<strong>The</strong> assistant employees who are appointed by the courts lack basic legal knowledge and this has<br />

an impact in the justice dispensing process. Universities have closed down the certificate level for<br />

law students and for an assistant employee to be qualified for the judicial service is required to<br />

possess a certificate in any discipline which has created some problems and the judiciary has<br />

taken note of this situation. Where the services and facilities for employees involved in the<br />

campaign of dispensing justice is not sufficient, tends to lower their morale. Majority of the<br />

assistant employees have opined and expressed for enactment of an umbrella Act for addressing<br />

the judicial manpower and distribution of services and facilities. Provided, this is not sufficiently<br />

addressed may have a negative effect on the implementation of the strategic plan and the judiciary<br />

should remain alert in this regard.<br />

4.1.4 Development of physical infrastructure<br />

Physical Resources<br />

<strong>The</strong> judiciary shall have to manage land and buildings for 101 judicial bodies including the<br />

following courts: <strong>Supreme</strong> <strong>Court</strong> -1, Appellate <strong>Court</strong> – 16, District <strong>Court</strong> – 75, Administrative <strong>Court</strong><br />

– 1, Special <strong>Court</strong> – 1, Labor <strong>Court</strong> – 1, and other tribunals. Detailed description of land and<br />

building including resident of each court has been provided in Annex 4 and 5. 108<br />

Situation of Land<br />

<strong>Supreme</strong> <strong>Court</strong> as of this date has not been able to obtain land pursuant to the prescribed<br />

standard. <strong>The</strong> number of cases at the <strong>Supreme</strong> <strong>Court</strong>, judges and number of employees and<br />

description of land has been provided in Annex 4 (a).<br />

Four Appellate <strong>Court</strong>s have received land pursuant to the prescribed standard for office building<br />

and residence whereas 12 Appellate <strong>Court</strong>s have not received land pursuant to the prescribed<br />

standard. Appellate and District <strong>Court</strong>s of Ilam, Baglung and Jumla are located within the same<br />

building. It is necessary to manage land pursuant to the prescribed standard for 12 Appellate<br />

<strong>Court</strong>s. <strong>The</strong> number of cases at the Appellate <strong>Court</strong>s, judges and number of employees and<br />

description of land pursuant to the prescribed standard has been provided in Annex 4 (b).<br />

35 District <strong>Court</strong>s have received land pursuant to the prescribed standard for office building and<br />

residence whereas 44 District <strong>Court</strong>s have not received land pursuant to the prescribed standard.<br />

From among the available land, the land of 31 District <strong>Court</strong>s are scattered within 2 to 10 plots of<br />

land. Land of Baglung, Jumla and Ilam District <strong>Court</strong> are jointly registered in the name of the<br />

Appellate <strong>Court</strong>s, whereas land for Dhanusha District <strong>Court</strong> is under the ownership of a Trust.<br />

Land for Kathmandu and Bhaktapur District <strong>Court</strong> is merely under their possession. Some of the<br />

land registered in the name of Makwanpur District <strong>Court</strong> falls in Bhimphedi and likewise some of<br />

the land registered in the name of Ramechhap District <strong>Court</strong> falls in Ramechhap market. Although,<br />

land pursuant to the prescribed standards have been available for the District <strong>Court</strong>s, it is<br />

necessary to manage the land that is scattered in different plots and places and it is deemed<br />

necessary to purchase land pursuant to the prescribed standard for office and residence. <strong>The</strong><br />
