have been <strong>in</strong>vestigat<strong>in</strong>g nurs<strong>in</strong>g homes <strong>in</strong> the State of New York, and we have
reason to believe that our client may be <strong>in</strong>cluded among the subjects of <strong>in</strong>vestigation.
Accord<strong>in</strong>gly, while our client desires to cooperate with the subcommittee <strong>in</strong>
connection with its hear<strong>in</strong>gs, he is reluctant to take steps that would jeopardize
his constitutional rights should he later be a respondent <strong>in</strong> a proceed<strong>in</strong>g <strong>in</strong>itiated
by one or more of the State agencies.
We believe it to be both necessary and appropriate that Mr. Sigety be given
satisfactory assurances (a) that any documents produced to the subcommittee
will be held <strong>in</strong> complete confidence and (b) that any such production of documents
will not be deemed to be a waiver of his constitutional rights. I would appreciate
it if you would telephone me at your earliest convenience so that we may discuss
the possibility of fashion<strong>in</strong>g appropriate safeguards.
