against Dennison, and his defence, are the most 29. Buying"<br />

interesting <strong>of</strong> the series. The bill formulated against Ground Malt,<br />

him stated that since the order <strong>of</strong> May 13, viz.<br />

between the 20th and 25th <strong>of</strong> May, he had ground<br />

two brewings <strong>of</strong> malt, containing forty-eight measures<br />

each, at Edwards' mill at Boughton. Against this<br />

practice <strong>it</strong> was pleaded that the buying <strong>of</strong> ground malt<br />

was fraudulent and a breach <strong>of</strong> the order <strong>of</strong> the Court<br />

<strong>of</strong> May 13. Richard Gough would testify that on<br />

May 24<br />

he saw six <strong>of</strong> Dennison's sacks <strong>of</strong> malt at<br />

Edwards' mill, and w<strong>it</strong>nessed them carried the same<br />

night to Dennison's house. William Culcheth would<br />

prove that he had several times tried to serve the<br />

order <strong>of</strong> the Court <strong>of</strong> May 13 upon Dennison at his<br />

house, but could never see him, and finally read a<br />

copy in the presence<br />

<strong>of</strong> Dennison's brother and ser-<br />

vants. As regarded Tyrer, <strong>it</strong> would be proved that<br />

he was ''a malt-maker, but hath no mylne to grind<br />

the same : upon which made the fraud more apparent<br />

and inexcusable in that he should grind his .malt at<br />

another mill and afterwards contract for the sale <strong>of</strong> <strong>it</strong>."<br />

As regarded Dickenson, <strong>it</strong> would be shown that after<br />

the order <strong>of</strong> May 13 he did contract and contribute<br />

moneys w<strong>it</strong>h other <strong>of</strong> the defendants to Edwards,<br />

miller <strong>of</strong> Boughton, for him to solic<strong>it</strong> a lawyer to help<br />

them, that they might be at liberty to grind where<br />

they pleased.<br />

On June 14, 1637, the defendants appeared for<br />

examination in the Chester Exchequer before Robert<br />

Gregg, examiner <strong>of</strong> the same court ; whose signed<br />

report <strong>of</strong> the depos<strong>it</strong>ions <strong>of</strong> the defendants concludes<br />

w<strong>it</strong>h the significant remark, ''The defendants are HarL MSS.,<br />

resolved to stand out against the complainant, and ^^ ^* "^<br />

to free themselves if they can from being tyed and
