There is no change <str<strong>on</strong>g>in</str<strong>on</strong>g> the quality of service. There is no change <str<strong>on</strong>g>in</str<strong>on</strong>g><br />
the accommodati<strong>on</strong> provided to the elderly patr<strong>on</strong>s <str<strong>on</strong>g>in</str<strong>on</strong>g> that nurs<str<strong>on</strong>g>in</str<strong>on</strong>g>g<br />
home, and what we merely had was a change <str<strong>on</strong>g>in</str<strong>on</strong>g> ownership, new faces<br />
runn<str<strong>on</strong>g>in</str<strong>on</strong>g>g the <str<strong>on</strong>g>in</str<strong>on</strong>g>stituti<strong>on</strong>, and receiv<str<strong>on</strong>g>in</str<strong>on</strong>g>g a profit, and so these are transfers<br />
which we believe greatly affected medicaid.<br />
Senator Moss. These are the five different nurs<str<strong>on</strong>g>in</str<strong>on</strong>g>g homes which you<br />
checked?<br />
Mr. MOAN. That is correct. We have had as many as 36 transfers of<br />
recorded acti<strong>on</strong>s, let's put it that way, 36 recorded acti<strong>on</strong>s, <str<strong>on</strong>g>in</str<strong>on</strong>g> I believe<br />
it was a 10- or 15-year period, so the average comes out to be a<br />
little bit greater than 23 transfers, or 2 transacti<strong>on</strong>s a year, the transacti<strong>on</strong><br />
is actually a sale, a mortgage, or a lease, so the property is c<strong>on</strong>t<str<strong>on</strong>g>in</str<strong>on</strong>g>ually<br />
be<str<strong>on</strong>g>in</str<strong>on</strong>g>g exchanged, or be<str<strong>on</strong>g>in</str<strong>on</strong>g>g manipulated <str<strong>on</strong>g>in</str<strong>on</strong>g> some way, somehow<br />
for reas<strong>on</strong>s which the public documents so far do not disclose.<br />
Mr. HALAMANDARIS. The questi<strong>on</strong> that occurs to me, is what degree<br />
do disclosures be<str<strong>on</strong>g>in</str<strong>on</strong>g>g made <str<strong>on</strong>g>in</str<strong>on</strong>g>dicate a comm<strong>on</strong> practice here <str<strong>on</strong>g>in</str<strong>on</strong>g> New<br />
York City, and if you could give me some idea of the scope of your<br />
<str<strong>on</strong>g>in</str<strong>on</strong>g>vestigati<strong>on</strong>. have you limited your <str<strong>on</strong>g>in</str<strong>on</strong>g>vestigati<strong>on</strong> particularly to Dr.<br />
Bergman and his family, or have you d<strong>on</strong>e this throughout the State<br />
of New York?<br />
My questi<strong>on</strong> aga<str<strong>on</strong>g>in</str<strong>on</strong>g> restated, is this a comm<strong>on</strong> practice, or did you<br />
focus <str<strong>on</strong>g>in</str<strong>on</strong>g> <strong>on</strong> <strong>on</strong>e home?<br />
Mr. MOAN. Most of our title searches were d<strong>on</strong>e <str<strong>on</strong>g>in</str<strong>on</strong>g> New York City.<br />
We have some from the outer boroughs, and from, I believe, Westchester,<br />
and other areas <str<strong>on</strong>g>in</str<strong>on</strong>g> New Jersey, as a matter of fact.<br />
We have not focused <str<strong>on</strong>g>in</str<strong>on</strong>g> <strong>on</strong> any <strong>on</strong>e family. It appears to be an <str<strong>on</strong>g>in</str<strong>on</strong>g>dustrywide<br />
practice, because whenever we asked for a title search, it<br />
<str<strong>on</strong>g>in</str<strong>on</strong>g>evitably takes 3 weeks to come back, and it <str<strong>on</strong>g>in</str<strong>on</strong>g>evitably comes <str<strong>on</strong>g>in</str<strong>on</strong>g> with<br />
10 pages worth of transfers such as we had here today, and it certa<str<strong>on</strong>g>in</str<strong>on</strong>g>ly<br />
is not isolated to any <strong>on</strong>e comp<strong>on</strong>ent of the <str<strong>on</strong>g>in</str<strong>on</strong>g>dustry.<br />
The age of the <str<strong>on</strong>g>in</str<strong>on</strong>g>stituti<strong>on</strong> does have an effect. A nurs<str<strong>on</strong>g>in</str<strong>on</strong>g>g home that<br />
was just built, certa<str<strong>on</strong>g>in</str<strong>on</strong>g>ly it -will not have all of those transfers, but an<br />
<str<strong>on</strong>g>in</str<strong>on</strong>g>stituti<strong>on</strong>, which is an old build<str<strong>on</strong>g>in</str<strong>on</strong>g>g, particularly a renovated build<str<strong>on</strong>g>in</str<strong>on</strong>g>g,<br />
will have underg<strong>on</strong>e any number of transfers <str<strong>on</strong>g>in</str<strong>on</strong>g> the past few years.<br />
We have also found, I believe, <str<strong>on</strong>g>in</str<strong>on</strong>g> the Mayflower Nurs<str<strong>on</strong>g>in</str<strong>on</strong>g>g Home, and<br />
I would have to check our files, but we have a great number of transfers.<br />
Senator Moss. Does the State department of health now have any<br />
opti<strong>on</strong>, or must it accept those sales prices when apply<str<strong>on</strong>g>in</str<strong>on</strong>g>g for transfers,<br />
go<str<strong>on</strong>g>in</str<strong>on</strong>g>g <strong>on</strong>, with prices go<str<strong>on</strong>g>in</str<strong>on</strong>g>g up?<br />
Mr. MOAN. The <strong>on</strong>es I showed <str<strong>on</strong>g>in</str<strong>on</strong>g> the last chart, <strong>on</strong>e of the reas<strong>on</strong>s<br />
that they said they were, they granted <str<strong>on</strong>g>in</str<strong>on</strong>g>creases, was because they were<br />
mortgages, those rents were necessary to cover outstand<str<strong>on</strong>g>in</str<strong>on</strong>g>g mortgages.<br />
Now, I do not know for a fact whetler those mortgages were entered<br />
<str<strong>on</strong>g>in</str<strong>on</strong>g>to the way these mortgages were, the earlier mortgages were,<br />
or between companies and related <str<strong>on</strong>g>in</str<strong>on</strong>g>stituti<strong>on</strong>s, or the commercial lend<str<strong>on</strong>g>in</str<strong>on</strong>g>g<br />
<str<strong>on</strong>g>in</str<strong>on</strong>g>stituti<strong>on</strong>s, but I do know that what we have found is that these<br />
build<str<strong>on</strong>g>in</str<strong>on</strong>g>gs, and these properties have always been well overf<str<strong>on</strong>g>in</str<strong>on</strong>g>anced and<br />
that is that they have always had debts, much greater than we could<br />
justify accord<str<strong>on</strong>g>in</str<strong>on</strong>g>g to their assessed value, or accord<str<strong>on</strong>g>in</str<strong>on</strong>g>g to the renovati<strong>on</strong>s<br />
that allegedly have been <str<strong>on</strong>g>in</str<strong>on</strong>g>cluded <str<strong>on</strong>g>in</str<strong>on</strong>g> the build<str<strong>on</strong>g>in</str<strong>on</strong>g>g themselves, so<br />
that if you have a build<str<strong>on</strong>g>in</str<strong>on</strong>g>g that is worth less than half a milli<strong>on</strong> dollars,<br />
grant<str<strong>on</strong>g>in</str<strong>on</strong>g>g it the total amount of purchase price, and the total
