DISCIPLINARY PROCEDURE – (continued)<br />
1.4 Should the Committee/Disciplinary Sub-Committee decide that action should be taken, one<br />
or more of the following penalties for each breach found may be placed upon the members:<br />
Informal stage:<br />
1.4a Written admonishment. No appeal<br />
1.4b Written censure (being a final warning). No appeal<br />
1.4c Monetary fine. No appeal<br />
Formal Stage:<br />
1.4d Suspension (in part or in whole) from:–<br />
• Showing or participation of the member or the member’s horses in any <strong>Association</strong><br />
recognised event, show or function<br />
• Receiving or retaining an accolade/prize Appeal procedure applies<br />
1.4e Expulsion from the <strong>Association</strong>. Appeal procedure applies<br />
1.5 The member shall be notified in writing of the Council/Disciplinary Sub-Committee’s<br />
findings <strong>and</strong> decision <strong>and</strong> any notice given shall be deemed to be given on the date such<br />
notice was posted by first class recorded delivery post to the last known address of the<br />
member.<br />
1.6 The member on receipt of any notice (refer 1.5) will have 28 days from the date of the letter,<br />
in which to submit a written appeal against the findings, decision or sanctions applied by<br />
the “Disciplinary Sub-Committee” after which an “Appeals Board” will be convened. No<br />
Solicitors letters may be entered into any appeal.<br />
the appeal should set out the reasons for objection <strong>and</strong> highlight any area of dispute<br />
regarding the facts of the matter.<br />
1.7 The BSPA Appeals Board will normally consist of three Council Members, 2 of who will be<br />
Trustees <strong>and</strong> chaired by either the Chairman of Company Secretary. The BSPA reserve the<br />
right to bring in an external person whose expertise is considered relevant but who will not<br />
be eligible to decide on the Appeal outcomes.<br />
1.8 BSPA members subject to Disciplinary procedures will have the right to address the appeal<br />
board in person <strong>and</strong> be accompanied by a support person (not a legal representative) who<br />
is not eligible to address board members, at stage 1.7 only<br />
