8. Compact ad reparacionem at sustentacionem predictorum molendinorum<br />
neglected by faciendorum, dicunt quod sepius eos monuer<strong>it</strong>, quoniam hos omnino<br />
the Town, facere recusarunt. Questio si predicti burgenses unquam prefatos<br />
1280. abbatem et conventum monuerunt ad reparacionem et sustentacionem<br />
predictorum molendinorum pro porcione ipsis contingente, dicunt<br />
quod non. Questio cujusmodi molendina sunt ilia xij molendina<br />
que prefati burgenses levaverunt, dicunt quod molendina cum rotis<br />
et similibus aliis instrumentis ad molendinum pertinentibus et que<br />
molere possunt viginti quarteria bladi nocte et die ut intelligunt.<br />
Ideo consideratum est quod predicta tria molendina reparentur<br />
et releventur sumptibus predictorum burgensium : et cum reparata<br />
et relevata fuerint sumptibus utrorumque abbatis et conventus et<br />
predictorum burgensium sustententur juxta formam composicionis<br />
predicte : et quod predicta duodecim molendina per prefatos burgenses<br />
levata sumptibus predictorum burgensium per vicecom<strong>it</strong>em<br />
prosternantur et prostrata permaneant. Et quo ad dampnorum, &c.,<br />
dies datus, &c., in tres septimanas, &c., quo ad audiendum<br />
judicium, &c.<br />
The jury find upon oath that three horse-mills and one windmill<br />
[in the town] are broken and prostrate by reason <strong>of</strong> the default <strong>of</strong><br />
the commonalty regarding their maintenance and repair, and not by<br />
default <strong>of</strong> the abbot and convent. Of the fourth mill they say they<br />
are entirely ignorant where <strong>it</strong>s s<strong>it</strong>e may have been, and they have<br />
had no evidence on the point. Three <strong>of</strong> the aforesaid mills are now<br />
rehabil<strong>it</strong>ated by the burgesses, and they take the pr<strong>of</strong><strong>it</strong>s therefrom.<br />
Also the burgesses have erected twelve mills in the town <strong>of</strong> Shrewsbury<br />
contrary to the terms <strong>of</strong> the compact and to the damage <strong>of</strong> the<br />
abbot and convent to the amount <strong>of</strong> ;2^3oo.<br />
Questioned if the abbot had ever admonished the burgesses to<br />
attend to the maintenance and repair <strong>of</strong> the mills, the jury say that<br />
he frequently did so, but they all refused to do <strong>it</strong>. Questioned if the<br />
burgesses had ever admonished the abbot and convent respecting<br />
their share <strong>of</strong> the maintenance and repair, they find that they did<br />
not. Questioned what manner <strong>of</strong> mills are those twelve which<br />
the burgesses have erected, the jury say that they are mills w<strong>it</strong>h<br />
wheels and similar other instruments appropriate to mills ;<br />
and that,<br />
night and day, they could grind twenty quarters <strong>of</strong> grain, as they<br />
understood.<br />
Therefore the decision [<strong>of</strong> the Court] is that the three mills should<br />
be repaired and restored at the cost <strong>of</strong> the burgesses, and when<br />
repaired and restored should be maintained at the common cost <strong>of</strong><br />
the burgesses and the abbot, according to the tenor <strong>of</strong> the aforesaid<br />
should be<br />
compact ; also that the twelve mills erected by burgesses<br />
pulled down by the sheriff at their cost, and should permanently<br />
remain prostrate. The question <strong>of</strong> damages as may be decided at<br />
a further hearing by the Court in three weeks' time.
