Ordinance No By AN ORDINANCE to take effect immediately provided it receives the affirmative vote of at least five 5 members elected to Council otherwise it shall take effect and be in force after the earliest period allowed by law amending section 1501 01 1995 Edition Adopted and section 1501 11 Copies of the Lakewood Codified Ordinances to adopt the most recent version of the Ohio Fire Code and to clarify where the public may access copies ofthe Code WHEREAS currently the 1995 edition of the Ohio Fire Code as adopted by the Ohio Department of Commerce Division of State Fire Marshall is the version that is in effect in the City of Lakewood and WHEREAS the Ohio Fire Code is amended from time to time causing the Ohio Department of Commerce to publish newer editions of the Code WHEREAS this Council by a vote of at least five 5 members elected thereto determines that this ordinance is an emergency measure and that this ordinance shall take effect at the earliest date possible as set forth in ARTICLE III SECTONS 10 and 13 of the SECOND AMENDED CHARTER OF THE CITY OF LAKEWOOD and that it is necessary for the immediate preservation ofthe public property health and safety and to provide for the usual daily operation of municipal departments in that it is necessary to have the most recent version of the Ohio Fire Code in effect within the City of Lakewood to ensure proper code enforcement Now therefore BE IT ORDAINED BY THE CITY OF LAKEWOOD STATE OF OHIO Section 1 That Section 1501 01 1995 Edition Adopted of the Lakewood Codified Ordinances currently reading as follows 1501 01 1995 EDITION ADOPTED Pursuant to OhioRC731 231 there is hereby adopted by the Municipality the 1995 edition ofthe Ohio Fire Code OFC as adopted by the Ohio Department of Commerce Division of State Fire Marshal published in Division 1301 7 of the Ohio Administrative Code OAC shall be and is hereby amended to read as follows 1501 01 EDITION ADOPTED Pursuant to OhioRC731 231 there is hereby adopted by the Municipality the 2007 edition ofthe Ohio Fire Code OFC as adopted by the Ohio Department of Commerce Division of State Fire Marshal published in Division 1301 7 of the Ohio Administrative CodeOAC The 2007 edition of the OFC shall be replaced U
automatically by the most recent edition of the OFC adopted by the Ohio Department of Commerce Division of State Fire Marshall Section 2 That Section 1501 11 Copies ofthe Lakewood Codified Ordinances currently reading as follows 1501 11 COPIES Copies of Codes as adopted in this chapter are on file with the Council Clerk for inspection by the public and also on file in the County Law Library and the Clerk has copies available for distribution to the public at cost shall be and is hereby amended to read as follows 1501 11 COPIES Copies of Codes as adopted in this chapter are on file with the Council Clerk for inspection by the public and also may be found on line atOhio gov under the section Fire Marshal Section 3 It is found and determined that all formal actions of this Council concerning and relating to the passage ofthis ordinance were adopted in an open meeting of this Council and that all such deliberation of the Council and of any of its committees that resulted in such formal action were in meetings open to the public in compliance with all legal requirements Section 4 That this ordinance is hereby declared to bean emergency measure necessary for the immediate preservation of the public peace property health safety and welfare in the City and for the usual daily operation ofthe City for the reasons set forth and defined in the preamble to this ordinance and provided it receives the affirmative vote of at least five 5 of its members elected to Council this ordinance shall take effect and be in force immediately upon its adoption by the Council and approval by the Mayor otherwise it shall take effect and be in force after the earliest period allowed by law Adopted 1 2 President of Council Clerk of Council
