50 to 51. Two persons namely Nazir Ahmad Lone & Gh.Mohmad Alias Munna<br />
R/O Baripora, Handwara Kupwara were arrested by the forces dur<strong>in</strong>g search<br />
operations some days earlier and taken to some <strong>in</strong>terrogation center near<br />
Handwara, were they were tortured and the dead bodies <strong>of</strong> the two persons with<br />
marks <strong>of</strong> violence on their body were handed over to their relatives through local<br />
Police. Their bodies bore burn <strong>in</strong>juries and some k<strong>in</strong>d <strong>of</strong> metal like substance was<br />
seen on their bodies. There were bullet <strong>in</strong>juries also on their bodies. The forces had<br />
also broken one leg <strong>of</strong> Nazir Ahmad.<br />
52. One Gh. Rasool Alhi S/O Ab. Ahad R/O Khuri-Batapora, Islamabad, was<br />
arrested by the forces dur<strong>in</strong>g search operations and his dead body was found near<br />
the locality on 12-1-92.<br />
53.One Mohd Subhan aged about 60 years R/O Medura, Tral <strong>of</strong> district Pulwama<br />
dur<strong>in</strong>g Crack-down operations was taken <strong>in</strong>to custody, dragged and taken to a<br />
nearby area, where he was ruthlessly beaten and drowned <strong>in</strong> cold water <strong>in</strong> the<br />
chilly w<strong>in</strong>ter till he breathed last. This <strong>in</strong>cident took place on 9-1-91.<br />
54. One Bashir Ahmad Alihai S/O Ab. Ahad R/O Khuri Batapora, Islamabad, a<br />
government employee <strong>in</strong> Sheep & Animal Husbandry department, was arrested by<br />
the forces dur<strong>in</strong>g search operations one day earlier and next day his dead body with<br />
marks <strong>of</strong> violence was found near the locality. The forces had killed him dur<strong>in</strong>g<br />
<strong>in</strong>terrogation. On his body there were marks <strong>of</strong> hot iron rods and bullet <strong>in</strong>juries on<br />
various parts <strong>of</strong> the body.<br />
55. In the month June 1990, at Zurhama, Kupwara district, the forces dur<strong>in</strong>g<br />
crack-down operations, directed the locals to assemble at a particuler place and one<br />
Nazir Ahmad S/O Saif Khan was dragged from the paddy field to the same place<br />
where the villegers had assembled. He was ruthlessly beaten. Thereafter his mother<br />
was called and <strong>in</strong> her presence the regular army cut the tongue <strong>of</strong> the boy and his<br />
eyes were gorged out. The army broke the head <strong>of</strong> the boy and his mother was<br />
asked to lick the blood <strong>of</strong> her son. This <strong>in</strong>cident has been mentioned <strong>in</strong> a writ<br />
petition titled Bar Association (Kupwara) V/S State and Others which is pend<strong>in</strong>g<br />
disposal <strong>in</strong> the High Court at Sr<strong>in</strong>agar.<br />
One writ petition has been filed for damages before the Hon'ble High Court by one<br />
Gh. Mohmad Shah <strong>in</strong> the second week <strong>of</strong> December, 1991 which is pend<strong>in</strong>g<br />
disposal. In this petition the petitioner has asked to pay damages to the tune <strong>of</strong> ten<br />
lacs and had to pay court fee <strong>of</strong> rupees ten thousand which mostly restra<strong>in</strong>s an<br />
ord<strong>in</strong>ary citizen to challenge the custodial deaths. The son <strong>of</strong> petitioner namely<br />
Shamim Ahmad Shah who was arrested by the forces along with some other<br />
person <strong>of</strong> the same locality (R<strong>in</strong>awari) Sr<strong>in</strong>agar dur<strong>in</strong>g crack-down operations. The<br />
dead bodies <strong>of</strong> both these persons were received by their relatives through local<br />
Police with marks <strong>of</strong> violence visible.<br />
