In the same year, after the Purification of the blessed virg<strong>in</strong><br />

John, bishop of Dunkeld, returned from the court of<br />

Mary, 2<br />

the lord pope ; Hugh, bishop of St. Andrews, hav<strong>in</strong>g been<br />

deposed. And hence the lord pope wrote <strong>in</strong> <strong>this</strong> form 3 :<br />

" Bishop Clement [III], servant of the servants of God, to<br />

his venerable brethren bishops Joscel<strong>in</strong> of Glasgow and<br />

Matthew of Aberdeen, and his beloved sons Arnold, abbot<br />

of Melrose, and Bertram, prior of Cold<strong>in</strong>gham, greet<strong>in</strong>g and<br />

apostolic benediction.<br />

" Lest the th<strong>in</strong>gs which are done should fall <strong>in</strong>to the<br />

suspicion of doubt, it is fitt<strong>in</strong>g that they be committed to the<br />

memorial of letters, and carried to the notice of thefti who seem<br />

to be concerned by <strong>in</strong>formation authoritative and truthful.<br />

Now we remember that pope Urban of good memory, our<br />

predecessor, commanded Hugh, formerly called bishop of St.<br />

Andrews, under penalty of excommunication, to present himself<br />

before the apostolic presence on a day fixed, to answer <strong>in</strong><br />

law concern<strong>in</strong>g the controversy which existed between him and<br />

our venerable brother John.<br />

But because he rebelliously refused to come, be<strong>in</strong>g conscious<br />

of his actions, and with reason <strong>in</strong> fear of the result of the<br />

judgment, we, for <strong>this</strong> and for many other th<strong>in</strong>gs which by the<br />

sp<strong>read</strong> of rumour have created s<strong>can</strong>dal to the church of God,<br />

have with counsel and assent of the brethren adjudged him by<br />

authority of the apostolic see for ever removed from the bishopric<br />

of St. Andrews, and suspended from the use of episcopal<br />

office until such time as the apostolic see shall see fit to decide<br />

otherwise regard<strong>in</strong>g him, absolv<strong>in</strong>g his subord<strong>in</strong>ates from the<br />

fealty by which they were held bound to him.<br />

Indeed s<strong>in</strong>ce the sanctions of the sacred <strong>can</strong>ons forbid that<br />

va<strong>can</strong>t churches should long lack pastoral rule, we command<br />

your Discretion by apostolic script that on our behalf you<br />

affectionately admonish our beloved sons the chapter of St.<br />

Andrews to choose for themselves such a bishop and pastor as<br />

<strong>can</strong> worthily possess the dignity of episcopal office.<br />
