SECTION 1<br />

BUILDINGS OF SPECIAL ARCHITECTURAL OR HISTORIC INTEREST<br />

list 23tDdated ZLII('.q3 of <strong>build<strong>in</strong>gs</strong> of special architectural or historic <strong>in</strong>terest<br />

for your district.<br />

2. Application for the registration of the document <strong>in</strong> the register of local land charges<br />

will be made separately. A copy of the document is required to be made available for<br />

<strong>in</strong>spection by the public. Extra copies of the document are enclosed for your use.<br />

3. In accordance with the provisions of section 2(3) of the Act, the <strong>Council</strong> is required<br />

to serve formal notice of list<strong>in</strong>g or amendment on the owners and occupiers of each of<br />

the <strong>build<strong>in</strong>gs</strong> affected, except <strong>in</strong> the circumstances described <strong>in</strong> paragraph 4 below. The<br />

form of notice is prescribed <strong>in</strong> the Town and Country Plann<strong>in</strong>g (<strong>Listed</strong> Build<strong>in</strong>gs and<br />

Build<strong>in</strong>gs <strong>in</strong> Conservation Areas) Regulations 1990 (SI No 1519).<br />

4. Where amendments to the statutory list do not <strong>in</strong>volve the addition of a build<strong>in</strong>g to<br />

the lists, or the deletion of a build<strong>in</strong>g, there is no statutory requirement for the <strong>Council</strong><br />

to service fonnal notice of the amendment on the owners or occupiers of affected<br />

<strong>build<strong>in</strong>gs</strong>. It is, therefore, for the <strong>Council</strong> to decide <strong>in</strong> such cases whether it wishes to<br />

<strong>in</strong>fonn owners and occupiers. However, it may be helpful if I mention that wherever<br />

practicable btheDepartment sends a brief <strong>in</strong>formal letter of notification to owners,<br />

enclos<strong>in</strong>g a copy of its leaflet, <strong>in</strong> all cases where the grad<strong>in</strong>g of a build<strong>in</strong>g is changed by<br />

an amendment.<br />
