to greater benefit and advantage both of the church and of<br />

the k<strong>in</strong>g, we have thought fit to grant to our brother, now<br />

elected bishop, although he has by no means asked for it,<br />

the legation <strong>in</strong> the whole realm entrusted to our son the k<strong>in</strong>g<br />

aforesaid, <strong>in</strong> order to correct t<strong>here</strong> what th<strong>in</strong>gs are to be<br />

corrected, and salutarily to decree the th<strong>in</strong>gs which ought to<br />

be decreed ; on <strong>this</strong> condition that if you unanimously agree<br />

<strong>in</strong> select<strong>in</strong>g his person, and the same k<strong>in</strong>g will impart his assent,<br />

he shall be orda<strong>in</strong>ed bishop <strong>in</strong> that church. And although<br />

such transferences ought not to take place without consultation<br />

and the assent of the Roman pontiff, yet he shall not<br />

need to return to the apostolic see for his confirmation, but<br />

thenceforth shall perform freely the legation placed upon<br />

him, and the plenitude of the episcopal office <strong>in</strong> that church,<br />

And we, after his ord<strong>in</strong>ation, shall be careful with God's help<br />

to confirm to him and to the aforesaid church which he shall<br />

rule its ancient and justifiable customs and dignities.<br />

And if you <strong>can</strong>not agree regard<strong>in</strong>g him, we command<br />

you to agree by common will and unanimous desire with regard<br />

to some other person literate, suitable and honourable,<br />

and be at pa<strong>in</strong>s to elect him as your pastor. And if you<br />

wish to present the elect to us, we shall both treat him honour-<br />

ably, and endeavour to honour him <strong>in</strong> every way we see fitt<strong>in</strong>g.<br />

And thenceforth the legation of <strong>this</strong> [William] be<strong>in</strong>g at an<br />

end, he who has been confirmed and consecrated shall obta<strong>in</strong><br />

by apostolic authority the legation through the whole realm<br />

of our aforesaid son the k<strong>in</strong>g, and shall exercise the office of<br />

legate freely <strong>in</strong> those parts.<br />

In the year of grace 1160 . . . Malcolm, k<strong>in</strong>g of Scots,<br />

returned to his own land from the army of Toulouse.<br />

And when he came to the vill which is called Perth earl<br />

Feretach 3 and five other earls, <strong>in</strong> anger aga<strong>in</strong>st the k<strong>in</strong>g<br />

because he had gone to Toulouse, besieged the vill of Perth,<br />

and wished to take the k<strong>in</strong>g but ; they could not.<br />
