and <str<strong>on</strong>g>in</str<strong>on</strong>g> fact a practice of leak<str<strong>on</strong>g>in</str<strong>on</strong>g>g them selectively with false statements<br />

to the press, and, therefore, we need assurance that they will not be<br />

made available to Mr. Ste<str<strong>on</strong>g>in</str<strong>on</strong>g>, or to the members of his staff.<br />

I notice two gentlemen sitt<str<strong>on</strong>g>in</str<strong>on</strong>g>g beh<str<strong>on</strong>g>in</str<strong>on</strong>g>d him, I submit aga<str<strong>on</strong>g>in</str<strong>on</strong>g>, <str<strong>on</strong>g>in</str<strong>on</strong>g> terms,<br />

Mr. Chairman, you say it is a matter of appearances.<br />

I th<str<strong>on</strong>g>in</str<strong>on</strong>g>k it is a matter of very fundamental c<strong>on</strong>stituti<strong>on</strong>al rights<br />

<str<strong>on</strong>g>in</str<strong>on</strong>g>volved here.<br />

The <str<strong>on</strong>g>Senate</str<strong>on</strong>g> is sitt<str<strong>on</strong>g>in</str<strong>on</strong>g>g, and the witness is prepared to offer every<br />

cooperati<strong>on</strong>, but is not prepared to have some<strong>on</strong>e aga<str<strong>on</strong>g>in</str<strong>on</strong>g>st whom he has<br />

brought a suit <str<strong>on</strong>g>in</str<strong>on</strong>g> Federal district court, mak<str<strong>on</strong>g>in</str<strong>on</strong>g>g a very serious allegati<strong>on</strong>,<br />

who has been found to be act<str<strong>on</strong>g>in</str<strong>on</strong>g>g improperly by a State judge,<br />

def<str<strong>on</strong>g>in</str<strong>on</strong>g>itively, c<strong>on</strong>clusively, <str<strong>on</strong>g>in</str<strong>on</strong>g> litigati<strong>on</strong> that has been fully litigated<br />

before that State judge, to have that pers<strong>on</strong> sit up there <str<strong>on</strong>g>in</str<strong>on</strong>g> judgment.<br />

I th<str<strong>on</strong>g>in</str<strong>on</strong>g>k <str<strong>on</strong>g>in</str<strong>on</strong>g> the cases where you referred to, where the committee has<br />

<str<strong>on</strong>g>in</str<strong>on</strong>g> the past <str<strong>on</strong>g>in</str<strong>on</strong>g>vited <str<strong>on</strong>g>in</str<strong>on</strong>g>terested pers<strong>on</strong>s, I daresay probably it has<br />

never occurred that those <str<strong>on</strong>g>in</str<strong>on</strong>g>terested pers<strong>on</strong>s have been <str<strong>on</strong>g>in</str<strong>on</strong>g>volved <str<strong>on</strong>g>in</str<strong>on</strong>g><br />

those k<str<strong>on</strong>g>in</str<strong>on</strong>g>ds of litigati<strong>on</strong>s, have been found guilty of mispractices<br />

that this gentleman has been found of, and are be<str<strong>on</strong>g>in</str<strong>on</strong>g>g entitled to sit<br />

there, I th<str<strong>on</strong>g>in</str<strong>on</strong>g>k, to create false impressi<strong>on</strong>s.<br />

Senator Moss. Well, I of course know noth<str<strong>on</strong>g>in</str<strong>on</strong>g>g about a lawsuit. I<br />

am not aware of any of that. I d<strong>on</strong>'t know whether your allegati<strong>on</strong>s<br />

are correct or <str<strong>on</strong>g>in</str<strong>on</strong>g>correct, but I can assure you, Mr. Ste<str<strong>on</strong>g>in</str<strong>on</strong>g> is not sitt<str<strong>on</strong>g>in</str<strong>on</strong>g>g<br />

as a member of this committee, that the records will not be turned<br />

over to him, or anybody of his commissi<strong>on</strong>; they will rema<str<strong>on</strong>g>in</str<strong>on</strong>g> <str<strong>on</strong>g>in</str<strong>on</strong>g> the<br />

jurisdicti<strong>on</strong> of this committee and the General Account<str<strong>on</strong>g>in</str<strong>on</strong>g>g Office<br />

until they are returned to the owners of the records, and if that is not<br />

assurance enough, why, I do not know how much more assurance I<br />

can give you.<br />

Mr. Ste<str<strong>on</strong>g>in</str<strong>on</strong>g> is not go<str<strong>on</strong>g>in</str<strong>on</strong>g>g to ask any questi<strong>on</strong>s. He has not spoken<br />

to me other than greet<str<strong>on</strong>g>in</str<strong>on</strong>g>g me. I greeted him, said I was glad to meet<br />

him for the first time today, that is it.<br />

Mr. LEWIN. Mr. Chairman, I submit no other witness <strong>on</strong> that witness<br />

list has been given the opportunity to sit up there <strong>on</strong> that bench.<br />

My client has not been given the opportunity, and I th<str<strong>on</strong>g>in</str<strong>on</strong>g>k no <strong>on</strong>e<br />

has suggested to him that he might sit up <strong>on</strong> the bench and make<br />

an <str<strong>on</strong>g>in</str<strong>on</strong>g>troductory statement.<br />

I th<str<strong>on</strong>g>in</str<strong>on</strong>g>k as the Chairman <str<strong>on</strong>g>in</str<strong>on</strong>g>dicated, the appearance of it is wr<strong>on</strong>g,<br />

and I am not simply, as a matter of obligati<strong>on</strong> to my client, say to<br />

him, well, now, you can just go ahead with precisely the very central<br />

objecti<strong>on</strong> we have had with this hear<str<strong>on</strong>g>in</str<strong>on</strong>g>g s<str<strong>on</strong>g>in</str<strong>on</strong>g>ce the time it was called.<br />

I th<str<strong>on</strong>g>in</str<strong>on</strong>g>k it is a matter of history, I th<str<strong>on</strong>g>in</str<strong>on</strong>g>k we have called to your<br />

attenti<strong>on</strong> that Mr. Ste<str<strong>on</strong>g>in</str<strong>on</strong>g> made public statements, he would run this<br />

committee, he would preside over it, he would run it, he would operate<br />

it, he would decide when it would be held.<br />

We will not cooperate with any effort run by Mr. Ste<str<strong>on</strong>g>in</str<strong>on</strong>g> <str<strong>on</strong>g>in</str<strong>on</strong>g> that<br />

regard. It is really quite that simple.<br />

Senator Moss. I th<str<strong>on</strong>g>in</str<strong>on</strong>g>k we are probably hav<str<strong>on</strong>g>in</str<strong>on</strong>g>g quite a tempest<br />

over someth<str<strong>on</strong>g>in</str<strong>on</strong>g>g that is not important. If Dr. Bergman would like<br />

to come and sit up here, I would be glad to have him.<br />
