cute." John Broun, with whom <strong>the</strong> complainer<br />

lodged, did what he could to keep <strong>the</strong>m oQ.', but <strong>the</strong>y<br />

attacked him and hurt him deadly with a whinger in<br />

<strong>the</strong> breast. Complainer was taken up as dead, and<br />

carried to <strong>the</strong> house <strong>of</strong> Patrick Younj,^, Chirury;eon in<br />

Dumfries, "to be pansit"; and <strong>the</strong> said persons,<br />

learning that <strong>the</strong>re was still some appearance <strong>of</strong> life,<br />

" <strong>the</strong>n swelled in raig and fury, exclameing and<br />

cursing God and man for that thay left him afoir thay<br />

had sene that he wes dead." With drawn weapons in<br />

<strong>the</strong>ir hands <strong>the</strong>y came to Patrick Young's house<br />

•'and preasit to have brasheit <strong>the</strong> doores thair<strong>of</strong>, and<br />

to have enterit thairin to have endit <strong>the</strong> worke thay<br />

begane," but <strong>the</strong>y were repulsed by those who were<br />

present in <strong>the</strong> house.<br />

The parties, with <strong>the</strong> consent <strong>of</strong> <strong>the</strong> Council, agreed<br />

to submit <strong>the</strong> matter to <strong>the</strong> arbitration <strong>of</strong> David<br />

Johnstoun, merchant burgess <strong>of</strong> Edinburgh, and Mr<br />

John Hay, town clerk <strong>the</strong>re. The arbiters, however.
