New York City as well as the other municipalities are fac<str<strong>on</strong>g>in</str<strong>on</strong>g>g severe<br />
budget crises. New York State also faces a budget crisis next year.<br />
Wasted m<strong>on</strong>ey cannot be permitted <str<strong>on</strong>g>in</str<strong>on</strong>g> these days of ever-ris<str<strong>on</strong>g>in</str<strong>on</strong>g>g costs.<br />
The proprietary nurs<str<strong>on</strong>g>in</str<strong>on</strong>g>g homes and health-related facilities are run<br />
<strong>on</strong> a profitmak<str<strong>on</strong>g>in</str<strong>on</strong>g>g cost-plus basis. The State now relies up<strong>on</strong> statements<br />
submitted by the nurs<str<strong>on</strong>g>in</str<strong>on</strong>g>g homes as proof of the costs of runn<str<strong>on</strong>g>in</str<strong>on</strong>g>g<br />
the facility almost without verificati<strong>on</strong>.<br />
One small department of the State department of health has the<br />
m<strong>on</strong>umental task of audit<str<strong>on</strong>g>in</str<strong>on</strong>g>g the books of all these facilities and has<br />
recovered an average of $77,000 for each facility audited <str<strong>on</strong>g>in</str<strong>on</strong>g> New York<br />
City.<br />
Informati<strong>on</strong> is necessary <strong>on</strong> three fr<strong>on</strong>ts-the ec<strong>on</strong>omic basis for<br />
reimbursements, the quality of care delivered, and the <str<strong>on</strong>g>in</str<strong>on</strong>g>dependence<br />
of the regulatory agencies.<br />
They cannot be separated, but must be exam<str<strong>on</strong>g>in</str<strong>on</strong>g>ed together. A reas<strong>on</strong>able<br />
allowance for food is <strong>on</strong>ly reas<strong>on</strong>able if that food is actually<br />
delivered to the patients. A reas<strong>on</strong>able allowance for medic<str<strong>on</strong>g>in</str<strong>on</strong>g>e is <strong>on</strong>ly<br />
reas<strong>on</strong>able if it is given to the patients. A regulati<strong>on</strong> <strong>on</strong> the books is<br />
<strong>on</strong>ly effective if it is enforced.<br />
We must never forget that we are deal<str<strong>on</strong>g>in</str<strong>on</strong>g>g with human lives, not<br />
with a commodity. Any<strong>on</strong>e who cheats <str<strong>on</strong>g>in</str<strong>on</strong>g> a medical reimbursement<br />
is not merely steal<str<strong>on</strong>g>in</str<strong>on</strong>g>g from the Government, but is steal<str<strong>on</strong>g>in</str<strong>on</strong>g>g from the<br />
elderly who have been delivered <str<strong>on</strong>g>in</str<strong>on</strong>g>to their care.<br />
Today's hear<str<strong>on</strong>g>in</str<strong>on</strong>g>g is a Federal hear<str<strong>on</strong>g>in</str<strong>on</strong>g>g. The commissi<strong>on</strong> has held<br />
and will hold State hear<str<strong>on</strong>g>in</str<strong>on</strong>g>gs <strong>on</strong> this subject. The resp<strong>on</strong>sibility for<br />
m<strong>on</strong>itor<str<strong>on</strong>g>in</str<strong>on</strong>g>g the system which delivers care to our elderly is jo<str<strong>on</strong>g>in</str<strong>on</strong>g>tly<br />
shared by Federal, State, and local governments. Cooperati<strong>on</strong> between<br />
the various levels of government is essential if the delivery of decent<br />
care is to be assured.<br />
We will lend every assistance possible to the Federal Government<br />
<str<strong>on</strong>g>in</str<strong>on</strong>g> their <str<strong>on</strong>g>in</str<strong>on</strong>g>vestigati<strong>on</strong>. We will ma<str<strong>on</strong>g>in</str<strong>on</strong>g>ta<str<strong>on</strong>g>in</str<strong>on</strong>g> open communicati<strong>on</strong> with<br />
the subcommittee and will make accessible all <str<strong>on</strong>g>in</str<strong>on</strong>g>formati<strong>on</strong> we have<br />
thus far uncovered.<br />
I welcome this opportunity to participate <str<strong>on</strong>g>in</str<strong>on</strong>g> the subcommittee's<br />
hear<str<strong>on</strong>g>in</str<strong>on</strong>g>g and hope that today is merely the first step <str<strong>on</strong>g>in</str<strong>on</strong>g> the partnership<br />
