Central</strong> <strong>Railway</strong> can be seen<br />

at the Office of Div. Materials Manager <strong><strong>No</strong>rth</strong> <strong>Central</strong> <strong>Railway</strong>s, Agra<br />

3. The <strong>Tender</strong>er/<strong>Tender</strong>ers shall quote his/their rates on percent basis above or below or at par with reference to total estimated<br />

schedule cost. The quantities shown in the attached schedule are giving as guide and are approximate only and are subject t o<br />

variation according to the need of <strong>Railway</strong>. The <strong>Railway</strong> accepts no responsibility for their accuracy the railway does not<br />

guarantee work under each item of the schedule.<br />

4. The tender containing erasures and alteration of the tender docu<strong>ment</strong>s are liable to be rejected. Any correction<br />

made by the tender/ <strong>Tender</strong>ers in his/their entries must be attested by him/them.<br />

5. The Work are required to be completed within a period of 02 Years from the date of issue of acceptance letter.<br />

6. The tender must be accompanied by a sum of Rs . 11136.00 (Rs. Eleven thousand One Hundred Thirty Six Only) earnest<br />

money deposited in cash or in any forms <strong>ment</strong>ioned in the notice failing which the tender will be summarily rejected.The<br />

tender shall hold the offer open till such date as may be specified in the tender. It is understood that the tender docu<strong>ment</strong> have<br />

been sold/issued t o t he tenderer and t he tenderer is bei ng permitted to tender in consideration of the stipulation on his part that<br />

after submitting his tender, he will not resile from his offer or modify the terms and conditions therefore in a manner not<br />

acceptable to the of the <strong><strong>No</strong>rth</strong> central <strong>Railway</strong>. if the tender is accepted the amount of earnest money will<br />

be held as security deposit for the due and faithful fulfill<strong>ment</strong> of the contract. The earnest money of t he unsuccessful <strong>Tender</strong>er<br />

will as therei n-before provi ded be returned to the unsuccessful tenderers but the <strong>Railway</strong> shall not be responsible for any loss<br />

or depreciation that may happen to t he security for the due performance of the stipulation to keep the offer open for the period<br />

specified in the tender docu<strong>ment</strong> or to the earnest money while in their possession, nor be liable to pay interest thereon.<br />

7. It shall not be obligatory on the said authority to accept the lowest tender and no <strong>Tender</strong>er/tenderers shall demand any<br />

explanation for the cause of rejection of his/t heir tender.<br />

8. If the <strong>Tender</strong>er deliberately gives/tenderers deliberately give information i n his/t heir tender or creates/create<br />

Circumstances for the acceptance of his/their t ender, the <strong>Railway</strong> reserves the right to reject such tender at any Stage.<br />

9. If a <strong>Tender</strong>er expires after the submission of his tender or after the acceptances of his tender, the <strong>Railway</strong> shall<br />

deem such tender as cancelled. If a partner of a firm expires after the submission of their tender or after the<br />

acceptance of their tender, the <strong>Railway</strong> shall deem such tender as cancelled unless the firm retains its character.<br />

10.The earnest money for the due performance of the stipulation to keep t he offer open till the date specified in the tender will<br />

be refunded to the unsuccessful <strong>Tender</strong>er <strong>Tender</strong>ers within a reasonable time The earnest money deposited by the successful<br />

<strong>Tender</strong>er/tenderers will be retained towards the security deposit for the due and faithful fulfill<strong>ment</strong> of the contract but shall be<br />

forfeit ed if the contractor fails/contractors fail to execute to agree<strong>ment</strong> bond or start work within a reasonable time (to be<br />

determined by engineer-in-charge) after notification of the acceptance of his/t heir tender.<br />

1<strong>1.</strong> Docu<strong>ment</strong>s testifying to the <strong>Tender</strong>er / <strong>Tender</strong>ers’ Pervious experience and financial status should be produced when<br />

desired by the <strong>Railway</strong>.<br />

12.<strong>Tender</strong>s must be enclosed in sealed covers, super scribed , Hiring of One vehicle Scorpio/Tavera/ Bolero Tata Sumo/ or<br />

equivalent type model not earlier than yr.2010 colour preferably white in good working condition including driver, fuel, crew<br />

and maintenance etc. up to 2500 kms.per month 24 hrs.per day without any holiday or rest for official use of Sr.DMM/AGC<br />

and must be send by registered post to the address of Sr.Divisional Materials Manager ,<strong><strong>No</strong>rth</strong> <strong>Central</strong> <strong>Railway</strong>,Agra , so as<br />

to reach his office not later than 14.55 hrs. up to 08.02.12 or deposited in the special box allotted for the purposes this will be<br />

sealed at 14.55 hrs. on08.02.12 and will be opened at 15.00 hrs. on08.02.12 .those who wish to attended may do so.<br />

13. <strong>No</strong>n-compliance with any of the conditions set forth therein above is liable to result in the tender<br />

being rejected.<br />

14. The authority for the acceptance o f the tender will rest with the ADRM/AGRA/Engineer-in-<br />

chief/Deputy Chief Engineer/Div isional Super intended/Divisional Engineer/Executive<br />

Engineer , <strong><strong>No</strong>rth</strong> <strong>Central</strong> <strong>Railway</strong> who does not bind himself to accept the lowest or any other<br />

tender not does he undertake to assign reasons for declining to consider any particular tender or<br />

tenders.<br />

15. The successful <strong>Tender</strong>er/<strong>Tender</strong>ers shall be required to execute an Agree<strong>ment</strong> with the President<br />

India acting thought the Deputy Chief Engineer/Divisional Super intendent/Divisional<br />

Engineer /Executive Engineer of the <strong>Railway</strong>, for carrying out the work according to the<br />

general Conditions of Contract and Specification work and Materials of <strong>Central</strong> <strong>Railway</strong>.<br />

16. The tender shall keep the offer open for minimum period of 90 days from the date opening of the<br />

tender within which period the tenderer can not with draw his offer subject to the period bein g<br />

extended further if required by mutual agree<strong>ment</strong> fro m time to time. Any contravention of the<br />

above condition will make the tender liable for forfeiture of his earnest money.<br />

17. Should a tender be retired engineer of the Gazetted rank o r any other Gazetted officer working<br />

before his retire<strong>ment</strong>, whether in the executive or administrative capacity or whether holding a<br />

pension able post or not, in the electrical depart<strong>ment</strong> o f any of the <strong>Railway</strong> owned and<br />

administered by the present o f India for the being, or sho uld a tenderer being partnership fir m<br />

have as one of its partner a retired Engineer or retired Gazetted officer as a foresaid, or should a<br />

tenderer being as incorporated company have any such a retired Engineer or retired Gazetted<br />

officer foresaid, at one of his directors or should a tenderer have in his employ<strong>ment</strong> any retired<br />

Engineer or retired officer foresaid the full information as to the deu of retire<strong>ment</strong> of such<br />

Engineer or gazetted officer from the said ser vice and in case where such Engineer or officer had<br />

not retired from govern<strong>ment</strong> service at least two ear prior to date of the submission o f the tender<br />

as to whether permission fo r taking such contract, or, if the contract be a partnership fir m o r an<br />

incorporated, company to became a partner or director as the case may be, or to take<br />

employ<strong>ment</strong> under the contract has been obtained by the tender o r the engineer or the officer as<br />

the case maybe from the president o f India o r any officer duly authorize by him in this behalf<br />

shall be clearly state in writing at the time submitting the tender. <strong>Tender</strong>s without the<br />

information above refer to o r a state<strong>ment</strong> to the effect that no such retired engineer or retired<br />

gazetted officer is no associated the tender, as the case may be shall be rejected.<br />

18. Should a tenderer / contractor being the individual on the list o f approved contractor have a<br />

relative employed in gazetted capacity in the electrical deport<strong>ment</strong> o f <strong><strong>No</strong>rth</strong> <strong>Central</strong> <strong>Railway</strong> o r,<br />

in case of partnership firm or company incorporated under the Indian company law should a<br />

partner o r the relative or the partner or the share holder o r a relative of a share holder be<br />

employed in gazetted capacity in the electrical depart<strong>ment</strong> of <strong><strong>No</strong>rth</strong> <strong>Central</strong> <strong>Railway</strong> authority<br />

inviting tenders shall be inform o f the fact in the time of submission o f tenders, failing which<br />

tender may be reject, or if such fact subsequently comes to light, the contract may be rescinded<br />

in accordance with the provision in clause 62 of the general condition of contract.<br />

19. Should the railway decide to negotiate with a view to bring down rate the original offer will still<br />

be biding in case nothing materialized out o f the negotiation.<br />

SPECIAL CONDITIONS OF CONTRACT<br />

<strong>1.</strong> The special condition appoint<strong>ment</strong> the condition of tenders and contracts, the General Condition<br />

Contract and the notes appearing under the relevant chapters and sub-chapters of the stander s<br />

schedule o f Rates, 1976 and should be considered a part contract paper. Where the provisions of<br />

these conditions are at variance with the general conditions o f the contract, these special<br />

conditions shall prevail.<br />

<strong>1.</strong> A .The General Conditions of contract will mean the General Condition o f Contract as<br />

amended and/or corrected from time to time and obtaining at the time o f accepting of the tender<br />

and at the of execution of the agree<strong>ment</strong> <strong>ment</strong>ioned in clause 15 under conditions of tender.It<br />

should be the responsibility of the contractor before submitting his tender and again befo re<br />

entering into said agree<strong>ment</strong> to ascertain all amend<strong>ment</strong> and/or correction made to the said<br />

general conditions o f contract.<br />

2. <strong>Railway</strong>’s material such as ce<strong>ment</strong>, M.S. bars, flats or other sections including tie bars, A.C<br />

sheet with o r with out ridges and accessories, G.I. sheets g lasses o r and other items as are<br />

stipulated in the agree<strong>ment</strong> to be issued of the contractor for the work, either free of char ge or<br />

o n pay<strong>ment</strong> as the case may be will be issued to him at the <strong>Railway</strong>’s depot/goods shed at and<br />

will be used by the contractor for the work in such quantities as are indicated in the schedule or<br />

in revenant specification or drawing o r as approved by the Engineer whose decision hereon shall<br />

be final. Wastage of damage to such material in any manner shall be totally avoided. If any<br />

quantity of the <strong>Railway</strong>’s material is consumed in excess or wasted or damaged or lost or not<br />

satisfactorily accounted for, in that case, recovery, will be made from the contractor at the<br />

respective market rate o r book r ate whichever charges o n the overall cost of material consumed<br />

in excess or wasted damages, lost or not satisfactorily accounted for in accordance with pares<br />

2327 to 2329 of the India railway’s Code for stores depart<strong>ment</strong>.<br />

3. The co de nos. Descriptions and Rates given in the schedule are based on the standard schedules<br />

o f rates 1976. Any discrepancy notices during the executions of the work, in the working rates,<br />

quantity of the ce<strong>ment</strong> etc. Should be rectified by reference to the printed schedule, which be<br />

treated as authoritative & binding on the contractor. The relevant notes applicable to the<br />

respective sub-chapter will apply to the items of the tender schedule and should be considered<br />

as having been incorporation in the contract agree<strong>ment</strong> and binding on the contractor.<br />

4. For any other items not specially shown in the schedule o f rates appended to the tender<br />

docu<strong>ment</strong>, the Divisional/Executive Engineer will offer rates as shown for the X zone in the<br />

<strong><strong>No</strong>rth</strong> <strong>Central</strong> <strong>Railway</strong>’s standard schedule of rates, 1976 subject to the same percentage<br />

adjust<strong>ment</strong> accepted in the contract being applicable to the additional items.<br />

5. The <strong>Railway</strong>’s shall not supply fro m its own quota to the contractors controlled commodities<br />

Assistance will, however, be given by recommending to appropriate authorities contractor’s<br />

applications for issue o f import licenses and release of controlled commodities of the Engineer<br />

is satisfied that this material is actually required by the contractors for carrying out the work and<br />

is not available in the country.<br />

6. Variations of costs. – Labour and Material (Escalation clause) - Clause 60 of General conditions<br />

o f contract viz. Variations of costs labour and material and shall not be applicable to this<br />

contract.<br />

7. Period of completions - The <strong>Railway</strong> expects that resourceful and experienced contractor should<br />

be able to complete the work in all respects within 02 Years after contract is awarded.<br />

8. Maintenance period - The work shall be maintained after completion for a period of NILby the<br />

contractor and he shall make good any defects imperfections shrinkages or faults which may<br />

appear at his own cost.<br />

TERMS & CONDITIONS FOR SUPPLY OF VEHICLE ON MONTHLY<br />

HIRE BASIS TO SR.DMM’s Office /N.C.Rly/Agra.<br />

<strong>1.</strong> The rate shall be inclusive of all expenditures including fuel, maintenance etc. <strong>No</strong> additional charges,<br />

in any form, will be admissible, <strong>Railway</strong> will be concerned only about the operation of the vehicle.<br />

2. The vehicle must be mechanically sound and maintained in good condition . Model should not be<br />

earlier tha n Yr. 2010. Vehicle must have sufficient petrol / diesel to travel 200 kms at any point of<br />

time .<br />

3. The normal daily utilization will be 12 (twelve ) hours.<br />

4. The monthly utilization shall be 2000 Kms in aggregate.<br />

5. The vehicle should report to the officer at 8.00 hrs sharp everyday. However, the officer as per<br />

require<strong>ment</strong> ma y change the reporting time.<br />

6. Even beyond the specified hours of utilization, the vehicles should be available at short notice in case<br />

of emergency.<br />

7. Fifteen minutes (15’) time shall be allowed both ways for reporting on and off duty for the purpose of<br />

charges.<br />

8. All tax liabilities will be of the vehicle owner and <strong>Railway</strong> will not, in any way, be concerned with<br />

the same .<br />

9. The rates quoted by the firm (<strong>Tender</strong>er ) shall not be revised or altered during the currency of the<br />

contract period.<br />

10. The interior of the vehicle including luggage boot ( Dickey ) must be tidy with neat and clean loose<br />

seat covers and exterior should also be presentable.<br />

1<strong>1.</strong> The vehicle should be accompanied with all relevant and valid docu<strong>ment</strong>s and per mit to run the<br />

geographical, jurisdiction of Agra Division . Pay<strong>ment</strong> of toll tax/ entry tax, if any, within the<br />

geographical jurisdiction of Agra Division will be made by the contractor. <strong>Railway</strong> administration<br />

will not be liable to make any pay<strong>ment</strong> on this account. In case permit is not available, the contractor<br />

will get it on his own.<br />

12. The driver of the vehicle should be well mannered and educate, preferably with the knowledge of<br />

Hindi/ English and should report for duty properly dressed with valid driving license. H e will be<br />

required to maintain a logbook, which will be signed by the officer using the vehicle or any other<br />

persons authorized by him.<br />

13. The vehicle should be provided with sign-plate with ‘ On Govt. of India Service/ Bharat Sarkar<br />

Sewarth’ written on it and should be equipped with fog lights .<br />

14. In the event of brake down of vehicle, contractor will provide alternate suitable equivalent vehicle,<br />

otherwise proportionate amount for whole days will be deducted and penalty up to Rs. 1000/- per day<br />

(One Thousand only) will be imposed.<br />

15. In case of brake down of vehicle en-rout cost of transporting the user officer of the vehicle to his<br />

destination shall be borne by contractor. If he fails to provide the alternate arrange<strong>ment</strong> to transport<br />

the officer, he officer will hire any vehicle to reach the destination and charges paid will be deducted<br />

from contractor’ regular bills in addition to penalty.

16. In case the vehicle does not report for duty on any day of the driver / Vehicle become untraceable at<br />

any point of time, proportionate pay<strong>ment</strong> for the day shall be deducted and a penalty up to Rs. 500/-<br />

can also be imposed, in addition.<br />

17. In case of non compliance of any of the conditions, a penalty up to Rs.500/- per condition per day<br />

shall be imposed on defaulting contractor.<br />

18. The firm shall deposit earnest money @ 02% of contract value in the form of DD/FDR/TDR drawn<br />

on any scheduled bank in favour of Sr.DFM/ N.C.Rly. which shall be refundable award on successful<br />

completion of the contract.<br />

19. Pay<strong>ment</strong> will be made by Cheque on the basis of monthly billing for which proper record keeping<br />

with counter signatures of user officer has to be maintained by the suppler. Bills will have to<br />

produced to account for pay<strong>ment</strong> duly countersigned by user officer or his representative.<br />

20. The contract will be awarded for a period of Two years.<br />

2<strong>1.</strong> The vehicle should be registered as a Commercial vehicle with road transport & contractor should<br />

submit relevant papers of registration of vehicle before starting the work.<br />

22. <strong><strong>No</strong>rth</strong> <strong>Central</strong> <strong>Railway</strong> reserves the right to terminate the contract at any point of time without<br />

assigning any reason for which the balance pay<strong>ment</strong>, if any, will release in due course as per normal<br />

procedure.<br />

23. In all matters related to the quality of service, utilization of the vehicles within the agreed terms and<br />

conditions etc., decision of <strong>Railway</strong> administration will be final and binding.<br />

24. Offerer must give contact <strong>No</strong>. available at Agra so that he may be contacted round the clock. The<br />

drivers should be provided with a mobile phone by the contractor.<br />

Variation in quantities:<br />

The procedure detailed below shall be adopted for dealing with ;variation in quantities during execution of works<br />

contract:<br />

<strong>1.</strong>Individual NS items in contracts shall be operated with variation of plus or minus 25% and pay<strong>ment</strong> would be made<br />

as per the agree<strong>ment</strong> rate. For this, no finance concurrence would be required.<br />

2.In caser on increase in quantity of on individual item by more than 25% of the agree<strong>ment</strong> quantity is considered<br />

unavoidable, the same shall be got ;executed by floating a fresh tender. If floating a fresh tender for operating that item<br />

is considered not practicable quantity of that item may be operated in excess of125% of the agree<strong>ment</strong> of quantity<br />

subject to the following conditions:<br />

<strong>1.</strong>Operation of fan item by ;more ;than 125% of the agree<strong>ment</strong> quantity needs the approval of an officer of the ;rank not<br />

less than S-A Grade.<br />

i) Quantities operated in excess of 2125% but upto 140% of the ;agree<strong>ment</strong> quantity of the of the concerned item, shall<br />

be paid at 98% of the rate awarded for that item in that particular tender,<br />

ii) Quantities operated in excess of 140% but up to 150% of the agree<strong>ment</strong> quantity of the concerned item shall be paid<br />

at 96% of the rate awarded for that item in ;that particular tender.<br />

iii)Variation ;in ;quantities of individual terms beyond 150% will be prohibited and would be permitted only in<br />

exceptional unavoidable circumstances with the concurrence of associate finance and shall be paid at 96% of the rate<br />

awarded for that item in that particular tender.<br />

a.The variation in quantities as a per the above formula will apply only ;to the individual items of the contract and not<br />

on the overall contract value.<br />

b.Execution no quantities beyond 150% of the overall agree<strong>ment</strong>al value should not be permitted and, if found<br />

necessary , should be only through fresh tenders or by negotiating with existing with existing contractor, with prior<br />

personal concurrence of FA&CAO( C ) and approval of General Manager.<br />

3)Incase where decrease is involved during execution of contract:<br />

a) The contract signing authority can decrease the items upto 25% of individual item without finance concurrence.<br />

b) B)For decrease beyond 25% for individual items or 25% of contract agree<strong>ment</strong> value, the approval of an officer<br />

not less that rank of SA Grade may be taken. After obtaining ‘<strong>No</strong> claim certificate ‘from ;the contractor and with<br />

finance concurrence, giving detailed reasons for each such decrease in the quantities.<br />

c) C)It should be certified that the work proposed to be reduced will not required in the some work<br />

d) 4)The limit for varying quantities for minor value items shall be 100%(as against 25% prescribed for other items<br />

)<br />

e) A minor value item for this purpose is defined as an item whose original agree<strong>ment</strong> value isles that 1% of the<br />

total original agree<strong>ment</strong> value.<br />

5. <strong>No</strong> such quantity variation limit shall apply for foundation items.<br />

6. As far as SOPR items are concerned, thellimitof25% would apply to the value of SOR schedule as whole and not on<br />

individual SOR item. However , in case of NS items, the limit of25% would apply on the individual items irrespective<br />

of the manner quoting the rate(single percentage rate or individual item rate)<br />

7.Fortheternders accepted at Zonal <strong>Railway</strong>s level, variations in the quantities will be approved by the authority in<br />

whose powers revised value of the agree<strong>ment</strong> lies.<br />

8.For tenders accepted by Generl Managers, variations upto125% of the original agree<strong>ment</strong> value may be accepted by<br />

General Manager.<br />

9.Fortenders accepted by Board and <strong>Railway</strong> Ministers, variations up to 110% of the original agree<strong>ment</strong> value may be<br />

accepted by General Manager.<br />

10,The aspect of invitation of tender with respect to variation, in quantities should be checked and avbiided. In case of<br />

invitation of the tender(both for increase as well as decrease of value of contract agree<strong>ment</strong>), sanction of the competent<br />

authority as per single tender should be obtained.<br />
