EDITORIAL<br />

Self Satisfaction not Desirable<br />

The 6th verification for recognition of non-executive<br />

unions as per BSNL's Rule, 2012 is scheduled<br />

to take place on 16th April 2013. More than 12<br />

unions have played a very positive role in framing<br />

of new rules. The BSNL employees spread in the<br />

entire country will give their mandate to identify<br />

which are the two unions which should be recognised<br />

by the administration for redressal and settlement<br />

of their grievances. The present recognised<br />

union enjoyed the majority status for last 8 years<br />

but failed to fulfill the aspirations of the workers even<br />

in wage revision and much talked and propagated<br />

promotion scheme. The majority union had been<br />

crying from house top that they will ensure wage<br />

revision to workers with 78.2% IDA fixation benefits<br />

for 5 years periodicity. But the BSNLEU leadership<br />

made an about turn and signed the wage<br />

agreement on 15-1-2010 for 10 years and without<br />

78.2% IDA fixation benefit despite of orders dt. 2-<br />

4-2009 from Govt. of India. This has brought immense<br />

and irreparable loss to the employees. The<br />

non-executive promotion policy is not at all akin to<br />

Executive Scheme. The NEPP is full of<br />

discriminations and exploitations and staff are paying<br />

heavy price for the same. The staff are denied<br />

upgradations in the name of "average entries". The<br />

RMs are attaining stagnation in upgradations and<br />

that is why it is popularly called non-executive<br />

punishment policy. What is worst and distressing<br />

today is that company is in loss for almost<br />

10,000/- crores Rs. Whereas it was in profit of more<br />

than Rs.10,000/- crores in 2004-05 during <strong>NFTE</strong>'s<br />

regime. The recognised union completely failed to<br />

Condolence resolution on: Com. O.P. Gupta’s demise<br />

The Extended National executive Meeting of <strong>NFTE</strong> BSNL at Ongole (A.P.) on 4th February, 2013<br />

Condole the demise of Com. O.P. Guptaji (08-04-1922 to 06-01-2013) who was the symbol of working<br />

class unity and the tallest leader of NFPTE and <strong>NFTE</strong>. He was the first Secretary General of<br />

<strong>NFTE</strong> who successfully led the union to victory in the first even membership verification held in 2002.<br />

He was the main force behind the 3 days nationwide strike on the eve of corporatization in 2000<br />

which ultimately safeguarded the Government pension from consolidated fund of India for lakhs of<br />

employees who had got transferred to BSNL on 01-10-2000. He was a genius and down to earth<br />

Comrade who understood the aspirations and sufferings of the lowest employees. He thought<br />

ahead of everybody and could foresee dangers and suggest proper wage and means to overcome<br />

these. He was the architect of Time bound promotions and restructuring of Cadres. He<br />

was responsible for the regularization of More than one lakh employees on 30-09-2000 on the<br />

eve of corporatization despite ban on recruitment since 1980. The extended executive records<br />

its appreciation for his untiring work during the last 60 years in the service of P & T and BSNL<br />

employees with the almost zeal and commitment. The fitting tribute to the departed leader would<br />

be to work for strengthening the <strong>NFTE</strong> BSNL and make it the first recognized union in BSNL<br />

after the 6th Membership verification. Com. O.P. Gupta will be remembered by P & T workers<br />

and BSNL employees for ever. The National executive record with proud that Com. Gupta was<br />

the only leader in the country who was jailed for 14 months of rigorous imprisonment just for<br />

signing the strike agreement in 1949. He was man of the masses and loved by even those who<br />

opposed him on some issues. His loss will be felt for ever and is not easy to fill that vacum.<br />

protect the interest of the BSNL. The BSNLEU even<br />

failed to ensure that the materials are available in<br />

the field although they were enjoying the hospitality<br />

of then Minister Shri Raja.<br />

The National Executive of <strong>NFTE</strong> BSNL met on<br />

4 and 5th February, 2013 at Ongole in these background<br />

and reviewed the issues in real perspective.<br />

The <strong>NFTE</strong> BSNL has although secured 35%<br />

votes in all the five verification but there is no<br />

place for complacency in the present scenario.<br />

We have to work hard and make sustained efforts<br />

to get Majority Status in the ensuing verification.<br />

The meeting has decided to focus many issues<br />

including settlement of 78.2% IDA fixation<br />

benefit, sufferings in NEPP, wage erosion of DR staff,<br />

Timely notification of all Deptt. Examinations and<br />

promotion etc. but top most priority will be to<br />

defeat and scuttle the attempts of DPE (BRPSE)<br />

to declare BSNL as sick PSU. It is most dangerous<br />

and has to be resisted to avoid sufferings<br />

to staff. The employees will loose everything<br />

once company is declared sick.<br />

The National Executive of <strong>NFTE</strong> has appealed<br />

to the workers not to be complacent and work hard<br />

to achieve more than 50% votes in the election<br />

scheduled to take place on 16th April to end the<br />

darkness. This is difficult task but not impossible<br />

and can attain the target with the help and cooperation<br />

of alliance partners. The <strong>NFTE</strong> will continue<br />

alliance and extend all respects and cooperation<br />

to the Unions which stood with us.<br />

RESOLUTION TO FORGE ALLIANCE :<br />

The extended National Executive Committee<br />

meeting of <strong>NFTE</strong> BSNL held at Ongole on 4th &<br />

5th February, 2013 appreciates the role of the leadership<br />

of BSNL Workers alliance for keeping the<br />

unity in tact till this date. The NEC notes that the<br />

alliance approached the issues of employees in<br />

one voice and achieved the demand of formation<br />

of separate BSNL Rules for recognizing unions,<br />

proportionate representation in Councils<br />

and Minimum Trade union facilities. The NEC<br />

desires to hold the banner of Alliance to face the<br />

6th membership verification and to meet the challenges.<br />

The NEC appeals to the leadership of<br />

Snatta and other unions of BSNL workers Alliance<br />

to strengthen the alliance and steer the alliance<br />

to attain the position of sole bargaining<br />

agent. <strong>NFTE</strong> BSNL National Executive appeals<br />

to SEWA BSNL to extend their support by forging<br />

alliance with <strong>NFTE</strong> BSNL. <strong>NFTE</strong> assures to<br />

alliance unions that their interest will be safeguarded<br />

and assures SC/ST employees that their<br />

interest will be advanced.<br />

A mammoth meeting of employees was held<br />

on 08-02-2013 at Asman Mahal in Hyderabad TD<br />

which was presided by Com Ismail Gore. Comrades<br />

(GS BSNLES), Sudhir (Snatta Circle President),<br />

Rajmouli (Secy, <strong>NFTE</strong>), Anjiah (C/S), Parsuramlu<br />

N.K. Jain) addressed the gathering.<br />

<strong>NFTE</strong> opposes new entity for broadband services<br />

Ongole: The National Federation of Telecom<br />

Employees (<strong>NFTE</strong>) President Islam Ahamad on<br />

Monday vehemently opposed the reported decision<br />

of the Bharat Sanchar Nigam Ltd.(BSNL) Board<br />

to float a separate company for broadband and<br />

leased circuit services.<br />

Chairing the <strong>NFTE</strong> extended national executive<br />

committee meeting at the Com. Om Prakash<br />

Gupta Sabhastali here, he said a major portion of<br />

the revenue generated were from the two premier<br />

services.<br />

“If these services are taken away from the BSNL,<br />

its survival will be a big question mark ,” he feared.<br />

<strong>NFTE</strong> general secretary Chandreshwar Singh<br />

gave a call to the employees to fight against the<br />

BSNL Board’s “unilateral decision” which would turn<br />

the nation's leading <strong>telecom</strong> company a sick Public<br />

Sector Unit.<br />

Deputy General Secretary C.K.Mathivanan said<br />

the Sam Pitroda Committee’s recommendation suggesting<br />

sharp reduction in existing strength of employees<br />

was hanging like a “Damocles sword.<br />

"We have to unitedly fight against the move to<br />

retire over one lakh employees under the scheme<br />

awaiting clearance from the Union government,"<br />

he added.<br />

Only through the BSNL, better tariff benefit<br />

could be reached to the common people, said its<br />

State secretary Karlapudi Anjaiah.<br />

Hindu 5-2-2013 at Ongole<br />

Private telcos oppose move to bail out BSNL, MTNL<br />

Private mobile operators have raised objections to a proposal to give financial support to Staterun<br />

<strong>telecom</strong> companies.<br />

The Department of Telecom has sought the Cabinet’s approval for a Rs 20,000-crore bailout<br />

package for Bharat Sanchar Nigam Ltd and Mahanagar Telephone Nigam Ltd. The Department proposes<br />

to waive the one-time spectrum charge and refund money for surrendered broadband spectrum.<br />

BSNL wants to surrender broadband spectrum (2300 Mhz band) in six circles including Karnataka,<br />

Kolkata, Andhra Pradesh, Gujarat and Maharashtra.<br />

If the Cabinet accepts this request, the PSU BSNL, will get a refund of Rs 6,724.51 crore.<br />

BSNL’s finances have taken a turn for the worse with its income declining from Rs 35,812 crore in<br />

2008-09 to Rs 27,934 crore in 2011-12. During this period, the company’s bottomline changed from a<br />

net profit of Rs 574 crore to a loss of Rs 8,851 crore.<br />

A Canard is being spread by BSNLEU that the<br />

78.2% IDA fixation benefit in revision of pay scale<br />

could not be clinched on 15-1-2010 in wage agreement<br />

due to betrayal of <strong>NFTE</strong>-FNTO ignoring the<br />

fact that both were not at all associated in the negotiations<br />

The wage revision of group 'C' and 'D' staff was<br />

due from 1-1-2007 and the wage committee was<br />

formed by BSNL Management in December, 2006.<br />

Nothing was done from year 2007 to 2009 i.e. upto<br />

3 years and the wage agreement was signed only<br />

on 15-1-2010 with 68.8% IDA benefit although Govt.<br />

of India ordered for 78.2% IDA fixation.<br />

Accept failure with grace<br />

Every one is aware that the BSNLEU Cried from<br />

house top to get wage revision with 78.2% IDA benefit<br />

30% fitment and for periodicity of five years. At<br />

that time also we were called as agents of Management<br />

and Govt. and now betrayal. The <strong>NFTE</strong><br />

will never call any one either as betrayer or<br />

agents of Govt. and Management. Workers are<br />

fully aware who have sacrificed their most important<br />

issue - 78.2% IDA - despite orders dt 2-<br />

4-2009 of Govt. of India.<br />

BSNLEU should accept its failure with grace and<br />

tender apology to workers for mortgaging their interest<br />

and inflicting immortal financial loss.<br />

Furnishing of information in connection<br />

with rectification of anomaly in pension<br />

of BSNL employees retired within ten<br />

months of their absorption in BSNL w.e.f.<br />

01.01.2000 - settlement requested.<br />

BSNL No. 40-27/2011-Pen (B)(Misc) to All Heads<br />

of Telecom Circles, Bharat Sanchar Nigam Ltd.<br />

A proposal for rectification of anomaly in pension<br />

of BSNL employees retired within ten months of their<br />

absorption in BSNL w.e.f. 01.10.2000 by taking into<br />

account the average emoluments on notional IDA pay<br />

for the last ten months which would have been drawn<br />

by them for the period they were drawing pay in CDA<br />

scale is under examination with DOT.<br />

2. To examine the cadre further. DOT has requested<br />

us to furnish the information on the following<br />

points.<br />

i) What are the implications for fixing pension on<br />

notional basis?<br />

ii) If option has been exercised, how can the pensioners<br />

retract on it?<br />

iii) How many such cases are there?<br />

iv) What are the monetary implications?<br />

v) Will it open of many more cases?<br />

vi) What is the basis for taking up on notional basis?<br />

3. You are therefore requested to furnish the<br />

information in consultation with circle IFA of your<br />

circle for the BSNL employees who retired between<br />

Oct. 2000 to June, 2001 from your circle in the following<br />

proforma:-<br />

This office is in receipt of grievances of a section<br />

of non-executives employees in the matter of<br />

request transfers from rural to urban areas. The<br />

grievance is that many who are transferred to rural/<br />

nonpopular stations, are not brought back to urban<br />

stations of choice after completion of two years<br />

and more leading to financial hardships and long<br />

separation from-their families.<br />

In the interest of fairness and transparency in<br />

transfer of such employees to urban stations, it is<br />

requested that the concerned officers in circle/SSAs<br />

may be advised to maintain a formal register in which<br />

date of receipt of transfer request is recorded in<br />

Chronological order for making the transfers in<br />

accordance with Transfer Policy Guidelines<br />

2. Requests have been received from some<br />

Circles. Unions as well as through National Council<br />

requesting for modifications in these instructions.<br />

The Management Committee in its 150th meeting<br />

held on 2nd November 2012 has considered the<br />

above requests and has taken a decision that.<br />

(a) Circles Head may be empowered to decide for<br />

providing free SIM with a talk time of Rs. 200/p.m.<br />

to all outdoor staff including TTAs even if<br />

the CDMA coverage is available. However utility<br />

of CDMA handsets becoming spare should<br />

be ensured, and<br />

(b) The "94" facility (which also include other BSNL<br />

Mobile levels in that SSA) with CUG within the<br />

SSA level including free roaming but without<br />

STD may be extended to all such SIM Card<br />

holders.<br />

(c) Free talk time including the free roaming with<br />

the connection shall be for ONNET calling only.<br />

The other terms and conditions will remain the<br />

same as per Circular No. 01/2011-PHA dated 16-<br />

01-2012<br />

These instructions will come into force with immediate<br />

effect.<br />

Improvement in Fixed line Fault<br />

Clearance mechanism<br />

BSNL No. 8-23/2012 -PHM Dated 17th Jan.<br />

2013 to All Chief General managers Telecom<br />

Circles/Telecom Districts BSNL<br />

It has been observed that both fault rate and<br />

fault clearance time is high in most of the Circles.<br />

Besides this, the number of repeat faults occurrence<br />

is also very high.<br />

TRAI has recently made regulation on financial<br />

disincentives on not meeting the benchmark for<br />

quality of service parameters in Basic Service. This<br />

regulation has come into effect form 1st January<br />

2013. This office letter dtd 20th November - 2012<br />

regarding this may be referred.<br />

VOTE AT<br />

SERIAL NO. 15<br />

It has also been observed that faults occurring<br />

on Sundays/holidays or on previous day thereto,<br />

are not being attended on such closed holidays.<br />

This office latter dtd 26th December- 2012 regarding<br />

this may be referred in which it was mentioned<br />

that CMD has directed to develop a mechanism for<br />

attending faults on Sunday and holidays also.<br />

To improve the quality of fault rectification and<br />

providing satisfactory services to the customers,<br />

CMD has desired that the whole fault clearance<br />

process needs to be made more efficient and effective.<br />

The root cause for both fault occurrence<br />

and delay in fault clearance needs to be addressed.<br />

The FRS module of the CDR system be utilized for<br />

this if required.<br />

Following steps may be initiated within 15 days:<br />

1. The fault clearance work needs to be extended<br />

and be ensured between 0700 Hrs to 2100 Hrs.<br />

The existing resources may be realigned and<br />

if required, the field sections may be merged.<br />

2. A mechanism should be developed that faults<br />

are attended on Sundays and holidays also.<br />

3. Regarding reducing repeat faults, it will be now<br />

mandatory that the SDE/JTO should visit on<br />

2nd time fault, DE should visit on 3rd time fault,<br />

DGM on 4th time fault and GM should visit on<br />

5th time fault occurrence on the same telephone/BB/leased<br />

line during the last 30 days<br />

period.<br />

4. Possibilities of preparation of DPS (Daily performance<br />

Sheet) may be explored & implemented<br />

to improve the efficiency of employees<br />

as being practiced in PSU Banks.<br />

A report regarding implementation of above<br />

guidelines may be sent to this office by fax and<br />

email by 15th Feb- 2013.<br />

Procedure to be followed in case of OMR<br />

based Departmental Examinations<br />

conducted, by BSNL in future.<br />

I am directed to convey the approval of competent<br />

authority to the procedure, as under, to be<br />

followed in BSNL for various OMR based departmental<br />

examinations in future:<br />

i) After the examination is successfully conducted,<br />

the Provisional Answer Key will be uploaded<br />

on respective circle’s website or BSNL’s Intranet<br />

website etc. for information of candidates.<br />

ii) All the recruiting circles have already been<br />

requested to create an e-mail address vide this office<br />

letter No.I-5/2010-R-11 dated 4.8.2010. In case<br />

of departmental examination, candidates will be<br />

permitted, preferably through their Unions/Associations,<br />

to send representations/feedback in the provisional<br />

Answer Key within 10 days on the respective<br />

e- mail address as notified at the time of<br />

uploading provisional answer key on the website.<br />

In case the number of candidates appearing in the<br />

examination is more than 1000. The representations<br />

through Union/Associations only shall be entertained<br />

in order to reduce delay in settlement of<br />

representations and to ensure that repetitive cases<br />

are not received..<br />

iii) A Committee consisting of two to three officers<br />

of appropriate level may be appointed by the<br />

competent authority to examine the provisional<br />

answer key, the feedback received from the candidates/Unions/<br />

Associations etc. and give necessary<br />

recommendations.<br />

iv) The Answer Key shall be finalized by BSNL<br />

Corporate Office/concerned Circle, as the case may<br />

be, based on the recommendations of the Committee<br />

and the comments of the Paper Setter. The answer<br />

key thus finalized should be used for evaluation<br />

of OMR answer sheets. The final answer key may be<br />

uploaded on the website after declaration of result.<br />

v) In case OMR answer sheets are evaluated<br />

with the help of scanners and machine, upto 10% of<br />

the OMR Answer Sheets (minimum of 10 and maximum<br />

of 50 Answer Sheets), especially the boundary<br />

line cases where the marks secured are around the<br />

minimum qualifying marks, will be checked manually<br />

by a Committee of two to three officers of appropriate<br />

level set up by the competent authority. In case<br />

of any error in evaluation the committee- may check<br />

up even 100% of the result manually.<br />

vi) In case manual evaluation of OMR Answer<br />

sheets is adopted, the circles are at liberty to utilize<br />

services of JAG level officers of their own circle<br />

or adjoining circles. It may please be ensured that<br />

no officer from HR/Rectt/Admn/Estt. Wing of own<br />

circle is nominated for evaluation purpose. In such<br />

cases, the evaluation of OMR answer sheets and its<br />

cross checking should be done at the premises of<br />

the circle office itself. Every possible care should be<br />

taken to maintain secrecy during evaluation work.<br />

vii) In case any error is reported/detected/noticed<br />

with 15 days of declaration of result the same<br />

shall be corrected immediately by the department.<br />

No error in result after 15 days of declaration of<br />

result shall be entertained by the department under<br />

any circumstances.<br />

2. The above procedure shall be implemented<br />

with immediate effect.<br />

BSNL Recognition Rules of Non-<br />

Executives' Unions and Representation<br />

in the Councils Rules, 2012- regarding<br />

<strong>NFTE</strong> BSNL letter No. TF-1/1 (H) dated nil<br />

January, 2013<br />

This has reference to <strong>NFTE</strong> BSNL letter referred<br />

to above on the subject matter under which the<br />

union has raised certain issues and requested for<br />

consideration of the same.<br />

2. At the outset, the union has suggested for<br />

the facility of immunity in transfer to atleast two office<br />

bearers of such unions which secure 2% or<br />

more votes in the verification. You would appreciate<br />

that for grant of the facility of immunity form<br />

transfer to a union with merely 2% votest is too low<br />

and not justified.<br />

3. As regards the demand that the recognised<br />

unions should be treated at par in respect of all<br />

facilities, there is hardly any need to mention that<br />

the Rules already envisage parity/status at equal<br />

footing for all the recognised unions for all purposes,<br />

i.e. negotiations/agreements/deliberations.<br />

4. With reference to the next suggestion that<br />

decisions on issues in the Council meetings should<br />

be on the basis of unanimity in Staff side. In the<br />

regard, it is pointed out that developing unanimity<br />

on the issues would be internal affair of the Staff<br />

side. For the management, the entire Staff side comprising<br />

two or more unions is one collective body.<br />

5. On the issue of office accommodation, it is<br />

mentioned that the present statuesque shall continue<br />

and the position will be reviewed as and when<br />

required.<br />

This is in continuation of this office letter of even<br />

number dated 4th January, 2013 regarding preparation<br />

of revised electoral rolls for election of majority<br />

representative union(s) of non-executive employees<br />

2. In pursuance of the practice followed in the<br />

previous membership verifications, the following<br />

Schedule for finalization of electoral rolls has been<br />

decided :-<br />

(a) The revised electoral rolls may be displayed<br />

by 13.2.2013 and also a copy provided to the representatives<br />

of the participating unions at SSA /<br />

Unit HQrs. level to submit their objections, if an<br />

latest by 15.2.2013. The SSA/Unit level representatives<br />

shall be nominated the Circle Secretaries<br />

or General Secretary /Secretary General, as<br />

the case may be, and the Circle representatives<br />

shall be nominated by respective General Secretary/Secretary<br />

General.<br />

(b) In case no objections are received by the<br />

stipulated date, it will be presumed that the Union(s)<br />

is/ are not having any objection on the electoral<br />

rolls provided to them.<br />

(c) The concerned local authority shall finalize<br />

revision of electoral rolls, after addressing the objections<br />

received from unions, if any, by 20.2.2013.<br />

(d) The Circles shall provide a copy of the revised<br />

electoral rolls to the union representatives and<br />

advise them to submit No objection on the revised<br />

electoral roll by 22.2.2013. In case, no response is<br />

received by the due date from any union, it will be<br />

presumed that the concerned union is not having<br />

any objection on the revised electoral roll. However,<br />

in case any objections are received, the same shall<br />

be suitably addressed and final voters’ lists prepared<br />

by 26.2.2013.<br />

(e) The Circles shall display the final voter lists<br />

by 28.2.2013 and simultaneously communicate a<br />

list indicating the final number of voters in a Circle,<br />

with SSA- wise break-up, to this office.<br />

3. The field units may review the number of<br />

polling booths in the SSAs and communicate the<br />

precise number to Corporate Office along with the<br />

final number of voters in a Circle by 28.2.2013 so<br />

that the Election Commission could be timely contacted<br />

for supply of ballot boxes.<br />

4. You are requested to kindly ensure that the<br />

instructions contained in the preceding paragraphs<br />

2. Coronary Stents shall be permitted on the<br />

advice of Govt. Specialist, of which not more than<br />

two shall be of Drug Eluting Stents. Permission shall<br />

be granted as per the laid down procedure.<br />

If more than two drug eluting stents are implanted<br />

in an empanelled hospital and no written<br />

informed consent was obtained from the beneficiary<br />

that he/she would bear the difference in cost<br />

between the DES and Bare Metal Stent, and the<br />

hospital has charged this amount from the beneficiary,<br />

the additional amount shall be deducted from<br />

the pending bills of hospitals and shall be paid to<br />

the beneficiary<br />

3. It is essential for the empanelled hospitals<br />

to quote the Batch number when a coronary/ vascular<br />

stent of any type is implanted in the case of<br />

a CGHS/CS (MA) beneficiary and also enclose a<br />

copy of the relevant invoices pertaining to the<br />

procurement of the stents by the hospitals. In addition<br />

to this, the outer pouch of the Stent packet<br />

along with the sticker on it on which details of the<br />

stent are printed shall also be enclosed with the<br />

medical bill for claiming reimbursement from the<br />

Govt. In case of treatment from a private non-empanelled<br />

hospital, where the treatment was taken<br />

in an emergency, it is the responsibility of the beneficiary<br />

to obtain the batch number, invoice and outer<br />

pouches of the stent(s) before the submission of<br />

the medical claim to CGHS/ concerned department,<br />

as the case may be.<br />

4. The empanelled hospital shall submit a self<br />

certified undertaking that the hospital has not<br />

charged the CGHS / CS(MA) beneficiary more than<br />

the rate at which the stent has been procured by the<br />

hospital and incase of any detection and establishment<br />

that the hospital has overcharged the hospital<br />

shall be removed from the list of hospitals empanelled<br />

under CGHS without any further notice.<br />

5. UTI-TSL, while processing the hospital bills<br />

of coronary/vascular stents shall ensure that the<br />

hospitals have enclosed copies of the relevant invoices<br />

pertaining to the procurement of the stents<br />

by the hospitals and the outer pouch of the Stent<br />

packet along with the sticker on it on which details<br />

of the stent are printed and that the prescribed rates<br />

and the guidelines have been followed, before<br />

making provisional payments to the hospitals.<br />

6. The revised rates and guidelines shall come<br />

into force from the date of issue and shall be in<br />

force for a period of one year or till they are revised,<br />

whichever may be earlier.<br />

7. This issues with the concurrence of Finance<br />

Division vide Dy.No. 2979 dated 20.10.2011 of the<br />

office of AS&FA , Min. of H&FW.<br />

We have come to know that the Broad Band<br />

Limited (BBL) has come into existence and presently<br />

it is under administrative control of Administrator,<br />

USO Fund. It is also learnt that the Broad<br />

Band services and leased lines will be transferred<br />

to BBL. If it so the BSNL will become almost orphan.<br />

We feel it is high time that the BSNL management<br />

should interact with the unions so that the<br />

realities are known. It is also not known if revenues<br />

earned by BBL will come to BSNL or will go elsewhere.<br />

We, therefore, impress upon you to advise the<br />

Director HR/GM(SR) to hold meeting with unions<br />

on the issue so that the pros and cons could be<br />

properly known.<br />

Kindly refer to our earlier communication regarding<br />

settlement of the above demand.<br />

You will please recall that an agreement was<br />

arrived at and signed on 12-06-2012 between BSNL<br />

management and unions for extension of 78.2%<br />

IDA fixation benefit to BSNL staff. Sequel to the<br />

clearance by the Board the proposal was sent to<br />

the Administrative Ministry, DOT, for its approval.<br />

We are extremely sorry to state that the DOT is<br />

making quarries after quarries causing deep frustration<br />

and anguish amongst the employees as<br />

BSNL is the only PSU where staff were denied 78.2%<br />

fixation benefit in wage agreement signed on 15-01-<br />

2010 between recognized union and BSNL management.<br />

The agreement dt-12-06-2012 was obviously<br />

to correct the mistake which took place on 15-01-<br />

2010 despite availability of Govt. of India orders of<br />

2nd April, 2009 for 78.2% IDA benefit.<br />

According to information the DOT has again<br />

sought clarification on some points. Our President,<br />

Shri Islam Ahmad, met and apprised you about the<br />

present situation and impressed upon for expeditious<br />

reply to the DOT to avoid delay in settlement.<br />

We are mentioning below the following points for<br />

consideration.<br />

(1) The <strong>NFTE</strong> is one of the signatories of agreement<br />

of dt-12-06-2012 which is basically for correction<br />

for neutratisation of IDA amounting to 78.2%<br />

as per OPE order dt. 2nd April, 2009.<br />

(2) There will be no change in pay scales although<br />

it is quite likely that some employees may<br />

get .stagnation stage much earlier than expected.<br />

(3) The burden of arrears payment is deferred<br />

and it will be considered only when the PSU attains<br />

sound financial health. Thus the BSNL will<br />

not face huge financial burden as propagated.<br />

Moreover the unions have also agreed in agreement<br />

of 12-06-2012 for savings on some other items<br />

for time being.<br />

(4) There will be some financial burden on DOT<br />

due to enhanced pension. But the DOT has to discharge<br />

its social responsibility. Moreover, the BSNL<br />

has remitted and is depositing also the Pension<br />

contribution in respect of staff including of retired<br />

personnel.<br />

(5) The 78.2% IDA merger (50% IDA merger)<br />

and 30% fitment both are settled issues as per DPE<br />

guidelines. There has been affordability also due<br />

to which 30% fitment in fixation was extended to<br />

the staff. The BSNL’s affordability was well established<br />

on the basis of 2007-08 PBT which was the<br />

criteria fixed by DPE. We very strongly feel that the<br />

subsequent year criteria cannot be evolved at this<br />

stage.<br />

(6) The BSNL cannot be categorized as a sick<br />

company by any criteria and standard.<br />

We, therefore, request you to please look into<br />

the matter so that the reply is sent to the quarries<br />

made by DOT. We will also request you to use your<br />

good offices to impress upon the DOT to cause early<br />

settlement of the matter as BSNL staff can neither<br />

be discriminated nor denied 78.2% IDA fixation<br />

benefit.<br />

Maintenance of Request Register and<br />

repatriation of employees from rural to<br />

Urban areas.<br />

24-01-2013 orders have been issued for maintenance<br />

of Request Register for repatriation of staff<br />

who are serving in rural side for a very long period.<br />

This is correct step in right direction to curb malpractices<br />

and exploitation of staff at the hands of<br />

vested interest.<br />

However, we are surprised to note that nothing<br />

is mentioned to the effect how long the employees<br />

are required to serve in the rural sector and be away<br />

from their families. After all the officials serving in<br />

the rural and remote areas are the sons/daughters<br />

of the same soil to which others belong and don't<br />

expect atleast blatant discrimination and neglects.<br />

We firmly hold the view that they are not required<br />

to work in rural, places till their retirement or death.<br />

There should be some mechanism for their repatriation<br />

after their request and definite period in the<br />

analogy of executives. We feel that the matter<br />

needs dispassionate consideration.<br />

We, therefore, entreat upon you to kindly consider<br />

the plight of the workers stationed in the rural/remote<br />

places and fixed definite and reasonable<br />

period for their repatriation from rural sector<br />

as per their request.<br />

<strong>NFTE</strong> Marching ahead with determination<br />

16. One time upgradation of all qualified (TTAs) and officiating as JTO against their own posts and<br />

extension of FR 22 (1) (a) (I) benefit in officiating.<br />

17. One time upgradaion of all qualified and trained RMs as Telecom Mechanic along with their posts.<br />

18. Modification in recruitment rules of JTO<br />

35% quota – 5 years of service for eligibility.<br />

15% quota – i) BSC qualification be withdrawn (ii) five years of service for eligibility.<br />

TTA – a) Screening Test instead of LDCE<br />
