Senator Moss. I have not read <str<strong>on</strong>g>in</str<strong>on</strong>g> full detail this op<str<strong>on</strong>g>in</str<strong>on</strong>g>i<strong>on</strong> from the<br />

State court; however, I understood it <strong>on</strong>ly went to the State comnissi<strong>on</strong>'s<br />

right to subpena <strong>on</strong> crim<str<strong>on</strong>g>in</str<strong>on</strong>g>al matters.<br />

Mr. MIOIK1INNEY. Of course, that is true, Senator Moss, but it <str<strong>on</strong>g>in</str<strong>on</strong>g>volves<br />

some of the same material which has been subpenaed here today,<br />

and we do request a few days to analyze the issues raised by the<br />

State's op<str<strong>on</strong>g>in</str<strong>on</strong>g>i<strong>on</strong> yesterday, as they may apply to this subpena.<br />

Senator Moss. Well, I would th<str<strong>on</strong>g>in</str<strong>on</strong>g>k we could allow maybe a week's<br />

extensi<strong>on</strong>.<br />

Mr. McIVN-EY. Thank you, sir.<br />

Senator Moss. So we expect you to comply with<str<strong>on</strong>g>in</str<strong>on</strong>g> a week from<br />

today.<br />

Mr. LEWIN. Mr. Chairman, my name is Nathan Lew<str<strong>on</strong>g>in</str<strong>on</strong>g>, I am attorney<br />

for Bernard Bergman, and the Bergman family, and the Towers<br />

and Park Crescent Nurs<str<strong>on</strong>g>in</str<strong>on</strong>g>g Homes.<br />

Dr. Bergman was served with the subpena to be here today, and he<br />

will be here this afterno<strong>on</strong>.<br />

The Park Crescent and Towers Nurs<str<strong>on</strong>g>in</str<strong>on</strong>g>g Homes have pursuant to<br />

discussi<strong>on</strong>s with the members of your staff, compiled their records, and<br />

have them available for transmissi<strong>on</strong> to the committee.<br />

However, as I entered the committee room this morn<str<strong>on</strong>g>in</str<strong>on</strong>g>g, and as I<br />

view the bench that sits before me, I must raise serious questi<strong>on</strong>s about<br />

the legality and the c<strong>on</strong>stituti<strong>on</strong>ality of this committee.<br />

Mr. HALANEANDARIS. Our agreement stands, the <strong>on</strong>ly questi<strong>on</strong><str<strong>on</strong>g>in</str<strong>on</strong>g>g of<br />

Dr. Bergman will be by myself and John Edie, also a member of our<br />

committee staff, representative members of this committee, and Senator<br />

Moss.<br />

That is our agreement, and we are duly c<strong>on</strong>stituted here as the <str<strong>on</strong>g>Senate</str<strong>on</strong>g><br />

Subcommittee <strong>on</strong> <str<strong>on</strong>g>L<strong>on</strong>g</str<strong>on</strong>g>-<str<strong>on</strong>g>Term</str<strong>on</strong>g> <str<strong>on</strong>g>Care</str<strong>on</strong>g>.<br />

Mr. LEWIN. Mr. Chairman, I th<str<strong>on</strong>g>in</str<strong>on</strong>g>k <str<strong>on</strong>g>in</str<strong>on</strong>g> corresp<strong>on</strong>dence with you, our<br />

law firm called attenti<strong>on</strong> to the fact that here <str<strong>on</strong>g>in</str<strong>on</strong>g> New York, there has<br />

been c<strong>on</strong>ducted what <str<strong>on</strong>g>in</str<strong>on</strong>g> our view is a very substantial malevolent<br />

vendetta aga<str<strong>on</strong>g>in</str<strong>on</strong>g>st our client.<br />

We requested <str<strong>on</strong>g>in</str<strong>on</strong>g> that regard, therefore, that it be a correcti<strong>on</strong> of<br />

proposed plans for this committee hear<str<strong>on</strong>g>in</str<strong>on</strong>g>g, so that the chief participant<br />

<str<strong>on</strong>g>in</str<strong>on</strong>g> that activity, Assemblyman Ste<str<strong>on</strong>g>in</str<strong>on</strong>g>, I th<str<strong>on</strong>g>in</str<strong>on</strong>g>k for the record,<br />

should be noted is sitt<str<strong>on</strong>g>in</str<strong>on</strong>g>g <strong>on</strong> your right, where I suppose a Senator<br />

would sit, if there was another Senator <strong>on</strong> the subcommittee.<br />

Assemblyman Andrew Ste<str<strong>on</strong>g>in</str<strong>on</strong>g> should not be a member of the committee<br />

that is sitt<str<strong>on</strong>g>in</str<strong>on</strong>g>g here this morn<str<strong>on</strong>g>in</str<strong>on</strong>g>g. I believe the fact that Assemnblymnan<br />

Ste<str<strong>on</strong>g>in</str<strong>on</strong>g> has been <str<strong>on</strong>g>in</str<strong>on</strong>g>troduced by you, he has been given an<br />

opportunity to make an open<str<strong>on</strong>g>in</str<strong>on</strong>g>g statement, not as a witness, but from<br />

all appearances as a member of the committee, that he sits, I th<str<strong>on</strong>g>in</str<strong>on</strong>g>k<br />

where a Senator would sit, or a member of the committee staff would<br />

sit, presents certa<str<strong>on</strong>g>in</str<strong>on</strong>g>ly from our client's vantage po<str<strong>on</strong>g>in</str<strong>on</strong>g>t a substantial<br />

possibility that the very <str<strong>on</strong>g>in</str<strong>on</strong>g>dividual who a State court judge found<br />

yesterday was engaged <str<strong>on</strong>g>in</str<strong>on</strong>g> what he called a rov<str<strong>on</strong>g>in</str<strong>on</strong>g>g commissi<strong>on</strong>, simply
