In the same year [1198], after the death of master Richard<br />

of Cold<strong>in</strong>gham, Philip, bishop of Durham, and Bertram,<br />

prior of the church of Durham, disagreed about the presentation<br />

of the churches of Richard aforesaid.<br />

For the bishop said that the presentation perta<strong>in</strong>ed to<br />

him, as to the bishop and abbot of the church of Durham.<br />

Aga<strong>in</strong>st <strong>this</strong> the prior replied that the presentation perta<strong>in</strong>ed<br />

to him, because his predecessors and himself had given<br />

them without opposition of any, as priors and lords of the<br />

soil, and as those who have all authority of the abbot <strong>in</strong> the<br />

choir, and <strong>in</strong> disposition of his house and revenues, by concession<br />

of the k<strong>in</strong>gs and appo<strong>in</strong>tment of the bishops of Durham<br />

and by confirmation of the Roman pontiffs.<br />

But not thus was that controversy stilled ; but rose <strong>in</strong>deed<br />

to such height that, by command of the bishop, Aimeric<br />

archdeacon of Durham besieged the church of St. Oswald<br />

and permitted<br />

<strong>in</strong> Elvet, <strong>in</strong> which the monks had taken refuge ;<br />

not provisions to be brought to them.<br />

And on a certa<strong>in</strong> day, after appeal- had been made by the<br />

monks to the chief pontiff, the same Aimeric caused fire to<br />

be applied to the door of the church, <strong>in</strong> order thus by smoke<br />

and fumes of the fire to drive out the monks. When t<strong>here</strong>fore<br />

the door was half-burnt, his evil satellites entered the church,<br />

and drove out the monks with force and an armed hand.<br />

But God turned the m<strong>in</strong>d of the bishop to a better way ;<br />

and through reverence for the most holy Cuthbert he granted<br />

the same church for the proper uses of the monks, and confirmed<br />

it with his charter. He also yielded to them the free<br />

disposition of their approval.<br />
