Sewell is an uninhabited Chilean mining town located in <strong>the</strong> commune of Machalí in Cachapoal Province at an altitude of<br />

between 2,000 <strong>and</strong> 2,250 metres. The town was founded in 1904 by <strong>the</strong> Braden Copper Co to extract <strong>the</strong> copper in <strong>the</strong> El<br />

Teniente mine, <strong>and</strong>, in 1915, it was named after <strong>the</strong> company’s first president, Mr Barton Sewell. The Chilean Government<br />

declared Sewell a National Monument in 1998, while UNESCO designated it a World Heritage Site in 2006.<br />

1130 – 1230 Power integration in Latin America<br />

Latin America has no trouble securing sufficient energy resources to sustain its economic growth, <strong>and</strong> near-universal access to<br />

electricity is planned for <strong>the</strong> region by 2030. It remains a net oil, gas <strong>and</strong> coal exporter, with Colombia <strong>and</strong> Venezuela boasting<br />

sizeable coal resources <strong>and</strong> Brazil set to become <strong>the</strong> region’s largest gas producer by 2025. It will develop more hydro resources,<br />

with hydroelectricity accounting for more than 60 per cent of electricity generation by 2035, <strong>the</strong> largest percentage contribution<br />

worldwide. International agencies also predict significant growth in solar, photovoltaic, <strong>and</strong> wind power. However, energy<br />

resources are not necessarily located where <strong>the</strong>y are needed, with some countries having more than <strong>the</strong>y can use while o<strong>the</strong>rs<br />

are heavily dependent on foreign supply. Energy integration is necessary to deal with <strong>the</strong> uneven distribution of resources, <strong>and</strong><br />

various measures have already been taken to accomplish this, with more planned for <strong>the</strong> future. However, abrupt interruptions<br />

of previously agreed energy exchanges cast shadows on <strong>the</strong> security of <strong>the</strong>se integration agreements.<br />

Significant legal <strong>and</strong> regulatory challenges arise to make integration more than mere political wishful thinking.<br />

Integration of oil <strong>and</strong> gas production, hydro, <strong>the</strong>rmal, nuclear <strong>and</strong> o<strong>the</strong>r non-traditional power sources with <strong>the</strong> required<br />

pipelines <strong>and</strong> electricity grids is key for a world increasingly concerned with energy efficiency <strong>and</strong> consumption, necessitating<br />

a balance between promising new sources of energy <strong>and</strong> <strong>the</strong> existing plays in <strong>the</strong> whole of Latin America, with a precise<br />

evaluation of <strong>the</strong> future scenarios <strong>and</strong> <strong>the</strong> ever increasing dem<strong>and</strong> for energy. However, <strong>the</strong> region continues to import with<br />

high transportation costs, substantial volumes of coal, LNG <strong>and</strong> fuels which could instead be substituted advantageously if clear<br />

<strong>and</strong> stable energy policies could be set forth <strong>and</strong> energy trade regulated in a satisfactory way, with a long-term view.<br />

1120 – 1220 Cerro Verde <strong>and</strong> Pascua Lama projects: integration of complex mining, water, infrastructure projects,<br />

with cross-border aspects<br />

Investment in mining projects has become a very complex <strong>and</strong> sophisticated task. The need for an integral approach to any<br />

significant project involves not only <strong>the</strong> technical, financial <strong>and</strong> legal issues that have been traditionally associated with <strong>the</strong>se<br />

investments, but now also requires a sensitive social <strong>and</strong> environmental strategy. This is related to <strong>the</strong> difficulty in obtaining<br />

water resources without affecting supplies of <strong>the</strong> local population, <strong>and</strong> <strong>the</strong> need for energy <strong>and</strong> infrastructure in areas where<br />

usually <strong>the</strong>re is none, as well as pressure to provide additional benefits to <strong>the</strong> different stakeholders in a mining project. Due<br />

to this, it is increasingly common that a mining project includes <strong>the</strong> development of water projects, electricity or o<strong>the</strong>r energy<br />

sources projects <strong>and</strong> <strong>the</strong> construction of different infrastructure (roads, ports, etc) that go beyond <strong>the</strong> specific requirements of<br />

<strong>the</strong> project. This session will present two interesting examples of this complexity: (1) <strong>the</strong> important mining operation run by<br />

Sociedad Minera Cerro Verde in Arequipa, Peru; (2) <strong>the</strong> way in which it has addressed <strong>the</strong>se different infrastructure challenges in<br />

Not in my backyard!: relations with owners <strong>and</strong> indigenous communities: how to win hearts <strong>and</strong><br />

minds?<br />

An increasing number of natural resources projects around <strong>the</strong> world are facing mounting pressure from local communities,<br />

some of <strong>the</strong>m aboriginal, located near <strong>the</strong> area of <strong>the</strong> projects. The local ever-growing dem<strong>and</strong>s range from <strong>the</strong> respect for<br />

sacred or ancient places to <strong>the</strong> creation of local jobs, environmental concerns, social issues associated with <strong>the</strong> rapid growth<br />

of <strong>the</strong>ir economic activity <strong>and</strong> immigration, as well as <strong>the</strong> purchase of materials from local suppliers. Although local political<br />

authorities ensure that <strong>the</strong>y participate in <strong>the</strong> decisions that affect <strong>the</strong>ir communities, project owners rapidly find out, to <strong>the</strong>ir<br />

dismay, that dealing just with <strong>the</strong> elected authorities is not enough. If <strong>the</strong> project company is foreign, or if <strong>the</strong>re are multiple<br />

owners, <strong>the</strong> problems get compounded as cultural <strong>and</strong> linguistic issues come in to play. The panel will address how <strong>the</strong>se<br />

situations are dealt with, involving <strong>the</strong> audience <strong>and</strong> including practical cases in <strong>the</strong>ir presentations.<br />

How to deal with disputes. What mechanisms work to prevent <strong>and</strong> resolve disputes between <strong>the</strong><br />

parties <strong>and</strong> in relation to external stakeholders?<br />

A roundtable workshop on structuring <strong>and</strong> managing effective project dispute resolution processes for complex, long-term<br />

projects.<br />

Complex, long-term projects in <strong>the</strong> infrastructure, mining <strong>and</strong> oil <strong>and</strong> gas industries present special dispute resolution challenges.<br />

These challenges can be exacerbated in ‘inter-connected’ projects by <strong>the</strong> multiple interests <strong>and</strong> jurisdictions that are brought into<br />

play. Such projects – especially those involving <strong>the</strong> construction of high-value capital assets – can generate substantial disputes<br />

that threaten <strong>the</strong> very viability of <strong>the</strong> enterprise. When it comes to dispute resolution, lawyers structuring such projects should<br />

not assume that recommending arbitration before a knowledgeable tribunal in a neutral venue is sufficient to address <strong>the</strong> issue.<br />

This session will explore best practices in project dispute resolution processes that encourage efficient dispute resolution <strong>and</strong><br />

help minimise project disruption.<br />

This historic Spanish castle is located at <strong>the</strong> top of <strong>the</strong> Santa Lucía hill, once called Huelen, a sacred place for <strong>the</strong> native<br />

population.The monument was built in 1816 by <strong>the</strong> Spanish governor Marco del Pont as a fortress. The castle later took<br />

its name from Don Manuel Hidalgo, a brave captain who died at <strong>the</strong> battle of Chacabuco during <strong>the</strong> Chilean War of<br />
