And the same pope strictly charged John, bishop of St.<br />

Andrews, by force of obedience, that he should not presume<br />

<strong>in</strong> rash temerity through love or fear of anyone, or by any<br />

suggestion or wish, to forsake the church of St. Andrews to<br />

which he had been- consecrated, or to receive another ; add<strong>in</strong>g<br />

that, if he attempted it, without any qualification he would<br />

him of both. 2<br />

Alexius, t<strong>here</strong>fore, legate of the chief pontiff, and John,<br />

the elect of St. Andrews, came to England and set out, with<br />

the safe-conduct of the lord k<strong>in</strong>g of England, for <strong>Scotland</strong>.<br />

And the aforesaid legate on his arrival assembled the bishops,<br />

abbots, priors and the other prelates of the churches of the<br />

k<strong>in</strong>gdom of <strong>Scotland</strong> ;<br />

and hold<strong>in</strong>g a conference with them 3<br />

discussed at great length the elections of John and Hugh,<br />

and the consecration of Hugh.<br />

And when he learned that the aforesaid John had been<br />

<strong>can</strong>onically elected, and that Hugh had been forcibly <strong>in</strong>truded<br />

upon the episcopate of St. Andrews by the k<strong>in</strong>g of <strong>Scotland</strong><br />

after appeal had been made to the Roman pontiff, he deposed<br />

him without delay from the bishopric of St. Andrews, and<br />

by the authority which he exercised imposed perpetual silence<br />

upon him. And he confirmed the election which had been<br />

made of John, and caused him to be consecrated as bishop of<br />

St. Andrews by the bishops of <strong>Scotland</strong> ; the k<strong>in</strong>g neither<br />

forbidd<strong>in</strong>g nor ga<strong>in</strong>say<strong>in</strong>g it, nay rather permitt<strong>in</strong>g<br />

it, by<br />

advice of the bishops. 4<br />

When t<strong>here</strong>fore the k<strong>in</strong>g of <strong>Scotland</strong> saw the confusion<br />

of his bishop, he forbade bishop John 5 to tarry <strong>in</strong> his land.<br />

And Hugh conducted himself as bishop no less than before ;<br />

and tak<strong>in</strong>g away with him the episcopal hood, and the staff<br />

and the r<strong>in</strong>g, and the other th<strong>in</strong>gs which he had unlawfully<br />

reta<strong>in</strong>ed, departed to 6<br />
