came to us, and they reported they had never seen such a tremendous<br />

number of transfers <str<strong>on</strong>g>in</str<strong>on</strong>g> any <strong>on</strong>e parcel of real property.<br />

I might also add that we could have chosen any <strong>on</strong>e of a dozen<br />

nurs<str<strong>on</strong>g>in</str<strong>on</strong>g>g homes that we have, that have similar or even more complicated<br />

flow; however, this <strong>on</strong>e was chosen for the simple reas<strong>on</strong> that it clearly<br />

shows, the State department of health's acti<strong>on</strong> clearly shows that this<br />

rent is wr<strong>on</strong>g.<br />

Senator Moss. Now, <str<strong>on</strong>g>in</str<strong>on</strong>g> 1966, you have the green ownership that goes<br />

right <strong>on</strong>, and then that blue branches off above.<br />

Does that mean the renter is operat<str<strong>on</strong>g>in</str<strong>on</strong>g>g it as a nurs<str<strong>on</strong>g>in</str<strong>on</strong>g>g home, and the<br />

green is simply the ownership?<br />

Mr. MOAN. That is right. They own the physical property, but because<br />

they have entered <str<strong>on</strong>g>in</str<strong>on</strong>g>to this lease, and they dom<str<strong>on</strong>g>in</str<strong>on</strong>g>ate the nurs<str<strong>on</strong>g>in</str<strong>on</strong>g>g<br />

home, because their costs, is a fixed cost, and it is a major fixed cost, and<br />

the $100,000 here is a lot of m<strong>on</strong>ey to put <strong>on</strong> this <strong>on</strong>e small build<str<strong>on</strong>g>in</str<strong>on</strong>g>g.<br />

I have pictures of the build<str<strong>on</strong>g>in</str<strong>on</strong>g>g, which I would like to admit <str<strong>on</strong>g>in</str<strong>on</strong>g>to<br />

evidence, and they show a build<str<strong>on</strong>g>in</str<strong>on</strong>g>g, a three-story build<str<strong>on</strong>g>in</str<strong>on</strong>g>g.*<br />

Senator Moss. This build<str<strong>on</strong>g>in</str<strong>on</strong>g>g there?<br />

Mr. MOAN. That is right. That is the build<str<strong>on</strong>g>in</str<strong>on</strong>g>g, and the other picture<br />

shows the back of it, and this is the <str<strong>on</strong>g>in</str<strong>on</strong>g>stituti<strong>on</strong> that we are talk<str<strong>on</strong>g>in</str<strong>on</strong>g>g<br />

about, that underwent all of those transfers, and was mortgaged at<br />

<strong>on</strong>e time for $1.3 milli<strong>on</strong>.<br />

Senator Moss. Did you check its assessed valuati<strong>on</strong>?<br />

Mr. MOAN. The assessed value is less than $212,000.<br />

Senator Moss. These will be admitted <str<strong>on</strong>g>in</str<strong>on</strong>g>to the files.<br />

Did you f<str<strong>on</strong>g>in</str<strong>on</strong>g>d violati<strong>on</strong> of law <str<strong>on</strong>g>in</str<strong>on</strong>g> all of this transfer, anyth<str<strong>on</strong>g>in</str<strong>on</strong>g>g that<br />

you thought was violati<strong>on</strong> of law?<br />

Mr. MOAN. No, we did not f<str<strong>on</strong>g>in</str<strong>on</strong>g>d actual violati<strong>on</strong>s of law. This is legal,<br />

all of these transfers are legal. It is a perfectly legal operati<strong>on</strong>. There<br />

is noth<str<strong>on</strong>g>in</str<strong>on</strong>g>g unlawful or crim<str<strong>on</strong>g>in</str<strong>on</strong>g>al about it.<br />

The problem comes <str<strong>on</strong>g>in</str<strong>on</strong>g> that the exist<str<strong>on</strong>g>in</str<strong>on</strong>g>g medicaid reimbursement formula<br />

permits the reimbursement based up<strong>on</strong> a history of all of those<br />

transfers, and if the cost of that build<str<strong>on</strong>g>in</str<strong>on</strong>g>g, and the value of that build<str<strong>on</strong>g>in</str<strong>on</strong>g>g<br />

was-bore no relati<strong>on</strong>ship to its real value, its assessed value of<br />

$212,000, after the $250,000 worth of renovati<strong>on</strong>s, so that here we have<br />

a build<str<strong>on</strong>g>in</str<strong>on</strong>g>g that we know is worth no more than $300,000 <str<strong>on</strong>g>in</str<strong>on</strong>g> 1957, and a<br />

build<str<strong>on</strong>g>in</str<strong>on</strong>g>g that underwent $250,000 worth of renovati<strong>on</strong>s, that figure is<br />

recorded <strong>on</strong> the State department of health records, the HE-2, and<br />

the total of those is much less, it is even less than half of the amount<br />

of mortgages that were entered <str<strong>on</strong>g>in</str<strong>on</strong>g>to <strong>on</strong> that build<str<strong>on</strong>g>in</str<strong>on</strong>g>g.<br />

Senator Moss. What was the end effect, if you have it, what was the<br />

end effect of the cost figures that comes out at the end of that formula,<br />

by reas<strong>on</strong> of the real estate?<br />

Mr. MOAN. Well, aga<str<strong>on</strong>g>in</str<strong>on</strong>g>, we d<strong>on</strong>'t know exactly how much the State<br />

department of health will eventually reduce the rent <str<strong>on</strong>g>in</str<strong>on</strong>g> the future.<br />

We have been told, or I was told that the owners said they would no<br />

l<strong>on</strong>ger be able to operate the <str<strong>on</strong>g>in</str<strong>on</strong>g>stituti<strong>on</strong>, would have to go out of bus<str<strong>on</strong>g>in</str<strong>on</strong>g>ess,<br />

because the planned reducti<strong>on</strong> of bus<str<strong>on</strong>g>in</str<strong>on</strong>g>ess would be too great, and<br />

would force them <str<strong>on</strong>g>in</str<strong>on</strong>g>to bankruptcy, so what is probably a fairer rent<br />

for the build<str<strong>on</strong>g>in</str<strong>on</strong>g>g was allowed, the <str<strong>on</strong>g>in</str<strong>on</strong>g>stituti<strong>on</strong> would be no l<strong>on</strong>ger under<br />

the medicaid system, and would no l<strong>on</strong>ger bear any relevance to how<br />
