colorably to suppresse and pull down all other horse milnes wth'' the<br />
said town, but beinge (as theis defts thinke) bothe as lawful to be<br />
kept uppon and maintained as the horse milne <strong>of</strong> the said W"" More<br />
and also as necessary and p'f<strong>it</strong>able for the saide towne, hopinge<br />

In respecte wher<strong>of</strong> the saide defts humbly besecheth this honorable<br />
courte to have consideracon <strong>of</strong> the p'misses and to take suche<br />
order both in regarde <strong>of</strong> the necess<strong>it</strong>ie <strong>of</strong> the said towne and the<br />
extrem<strong>it</strong>ies the inhab<strong>it</strong>antes are some times dryven unto for want <strong>of</strong><br />
water milnes, as also for the better servinge <strong>of</strong> her Mt'^^ <strong>of</strong>ficers and<br />
forces at their repaire th<strong>it</strong>her, that the horse milnes nowe in the<br />
ocupacon <strong>of</strong> these defts being verie necessarie and a gret ease to<br />
the saide towne maie be kept upp and used and that the said defts<br />

maie have the alowance <strong>of</strong> the use ther<strong>of</strong> by thorder <strong>of</strong> this<br />

W<strong>it</strong>hout—<br />
[they deny] that all inhab<strong>it</strong>ants <strong>of</strong> Lyverpoole by all the<br />
tyme wher<strong>of</strong> the memory <strong>of</strong> man is not to be contrary have used<br />
and <strong>of</strong> right ought to grind all their <strong>corn</strong>e and malte spent in their<br />
sevrall houses in Lyverpoole at her Mt'^' milnes <strong>of</strong> Lyverpoole called<br />
Easteham Milne and Townsend Milne to the knowledge <strong>of</strong> theis<br />
defts : And w<strong>it</strong>hout— theis defts or e<strong>it</strong>her <strong>of</strong> them doe not usuallie<br />
grinde in their sevrall horse milnes any graine but onlie malt. And<br />
w<strong>it</strong>hout— that by reason <strong>of</strong> theis defts horse milnes her Mt'*^ said<br />
twoe windemilnes in Leverpoole are so hindered as her Mt^ farmor<br />
ys not able to paie the rent reserved to her Mat'^ for the same, but<br />
theis defts saie that if the said defts maie be her Mf^^ farmors <strong>of</strong> the •<br />
said Estham Mylne and Townsend Milne they will put in sufficiente<br />
suerties to aunswere her Mt'^^ Rent for the same in the encrease and<br />
for the necess<strong>it</strong>ie and beho<strong>of</strong>e <strong>of</strong> the towne, and not onelie allow the<br />
saide Mr. Crosse his Auncient Winde Milne but the said W More<br />
his horse milne and two other horse milnes w<strong>it</strong>h'' the saide towne<br />
and as manie more as this honorable Courte shall think requis<strong>it</strong>.<br />
