be called to testify under oath. These are serious proceed<str<strong>on</strong>g>in</str<strong>on</strong>g>gs which<br />
have profound effects <strong>on</strong> many lives.<br />
I want to make very clear that as chairman of this subcommittee I<br />
will do everyth<str<strong>on</strong>g>in</str<strong>on</strong>g>g <str<strong>on</strong>g>in</str<strong>on</strong>g> my power to preserve the c<strong>on</strong>stituti<strong>on</strong>al rights<br />
of witnesses. Several witnesses have written and asserted that a sort<br />
of lynchl-mob atmosphere prevails here <str<strong>on</strong>g>in</str<strong>on</strong>g> New York, and they ask<br />
to be excused from testify<str<strong>on</strong>g>in</str<strong>on</strong>g>g publicly. I have <str<strong>on</strong>g>in</str<strong>on</strong>g>sisted that all hear<str<strong>on</strong>g>in</str<strong>on</strong>g>gs<br />
be open. I have great faith <str<strong>on</strong>g>in</str<strong>on</strong>g> the American public. I believe that<br />
the public has the right to know the truth.<br />
I also have great faith <str<strong>on</strong>g>in</str<strong>on</strong>g> the media to treat every<strong>on</strong>e fairly. However,<br />
I feel operators have a legitimate compla<str<strong>on</strong>g>in</str<strong>on</strong>g>t <str<strong>on</strong>g>in</str<strong>on</strong>g> at least <strong>on</strong>e<br />
respect.<br />
As the allegati<strong>on</strong>s of abuse have arisen, there has been a tendency<br />
to generalize that all nurs<str<strong>on</strong>g>in</str<strong>on</strong>g>g home operators are corrupt profiteers<br />
who offer poor care. This is not true. Just as the generalizati<strong>on</strong> dur<str<strong>on</strong>g>in</str<strong>on</strong>g>g<br />
Watergate that because some politicians were corrupt, was untrue.<br />
I would like to c<strong>on</strong>clude <strong>on</strong> what might be c<strong>on</strong>sidered a pers<strong>on</strong>al<br />
note. I, perhaps more than any<strong>on</strong>e else, am tired of the slow progress<br />
or no progress <str<strong>on</strong>g>in</str<strong>on</strong>g> this field.<br />
For that reas<strong>on</strong>, <str<strong>on</strong>g>in</str<strong>on</strong>g> 1974, I directed the subcommittee to devise a<br />
report which would sum up where the Nati<strong>on</strong> stands <strong>on</strong> nurs<str<strong>on</strong>g>in</str<strong>on</strong>g>g home<br />
care today. I would not settle for a <strong>on</strong>e-shot volume which would<br />
stir up attenti<strong>on</strong> for a few weeks and then be forgotten. I <str<strong>on</strong>g>in</str<strong>on</strong>g>sisted<br />
up<strong>on</strong> an <str<strong>on</strong>g>in</str<strong>on</strong>g>troductory summati<strong>on</strong> of failures <str<strong>on</strong>g>in</str<strong>on</strong>g> Government policy.<br />
Now, at scheduled <str<strong>on</strong>g>in</str<strong>on</strong>g>tervals, the subcommittee is issu<str<strong>on</strong>g>in</str<strong>on</strong>g>g reports<br />
deal<str<strong>on</strong>g>in</str<strong>on</strong>g>g with specific, but complicated and important, subjects, such<br />
as drug use and staff<str<strong>on</strong>g>in</str<strong>on</strong>g>g patterns <str<strong>on</strong>g>in</str<strong>on</strong>g> nurs<str<strong>on</strong>g>in</str<strong>on</strong>g>g homes.<br />
And before our f<str<strong>on</strong>g>in</str<strong>on</strong>g>al report, I will <str<strong>on</strong>g>in</str<strong>on</strong>g>vite the U.S. Department of<br />
Health Educati<strong>on</strong>, and Welfare and the nurs<str<strong>on</strong>g>in</str<strong>on</strong>g>g home <str<strong>on</strong>g>in</str<strong>on</strong>g>dustry to<br />
submit rebuttal or commentary, which the subcommittee will then<br />
pr<str<strong>on</strong>g>in</str<strong>on</strong>g>t.<br />
We are <str<strong>on</strong>g>in</str<strong>on</strong>g>terested <str<strong>on</strong>g>in</str<strong>on</strong>g> communicati<strong>on</strong>, not denunciati<strong>on</strong>. We want a<br />
process to take place, and we want it to change the way th<str<strong>on</strong>g>in</str<strong>on</strong>g>gs are<br />
d<strong>on</strong>e <str<strong>on</strong>g>in</str<strong>on</strong>g> the Nati<strong>on</strong>'s nurs<str<strong>on</strong>g>in</str<strong>on</strong>g>g homes.<br />
Already, I th<str<strong>on</strong>g>in</str<strong>on</strong>g>k, I have detected a similar determ<str<strong>on</strong>g>in</str<strong>on</strong>g>ati<strong>on</strong> at HEW,<br />
and am<strong>on</strong>g certa<str<strong>on</strong>g>in</str<strong>on</strong>g> leaders <str<strong>on</strong>g>in</str<strong>on</strong>g> the nurs<str<strong>on</strong>g>in</str<strong>on</strong>g>g home <str<strong>on</strong>g>in</str<strong>on</strong>g>dustry. They realize,<br />
I hope, that the people of the United States will no l<strong>on</strong>ger tolerate<br />
damag<str<strong>on</strong>g>in</str<strong>on</strong>g>g, disgust<str<strong>on</strong>g>in</str<strong>on</strong>g>g, and degrad<str<strong>on</strong>g>in</str<strong>on</strong>g>g scandals and profiteer<str<strong>on</strong>g>in</str<strong>on</strong>g>g <str<strong>on</strong>g>in</str<strong>on</strong>g><br />
<str<strong>on</strong>g>in</str<strong>on</strong>g>stituti<strong>on</strong>s which, largely at public expense, supposedly give care<br />
and k<str<strong>on</strong>g>in</str<strong>on</strong>g>dness to those people who are so completely <str<strong>on</strong>g>in</str<strong>on</strong>g> their hands.<br />
I sense the same determ<str<strong>on</strong>g>in</str<strong>on</strong>g>ati<strong>on</strong> am<strong>on</strong>g newspaper and televisi<strong>on</strong><br />
reporters and editors who have had such a large role <str<strong>on</strong>g>in</str<strong>on</strong>g> br<str<strong>on</strong>g>in</str<strong>on</strong>g>g<str<strong>on</strong>g>in</str<strong>on</strong>g>g to<br />
light many of the matters to be discussed here today.<br />
I sense the same determ<str<strong>on</strong>g>in</str<strong>on</strong>g>ati<strong>on</strong> am<strong>on</strong>g city officials, State legislators,<br />
and the new Governor of this State. I sense. too, that the people<br />
of New York-and of other States-are say<str<strong>on</strong>g>in</str<strong>on</strong>g>g: Enough; no more<br />
apathy to costly abuses and ripoffs <str<strong>on</strong>g>in</str<strong>on</strong>g> nurs<str<strong>on</strong>g>in</str<strong>on</strong>g>g homes.<br />
In short, the showdown so l<strong>on</strong>g delayed is now here. New York has<br />
the opportunity to lead, as it has so often <str<strong>on</strong>g>in</str<strong>on</strong>g> the past, <str<strong>on</strong>g>in</str<strong>on</strong>g> establish<str<strong>on</strong>g>in</str<strong>on</strong>g>g<br />
genu<str<strong>on</strong>g>in</str<strong>on</strong>g>e reform, and then <str<strong>on</strong>g>in</str<strong>on</strong>g>sist<str<strong>on</strong>g>in</str<strong>on</strong>g>g that the reforms stick. The C<strong>on</strong>gress.<br />
with help from leaders here and <str<strong>on</strong>g>in</str<strong>on</strong>g> other States, can <str<strong>on</strong>g>in</str<strong>on</strong>g>sist that<br />
the tide now ris<str<strong>on</strong>g>in</str<strong>on</strong>g>g will sweep away scandal and shortcom<str<strong>on</strong>g>in</str<strong>on</strong>g>gs <str<strong>on</strong>g>in</str<strong>on</strong>g> all<br />
of the 50 States.
