Congressman KOCH. And do I understand that after you were so
advised, that from that po<strong>in</strong>t on, advanced notice had to be given to a
nurs<strong>in</strong>g home before you would go and make your <strong>in</strong>spection?
MS. JARVIS. Yes.
Congressman KocHx. Let me ask you this. Did you f<strong>in</strong>d any difference
between the <strong>in</strong>spections that came as a result of the announced visit,
or those that came as a result of an unannounced visit prior to the
change <strong>in</strong> the directive?
MS. JARVIS. Let me put it this way, although we were supposed to
announce our visits, very few of them were announced.
Senator Moss. Thank you very much.

The next witness will be Dr. Bernard Bergman. Is Dr. Bergman

Mr. STEIN-. Mr. Chairman, although as you said, there is noth<strong>in</strong>g
at all wrong and improper about my presence up here, s<strong>in</strong>ce this is a
duly-authorized <strong>Senate</strong> hear<strong>in</strong>g, and I have been k<strong>in</strong>dly <strong>in</strong>vited by
you, as a participant of the State of New York, and I am a member
of the commission, even though there is noth<strong>in</strong>g wrong, if. it would
make Dr. Bergman more comfortable and more will<strong>in</strong>g to talk about
these problems, I would be happy to get off the stand.
Dr. BERGMAN. I personally have no objection, Mr. Chairman.
Senator Moss. Your counsel thought you would object.
Dr. BERGMAN. I have no objection.
Mr. SEIDM3AN. Might I note for the record that my name is Irv<strong>in</strong>g
P. Seidman, and together with Mr. Lew<strong>in</strong>, counsel for Dr. Bergman,
before this august <strong>Senate</strong> committee.
Senator Moss. We are glad to have you here. Dr. Bergman, Counsel,
and Mir. Lew<strong>in</strong> appeared earlier, and we are glad he is here, Dr. Bergman,
we are glad to have you here before the committee.
As you know, Dr. Bergman, we are <strong>in</strong>quir<strong>in</strong>g <strong>in</strong>to the nurs<strong>in</strong>g home
situation (renerallv, <strong>in</strong> the State of New York, and your name has
come up a number of times, and we would like to have any statement
that you want to give us, and then we may want to ask you some
questions.
