and barons and knights of his k<strong>in</strong>gdom, by his summons, supplied<br />

And t<strong>here</strong> the aforesaid Vivian, legate of the apostolic see,<br />

came to the court of the k<strong>in</strong>g of England and on the ;<br />

day<br />

after the Lord's Ascension obta<strong>in</strong>ed of the lord k<strong>in</strong>g letters of<br />

his protection and safe-conduct, and returned to <strong>Scotland</strong> to<br />

perform his legation.<br />

And on the approach of the feast of sa<strong>in</strong>t Peter ad V<strong>in</strong>cula 5<br />

the aforesaid Vivian came to the castle of Maidens with the<br />

bishops and ecclesiastics of the k<strong>in</strong>gdom of <strong>Scotland</strong>, to hold<br />

t<strong>here</strong> a council of the statutes of the church.<br />

And <strong>in</strong> <strong>this</strong> council he suspended from episcopal office<br />

Christian bishop of Whithorn, 6 because he refused to come to<br />

that council. For he said that his episcopate perta<strong>in</strong>ed to the<br />

legation of Roger, archbishop of York, who had consecrated<br />

him as bishop, accord<strong>in</strong>g to the ancient custom of the predecessors<br />

of each and ; Roger himself, archbishop of York, had<br />

been constituted legate of his prov<strong>in</strong>ce by Alexander, the chief<br />

pontiff, and he claimed as belong<strong>in</strong>g to his right the subjection<br />

of the bishopric of Candida Casa, which is also called the<br />

bishopric of Whithorn <strong>in</strong> Galloway. 7<br />

Now when <strong>this</strong> council had been held, the aforesaid Vivian<br />

returned to Rome by mandate of Alexander, the chief pontiff,<br />

Christian, bishop of Galloway, had been present (13th March, 1177) <strong>in</strong><br />

the council of the Spanish award, and was a witness of the adjudication<br />

consecrated to Whithorn <strong>in</strong> 1154; Chr. of Hoi., 37.<br />
