If you notice, there is a wide variati<strong>on</strong> of costs aga<str<strong>on</strong>g>in</str<strong>on</strong>g>, and if you<br />

also notice, c<strong>on</strong>tracts are c<strong>on</strong>sistently higher than n<strong>on</strong>c<strong>on</strong>tracts.<br />

I d<strong>on</strong>'t know why. Probably they sell them <strong>on</strong> better service or someth<str<strong>on</strong>g>in</str<strong>on</strong>g>g;<br />

however, I can say that we do have deficiency reports <strong>on</strong> the<br />

various homes, which show that the beds are not changed. That is a<br />

lot of l<str<strong>on</strong>g>in</str<strong>on</strong>g>en for beds that are not changed.<br />

We are also told, as the reas<strong>on</strong> for higher cost of l<str<strong>on</strong>g>in</str<strong>on</strong>g>en, that we have<br />

more people, a greater percentage of our people are <str<strong>on</strong>g>in</str<strong>on</strong>g> beds than are<br />

<str<strong>on</strong>g>in</str<strong>on</strong>g> other homes, stay <str<strong>on</strong>g>in</str<strong>on</strong>g> beds, not ambulatory patients.<br />

If you take a look at the first three bars, the <strong>on</strong>e <strong>on</strong> the left is the<br />

highest cost. They have 18 percent of their patients not ambulatory,<br />

and the <strong>on</strong>e <strong>on</strong> the right of those first three bars, has 63 percent of<br />

their patients n<strong>on</strong>ambulatory.<br />

Yet their costs for l<str<strong>on</strong>g>in</str<strong>on</strong>g>ens are far less than the <strong>on</strong>e <strong>on</strong>ly for 18<br />

percent.<br />

More people are <str<strong>on</strong>g>in</str<strong>on</strong>g> bed all the time, but it costs them less m<strong>on</strong>ey to<br />

ma<str<strong>on</strong>g>in</str<strong>on</strong>g>ta<str<strong>on</strong>g>in</str<strong>on</strong>g> than it does at the other home.<br />

Here is, I would say, a pretty phenomenal example of it, the same<br />

th<str<strong>on</strong>g>in</str<strong>on</strong>g>g, 34 percent of the people <str<strong>on</strong>g>in</str<strong>on</strong>g> this home are n<strong>on</strong>ambulatory, 28<br />

percent of these people are n<strong>on</strong>ambulatory, this would be more like it,<br />

except this is a 128-percent difference <str<strong>on</strong>g>in</str<strong>on</strong>g> the cost, where a 6-percent<br />

difference <str<strong>on</strong>g>in</str<strong>on</strong>g> the number of people exists.<br />

Aga<str<strong>on</strong>g>in</str<strong>on</strong>g>, I have no answer, <strong>on</strong>ly questi<strong>on</strong>s.<br />

Senator Moss. Well, thank you, Mr. Lee.<br />

That poses some questi<strong>on</strong>s there that will take some p<strong>on</strong>der<str<strong>on</strong>g>in</str<strong>on</strong>g>g, as<br />

to why those differences exist, and it <str<strong>on</strong>g>in</str<strong>on</strong>g>dicates that there is not any<br />

standard that is fairly well accepted throughout the nurs<str<strong>on</strong>g>in</str<strong>on</strong>g>g home <str<strong>on</strong>g>in</str<strong>on</strong>g>dustry<br />

<strong>on</strong> costs like l<str<strong>on</strong>g>in</str<strong>on</strong>g>ens, and ma<str<strong>on</strong>g>in</str<strong>on</strong>g>ta<str<strong>on</strong>g>in</str<strong>on</strong>g><str<strong>on</strong>g>in</str<strong>on</strong>g>g a bed, and th<str<strong>on</strong>g>in</str<strong>on</strong>g>gs of that<br />

sort.<br />

Mr. LEE. That is correct, Senator. There is no real valid explanati<strong>on</strong><br />

for the variati<strong>on</strong> of costs with<str<strong>on</strong>g>in</str<strong>on</strong>g> a* 50-bed home and a 150-bed home.<br />

There is no explanati<strong>on</strong> of it at all, for a 400- or 500-percent variati<strong>on</strong>.<br />

Senator Moss. To what extent are people, are patients <str<strong>on</strong>g>in</str<strong>on</strong>g> nurs<str<strong>on</strong>g>in</str<strong>on</strong>g>g<br />

homes able to remove themselves, if they want to go to another nurs<str<strong>on</strong>g>in</str<strong>on</strong>g>g<br />

home?<br />

I realize we are talk<str<strong>on</strong>g>in</str<strong>on</strong>g>g of old, sick people, but suppose there is <strong>on</strong>e<br />

that is bad, and they know of <strong>on</strong>e down the street that is better, to what<br />

extent can they change their place?<br />

Mr. MOAN. I th<str<strong>on</strong>g>in</str<strong>on</strong>g>k I could answer that a little better.<br />

A few years ago, there was a study performed. which I do not th<str<strong>on</strong>g>in</str<strong>on</strong>g>k<br />

was ever released publicly, which was d<strong>on</strong>e. as to the rights, or the<br />

perceived rights of the people <str<strong>on</strong>g>in</str<strong>on</strong>g> a nurs<str<strong>on</strong>g>in</str<strong>on</strong>g>g home, and the people <str<strong>on</strong>g>in</str<strong>on</strong>g><br />

the county jail.<br />

The results of that test, or that survey, was that pris<strong>on</strong>ers <str<strong>on</strong>g>in</str<strong>on</strong>g> jail<br />

felt they had more rights of freedom than do patients <str<strong>on</strong>g>in</str<strong>on</strong>g> nurs<str<strong>on</strong>g>in</str<strong>on</strong>g>g<br />

homes.<br />

We have received letters from people sav<str<strong>on</strong>g>in</str<strong>on</strong>g>g. please help me get out<br />

of this nurs<str<strong>on</strong>g>in</str<strong>on</strong>g>g home, <str<strong>on</strong>g>in</str<strong>on</strong>g>dicat<str<strong>on</strong>g>in</str<strong>on</strong>g>g that the people <str<strong>on</strong>g>in</str<strong>on</strong>g> nurs<str<strong>on</strong>g>in</str<strong>on</strong>g>g homes, the<br />

patients believe they cannot leave, and believe they have no freedom<br />

of choice.<br />

That fact, their right to leave, their right to choose a nurs<str<strong>on</strong>g>in</str<strong>on</strong>g>g home,<br />

are never brought to the awareness of the patient, and as a practical
