1. Purpose of the supplementary report<br />

1.1 To update Cabinet Executive following recent clarification from<br />

Government Office of the East Midlands (GOEM) relating to ‘saved’<br />

policies.<br />

Appendix 1 to the original report, be agreed for submission to the<br />

Secretary of State.<br />

That the requested extension of “saved” policies in the <strong>Blaby</strong> <strong>District</strong><br />

Local Plan, as shown in Appendix 2 to the original report (and the<br />

additional policies specified in appendix 1 of this supplementary<br />

report), be agreed for submission to the Secretary of State.<br />

That delegated authority be granted to the Head of Planning and<br />

Environmental Health Services, in consultation with the Portfolio Holder<br />

for the Natural and Built Environment, to make any necessary<br />

amendments to the final Revised Local Development Scheme<br />

document and the request to extend the “saved” policies of the BDLP<br />

prior to their submission to the Secretary of State.<br />

Reasons for the Decision Recommended<br />

The RLDS and the request to extend “saved” policies of the BDLP must<br />

be submitted to the Secretary of State by 31 March 2007. The<br />

timetable set out in the RLDS represents the <strong>Council</strong>’s priorities for<br />

producing Local Development Documents (LDD) over the next 5 years.<br />

It is considered that this timetable is both realistic and achievable<br />

having regard to current Government guidance.<br />

Amendments to the RLDS and the request to extend “saved” policies,<br />

shown in Appendices 1 and 2 of the original report respectively (and<br />

the additional policies specified in appendix 1 of this<br />

supplementary report), may be necessary depending on the response<br />

of the GOEM to the current pre-submission discussions.<br />

6.1 Proposed amendments.<br />

6.1.1 Appendices 2 and 3 of the original report set out the policies that are<br />

proposed ‘to be saved’, and those that are proposed ‘not to be saved’.<br />

Following the drafting of the report to Cabinet Executive, GOEM has<br />

clarified advice relating to saved policies, indicating that they can only<br />

be saved in their entirety and not in part. Appendix 3 of the original<br />

report sets out parts of several policies that were proposed not to be<br />

saved. Given GOEM’s advice, it now appears that these policies need<br />

to be saved in their entirety to avoid the loss of that part of the policy<br />

which is still relevant.<br />

6.1.2 Appendix 1 to this supplementary report details additional policies<br />

originally contained in appendix 3 of the original report that now need<br />

to be saved. If the proposed revised recommendation is agreed, these<br />

additional policies will be forwarded to the Secretary of State as part of<br />

the saved policies contained in appendix 2 of the original report.<br />

7. Other Options Considered<br />

7.1 The <strong>Council</strong> must complete its RLDS in time for it to operate from 1<br />

April 2007. It must also make its request to extend the saved policies<br />

of the BDLP by this date. Delaying its submission to GOEM is not an<br />

option. Other options in respect of the content and timing of<br />

documents included within the RLDS have been considered when<br />

preparing Section 6 of this report and rejected because they are not<br />

considered to represent the priorities of this <strong>Council</strong> and/or their<br />

inclusion would result in a timetable which is unrealistic and therefore<br />

not deliverable. Other options in respect of the extension to “saved”<br />

policies have been considered and rejected because they were either<br />

not considered to satisfy Department for Community and Local<br />

Government Protocol, or their omission would leave an undesirable<br />

policy “void”.<br />
