Justification of FY 2013 Programmatic Changes<br />

The FY 2013 budget request for <strong>National</strong> Native American Graves Protection and Repatriation Act Grants<br />

is $1,747,000, with no program changes from FY 2012 Enacted.<br />

Program Overview<br />

The Native American Graves Protection and Repatriation Act (NAGPRA) was enacted on November 16,<br />

1990, to address the rights of lineal descendents, Indian Tribes, and Native Hawaiian organizations to<br />

Native American cultural items, including human remains, funerary objects, sacred objects, and objects of<br />

cultural patrimony.<br />

The Native American Graves Protection and Repatriation Program annually awards approximately $1.8<br />

million in grants to museums, Tribes, and Native Hawaiian organizations under the provisions of 25<br />

U.S.C. 3008. From FY 1994 to FY 2011, the NAGPRA grant program has awarded a total of 703 grants<br />

totaling $36.54 million.<br />

The grants fund museum and Tribal projects for consultation and identification, leading to repatriation;<br />

including costs of transfer of possession from museums and agencies to Tribes.<br />

FY 2013 Program Performance<br />

• Review competitive consultation and documentation grant applications from Tribes and<br />

museums, and fund the maximum number of grants as prioritized by the grants panel.<br />

• Award grants to fund repatriation requests for the transfer of possession of Native American<br />

human remains and NAGPRA cultural items from museums and Federal agencies to Native<br />

American Tribes and Native Hawaiian organizations.<br />
