his patrimony lie proceeded to carry fur<strong>the</strong>r <strong>the</strong> steps<br />

had slain his fa<strong>the</strong>r's younger bro<strong>the</strong>r, Andrew<br />

<strong>Lindsay</strong> <strong>of</strong> Rascarrel. This uncle was servitor to<br />

Lord Herries, and on <strong>the</strong> evening <strong>of</strong> <strong>the</strong> 17th Sep-<br />

tember 1596, at <strong>the</strong> Brigend <strong>of</strong> Dumfries (now<br />

Maxwelltown), he was set upon by John Carru<strong>the</strong>rs<br />

and George Graham, servitors to llobert Lord<br />

Sanquhar, who shot him through <strong>the</strong> body with a<br />

pistolet, " <strong>of</strong> <strong>the</strong> quhilk schotte, and be dyuerse<br />

u<strong>the</strong>ris crewall and deidlie woundis, given to him<br />

with suordis, quhingeris and u<strong>the</strong>ris forbiddin v/ap-<br />

poues, he schortlie thaireftir depairtit this lyfe.J<br />

The accused having failed to find caution to enter<br />

<strong>the</strong>mselves for trial, a petition was presented to <strong>the</strong><br />

Privy Council by <strong>the</strong> laird <strong>of</strong> Fairgirth for a com-<br />

mission <strong>of</strong> fire and sword against <strong>the</strong>m. This com-<br />

mission was granted to William Maxwell <strong>of</strong> Cowhill,<br />

Herbert <strong>Lindsay</strong> in <strong>the</strong> Mains, James <strong>Lindsay</strong> <strong>of</strong><br />

Barcloy, Robert Maxwell in Toure, Hugh <strong>Lindsay</strong> <strong>of</strong><br />

Rascarrel, and John <strong>Lindsay</strong> <strong>of</strong> Auchenskeoch, but<br />

it was not until nearly four years later that one <strong>of</strong><br />
