made to Mr. Halamandaris, and that we made <str<strong>on</strong>g>in</str<strong>on</strong>g> corresp<strong>on</strong>dence, that<br />
the records would be submitted to the committee, and to the committee<br />
<strong>on</strong>ly, and <strong>on</strong> the understand<str<strong>on</strong>g>in</str<strong>on</strong>g>g that it is the committee, and the committee<br />
<strong>on</strong>ly, that is to have access to those records.<br />
Now, if that submissi<strong>on</strong> is to be made, and we would be prepared to<br />
make it, we th<str<strong>on</strong>g>in</str<strong>on</strong>g>k it should be made at a time when Mr. Ste<str<strong>on</strong>g>in</str<strong>on</strong>g> <str<strong>on</strong>g>in</str<strong>on</strong>g> not<br />
sitt<str<strong>on</strong>g>in</str<strong>on</strong>g>g as a member of the committee, and when his representatives do<br />
not sit <str<strong>on</strong>g>in</str<strong>on</strong>g> that capacity at the table which is reserved for the committee<br />
members, so at present, as the committee is presently c<strong>on</strong>stituted,<br />
I would most respectfully have to advise my client not to produce<br />
those records.<br />
Senator Moss. Well, based <strong>on</strong> our corresp<strong>on</strong>dence, I made it clear<br />
that this is an official hear<str<strong>on</strong>g>in</str<strong>on</strong>g>g of the <str<strong>on</strong>g>Senate</str<strong>on</strong>g> subcommittee, and that<br />
our committee exclusively has jurisdicti<strong>on</strong> here.<br />
Now, it is customary, <str<strong>on</strong>g>in</str<strong>on</strong>g> fact, rather frequently d<strong>on</strong>e when the committee<br />
sits <str<strong>on</strong>g>in</str<strong>on</strong>g> another city out of Wash<str<strong>on</strong>g>in</str<strong>on</strong>g>gt<strong>on</strong>, or another State, we<br />
oftentimes <str<strong>on</strong>g>in</str<strong>on</strong>g>vite people who are <str<strong>on</strong>g>in</str<strong>on</strong>g>terested <str<strong>on</strong>g>in</str<strong>on</strong>g> the subject matter to sit<br />
with us, but they do not functi<strong>on</strong> as a member of the committee, and<br />
<str<strong>on</strong>g>in</str<strong>on</strong>g> this <str<strong>on</strong>g>in</str<strong>on</strong>g>stance, Mr. Ste<str<strong>on</strong>g>in</str<strong>on</strong>g> is go<str<strong>on</strong>g>in</str<strong>on</strong>g>g to be a witness, he is go<str<strong>on</strong>g>in</str<strong>on</strong>g>g to sit<br />
down there <str<strong>on</strong>g>in</str<strong>on</strong>g> fr<strong>on</strong>t of those microph<strong>on</strong>es, and I do accord him the<br />
opportunity of sitt<str<strong>on</strong>g>in</str<strong>on</strong>g>g up here, s<str<strong>on</strong>g>in</str<strong>on</strong>g>ce he has been c<strong>on</strong>duct<str<strong>on</strong>g>in</str<strong>on</strong>g>g an <str<strong>on</strong>g>in</str<strong>on</strong>g>vestigati<strong>on</strong><br />
for a l<strong>on</strong>g time that we have been hear<str<strong>on</strong>g>in</str<strong>on</strong>g>g about.<br />
Now, maybe the appearance is that, but Mr. Ste<str<strong>on</strong>g>in</str<strong>on</strong>g> is not to become a<br />
member of this committee, and he will not functi<strong>on</strong> <str<strong>on</strong>g>in</str<strong>on</strong>g> any way <str<strong>on</strong>g>in</str<strong>on</strong>g> the<br />
records we prepare, and the exam<str<strong>on</strong>g>in</str<strong>on</strong>g>ati<strong>on</strong> to be made.<br />
Incidentally, those records will be exam<str<strong>on</strong>g>in</str<strong>on</strong>g>ed by the General Account<str<strong>on</strong>g>in</str<strong>on</strong>g>g<br />
Office. I do not have staff available to me, and I have the General<br />
Account<str<strong>on</strong>g>in</str<strong>on</strong>g>g Office to exam<str<strong>on</strong>g>in</str<strong>on</strong>g>e the records for me.<br />

Mr. Ste<str<strong>on</strong>g>in</str<strong>on</strong>g>, if we are go<str<strong>on</strong>g>in</str<strong>on</strong>g>g to submit those records, leave the podium,<br />
and not be permitted to sit there, and I would ask <str<strong>on</strong>g>in</str<strong>on</strong>g> additi<strong>on</strong>, that the<br />
Chairman give us the assurance that the General Account<str<strong>on</strong>g>in</str<strong>on</strong>g>g Office will<br />
have access to these records, which we are perfectly prepared to accept,<br />
and which we th<str<strong>on</strong>g>in</str<strong>on</strong>g>k is proper, and <str<strong>on</strong>g>in</str<strong>on</strong>g>deed Dr. Bergman's view throughout<br />
is that he will cooperate with every lawful governmental body<br />
that is seek<str<strong>on</strong>g>in</str<strong>on</strong>g>g to c<strong>on</strong>duct any good-f aith <str<strong>on</strong>g>in</str<strong>on</strong>g>vestigati<strong>on</strong> of the nurs<str<strong>on</strong>g>in</str<strong>on</strong>g>g<br />
home <str<strong>on</strong>g>in</str<strong>on</strong>g>dustry.<br />
That has been his view <str<strong>on</strong>g>in</str<strong>on</strong>g> the past, that c<strong>on</strong>t<str<strong>on</strong>g>in</str<strong>on</strong>g>ues to be his view today,<br />
that will be his view <str<strong>on</strong>g>in</str<strong>on</strong>g> the future, and it is for that reas<strong>on</strong>, when<br />
we received the <str<strong>on</strong>g>Senate</str<strong>on</strong>g> subpenas, we made it clear that that full cooperati<strong>on</strong><br />
would be made available.<br />
Now, I must say, simply as an attorney, who has been practic<str<strong>on</strong>g>in</str<strong>on</strong>g>g for<br />
some time, there are I th<str<strong>on</strong>g>in</str<strong>on</strong>g>k substantial legal objecti<strong>on</strong>s that would be<br />
<str<strong>on</strong>g>in</str<strong>on</strong>g>serted <str<strong>on</strong>g>in</str<strong>on</strong>g> various ways to the subpenas.<br />
They encompass the entire operat<str<strong>on</strong>g>in</str<strong>on</strong>g>g records of the bus<str<strong>on</strong>g>in</str<strong>on</strong>g>ess. We<br />
have not made any such legal asserti<strong>on</strong>s, because we th<str<strong>on</strong>g>in</str<strong>on</strong>g>k it is important<br />
that false allegati<strong>on</strong>s be laid to rest, but we th<str<strong>on</strong>g>in</str<strong>on</strong>g>k false allegati<strong>on</strong>s<br />
will not be laid to rest if those documents are made available to
