Introduction<br />
The <strong>City</strong> <strong>Council</strong> invites offers from interested parties to manage the tennis courts and<br />
surrounding area as shown outlined in red on the attached plan. The designated site is<br />
<strong>West</strong> <strong>Beach</strong> <strong>Tennis</strong> courts, Whitstable.<br />
The Tender<br />
The Licence is for one year (coming ASAP after an operator has been chosen) only and is<br />
expected to commence on 1 May 2012. The licence is subject to terms and conditions<br />
shown below.<br />
It should be borne in mind that the Licensee will be expected to operate throughout the<br />
season. Income generated will depend on weather conditions as well as levels of service.<br />
Applicants should satisfy themselves as to the commercial potential of this site.<br />
The offers will be judged upon the qualities of the individual and the service they can offer to<br />
tennis in the local area. All court hire fees will be set by the <strong>Council</strong>, and all income from<br />
these will be split 50/50 (ex. VAT). Any profits from other activities (i.e. coaching) will not be<br />
split with the <strong>Council</strong>.<br />
There may also be the option to sell snacks and light refreshments from the kiosk within the<br />
grounds to users of the courts only, subject to permission from the <strong>Council</strong>.<br />
There are public toilets adjacent to the tennis courts which will remain under management<br />
of the <strong>Council</strong>.
Terms and conditions<br />
1. The Licensee shall be required to manage the ‘<strong>West</strong> <strong>Beach</strong> <strong>Tennis</strong> <strong>Courts</strong>’. This involves<br />
keeping records of all transactions and maintaining the courts.<br />
2. The payments to the <strong>Council</strong> shall be payable monthly in arrears and these shall be<br />
dependent on the income generated from court hire fees.<br />
3. The <strong>concession</strong> is available for a period of 12 months commencing ASAP once an<br />
operator has been chosen.<br />
4. The Licensee may be able to use the kiosk in the communal area to sell snacks and light<br />
refreshments to users of the courts only, subject to permission of the <strong>Council</strong>.<br />
5. The Licensee is obliged to operate on all days possible between dawn and dusk, except<br />
when it is not reasonably practical to do so.<br />
6. The <strong>Council</strong> reserves the right to alter or relocate the area of operation at any time on<br />
giving reasonable notice.<br />
7. The courts and surrounding areas are not to be used as residential accommodation.<br />
8. The Operator shall keep the site in a clean and tidy condition at all times, provide such<br />
waste bins as may be required and make good any damage that may be caused. Waste is<br />
to be removed from the site on a daily basis.<br />
9. The Operator shall display only such advertisements on the site as shall have the prior<br />
written consent of the <strong>Council</strong>.<br />
10. The Licensee is not to bring anything on to the land which is likely to be noxious or<br />
dangerous to other users of the land.<br />
11. The Operator shall not cause or permit there to be any noise nuisance or music from the<br />
<strong>concession</strong> area which might cause annoyance to members of the public in the area.<br />
12. The Operator shall be responsible for all outgoings incurred in the operation of the<br />
<strong>concession</strong> including business rates (if applicable).
13. The Operator shall indemnify the council against any claims arising out of the operation<br />
of the <strong>concession</strong> by taking out public liability insurance cover in the sum of £5,000,000 (five<br />
million pounds). The council requires sight of the insurance certificate before<br />
commencement of <strong>concession</strong>.<br />
14. The Licence is personal to the operator and may not be sublet, assigned, charged, dealt<br />
with or otherwise passed on.<br />
15. The prospective Licensee will be CRB checked and will only be offered the Licence if a<br />
satisfactory result is received.<br />
16. The Licensee will have a duty of care to ISA (Independent Safeguarding Authority)<br />
check all employees/volunteers.<br />
17. The <strong>Council</strong> reserves the right to terminate the agreement at its discretion if the terms of<br />
the Licence are not adhered to or an unsatisfactory service is being provided by the<br />
Operator.<br />
18. The Licensee is responsible for the payment of an administration fee of £75 in<br />
connection with the preparation of the Licence.<br />
