The <str<strong>on</strong>g>in</str<strong>on</strong>g>vestigati<strong>on</strong> should also <str<strong>on</strong>g>in</str<strong>on</strong>g>clude a full scale study and audit of the cha<str<strong>on</strong>g>in</str<strong>on</strong>g><br />

nurs<str<strong>on</strong>g>in</str<strong>on</strong>g>g home operati<strong>on</strong>s, particularly those that have been created s<str<strong>on</strong>g>in</str<strong>on</strong>g>ce the<br />

advent of the Medicaid program. Every effort should be made to uncover how<br />

nurs<str<strong>on</strong>g>in</str<strong>on</strong>g>g homes <str<strong>on</strong>g>in</str<strong>on</strong>g> States with low, flat-rate Medicaid reimbursement manage to<br />

make a profit. 1)o they reduce the patient care budget, or do they make m<strong>on</strong>ey<br />

through deal<str<strong>on</strong>g>in</str<strong>on</strong>g>gs with affiliated real estate and c<strong>on</strong>structi<strong>on</strong> companies or suppliers<br />

as is often alleged?<br />

The f<str<strong>on</strong>g>in</str<strong>on</strong>g>ancial side of the nurs<str<strong>on</strong>g>in</str<strong>on</strong>g>g home <str<strong>on</strong>g>in</str<strong>on</strong>g>dustry has been ignored by the State<br />

and Federal Medicaid programs. We are sure that a study such as we have<br />

suggested will not <strong>on</strong>ly result <str<strong>on</strong>g>in</str<strong>on</strong>g> a sav<str<strong>on</strong>g>in</str<strong>on</strong>g>g of Medicaid m<strong>on</strong>ey that is now be<str<strong>on</strong>g>in</str<strong>on</strong>g>g<br />

diverted <str<strong>on</strong>g>in</str<strong>on</strong>g>to illicit profits, but will also enable HEW to devise mechanisms to<br />

assure better patient care.<br />

sitt<str<strong>on</strong>g>in</str<strong>on</strong>g>g this morn<str<strong>on</strong>g>in</str<strong>on</strong>g>g with the panel.<br />

This is an official acti<strong>on</strong> of the <str<strong>on</strong>g>Senate</str<strong>on</strong>g> committee, but we do often<br />

<str<strong>on</strong>g>in</str<strong>on</strong>g>vite people who are <str<strong>on</strong>g>in</str<strong>on</strong>g>terested <str<strong>on</strong>g>in</str<strong>on</strong>g> the work that we are do<str<strong>on</strong>g>in</str<strong>on</strong>g>g, to<br />

sit here and listen to the witnesses, and Mr. Ste<str<strong>on</strong>g>in</str<strong>on</strong>g> has d<strong>on</strong>e a great<br />

job <str<strong>on</strong>g>in</str<strong>on</strong>g> the State of New York, expos<str<strong>on</strong>g>in</str<strong>on</strong>g>g many of these deficiencies<br />

that we are go<str<strong>on</strong>g>in</str<strong>on</strong>g>g to be talk<str<strong>on</strong>g>in</str<strong>on</strong>g>g about, and I am pleased to have him<br />

with us this morn<str<strong>on</strong>g>in</str<strong>on</strong>g>g.<br />

We are pleased to have you, Mr. Ste<str<strong>on</strong>g>in</str<strong>on</strong>g>.<br />

In preparati<strong>on</strong> for this hear<str<strong>on</strong>g>in</str<strong>on</strong>g>g, because we have had such a great<br />

difficulty <str<strong>on</strong>g>in</str<strong>on</strong>g> ever gett<str<strong>on</strong>g>in</str<strong>on</strong>g>g the records of nurs<str<strong>on</strong>g>in</str<strong>on</strong>g>g homes, we issued some<br />

45 subpenas to nurs<str<strong>on</strong>g>in</str<strong>on</strong>g>g homes <str<strong>on</strong>g>in</str<strong>on</strong>g> New York for their records, the<br />

subpenas have been served <strong>on</strong> various <strong>on</strong>es of the nurs<str<strong>on</strong>g>in</str<strong>on</strong>g>g homes, and<br />

resp<strong>on</strong>se has been made to the subpenas.<br />

Mr. Val Halamandaris, who is Counsel to the <str<strong>on</strong>g>Special</str<strong>on</strong>g> <str<strong>on</strong>g>Committee</str<strong>on</strong>g><br />

<strong>on</strong> Ag<str<strong>on</strong>g>in</str<strong>on</strong>g>g, and who works with this subcommittee, will now call the<br />

roll, and <str<strong>on</strong>g>in</str<strong>on</strong>g>dicate what records have been submitted and are here.<br />

The magnitude of the nurs<str<strong>on</strong>g>in</str<strong>on</strong>g>g home <str<strong>on</strong>g>in</str<strong>on</strong>g>dustry <str<strong>on</strong>g>in</str<strong>on</strong>g> New York is stagger<str<strong>on</strong>g>in</str<strong>on</strong>g>g.<br />

Last year medicaid reimbursements ran over $1/2 billi<strong>on</strong> to<br />

proprietary nurs<str<strong>on</strong>g>in</str<strong>on</strong>g>g homes.<br />

Over 92 percent of the 70,000 elderly citizens of this State now<br />

resid<str<strong>on</strong>g>in</str<strong>on</strong>g>g <str<strong>on</strong>g>in</str<strong>on</strong>g> nurs<str<strong>on</strong>g>in</str<strong>on</strong>g>g homes are supported by medicaid, a comb<str<strong>on</strong>g>in</str<strong>on</strong>g>ati<strong>on</strong><br />

of Federal, State, and local funds.
