TERMS of BUSINESS for NEWLYN LODGMENT CENTRE<br />

1. Our terms of business set out the basis on which Newlyn Lodgment will provide a service to you. We are acting for the person<br />

on whose behalf the form overleaf is completed.<br />

2. Our Money Judgment Lodgment Service is set out overleaf.<br />

3. For any Writ that we prepare we will nominate an <strong>Enforcement</strong> Officer on your behalf unless you instruct us to the contrary.<br />

From our experience we will select the most suitable <strong>Enforcement</strong> Officer for the area of the debtor’s address.<br />

4. We are not able to provide legal advice on the appropriate means of enforcement, for which you must seek separate legal<br />

advice.<br />

5. If you wish to cancel an instruction or place a matter on hold then you must advise us as soon as possible by way of letter,<br />

fax, e-mail or telephone.<br />

6. If you cancel an instruction and the <strong>Court</strong> fee is unpaid then the disbursement will be refunded to you.<br />

7. We will action your instructions within 3 working days and forward you an acknowledgment within this period.<br />

8. We are dependent on <strong>Court</strong> turnaround times and there may be delays in issuing Writs of Fieri Facias when we need to obtain<br />

a Certificate of Judgment from a local County <strong>Court</strong>. If the delay lasts more than 28 working days we will inform you of the<br />

reasons for the delay.<br />

9. If a Writ of Fieri Facias or other document is lost in the post (or Document Exchange) we reserve the right to charge for the<br />

cost of obtaining a duplicate Writ.<br />

10. You are responsible for ensuring that all information you give to us is complete and accurate. We are not responsible for the<br />

checking of information given in your instructions.<br />

11. You will be contacted by the <strong>Enforcement</strong> Officer dealing with the enforcement of the Writ of Fieri Facias and from then all<br />

communications should then be with the <strong>Enforcement</strong> Officer direct and not The <strong>Enforcement</strong> Lodgment Centre.<br />

12. Your personal details will be added to our database to enable us to process your instructions and for keeping you informed of<br />

information about our services and any rule changes unless you advise us to the contrary.<br />

13. We will not pass your personal details to others, save for the <strong>Enforcement</strong> Officer instructed on your behalf, with whom we will<br />

share your information for the purposes of enforcement of the Writ of Fieri Facias.<br />

14. Partners of this Firm, Nicholas Alexander and Andrew Ewart-James, are authorised <strong>High</strong> <strong>Court</strong> <strong>Enforcement</strong> Officers and<br />

Solicitors, who specialise in the enforcement of Writs of Fieri Facias throughout the England and Wales.<br />

15. The Writ of Fieri Facias expires after 12 months. It is the responsibility of the claimant/claimant’s solicitors to renew the Writ<br />

prior to the expiry date. We are happy to carry out this service upon receipt of your instructions to do so one month prior to<br />

expiry.
